It was moved by Commissioner Courtney, seconded by Commissioner Burrowes, to approve January 2025 minutes as presented. Motion passed 5-0. b.Approval of Section Eight Management Assessment Program (SEMAP) certification for fiscal year end December 31, 2024. Ms. Randall presented the HUD Form 52648 SEMAP Certification for execution and transmission from the board. Ms. Randall explained the 14 key indicators of performance on the SEMAP and how the SEMAP is used to remotely measure PHA performance and administration of the housing choice voucher program. Based on staff’s examination of the Housing Authority’s records, staff anticipate receiving a score of 100 and a classification of high performer. It was moved by Commission Tanner, seconded by Commissioner Burrowes, to approve the SEMAP certification fiscal year end December 31, 2024. 3 Motion passed 5-0. c.Proposed allocation of 2025 Community Development Block Grant (CDBG) funds. No action required. Policy consideration: Does the Housing Authority Board have comments or further direction regarding the Bring It Home Program? Summary: Minnesota Housing is now accepting applications for the Bring It Home Rental Assistance Request for Proposals (“RFP”) in accordance with Minnesota Statute 462A.2095. Bring It Home (BIH) is a new program to create rental assistance for low-income families across Minnesota. Funded by state appropriations and the new metro sales tax for housing, the program will provide grants to Program Administrators (PAs) who will administer the program as direct assistance for renter households. The program funds Tenant-Based and Project-Based Rental Assistance for cost-burdened households earning up to 50% area median income (AMI) or less. Cost-burdened means a household that is paying more than 30% of the household’s annual income on rent. Priority for rental assistance shall be given to households with children 18 years of age and under and annual incomes of up to 30% of the area median income. A PA may provide Tenant-Based or Project-Based Rental Assistance in amounts equal to the difference between 30% of household income and the rent charged, plus an allowance for utilities if not included in rent. A PA may not provide assistance that is more than the difference between 30% of the tenant's gross income and 120% of the payment standard, plus utilities, as established by the local Public Housing Authority, unless otherwise authorized by Minnesota Housing. Minnesota Housing is providing authorization to use adjusted gross income instead of gross income to be consistent with the federal Housing Choice Voucher program. Like the federal Housing Choice Vouchers, households may continue to receive housing assistance as long as the household remains income-eligible and is compliant with Participant obligations Program design •By statute, HAs must prioritize households with children and household income up to 30% AMI. •Housing Authority board previously provided direction on the following St. Louis Park priorities ordered as: 1.30% AMI, with children and residency preference (lives, works or goes to school in St. Louis Park) 2.30% AMI with children (no residency preference) 3.30% AMI elderly, near-elderly, disabled with residency preference 4.30% AMI elderly, near-elderly, disabled (no residency preference) 5.Veteran preference •Staff intend to use the same payment standards and utility allowances as our HCV program with flexibility to go up to 120% as allowed by Minnesota Housing if necessary 5 Housing Authority meeting of April 9, 2025 (Item No. 6a) Page 2 Title: Bring It Home Discussion •The SLPHA BIH program will use: Option 2 - Amended HCV procedures, amending these sections of the admin plan for BIH: Elimination of an inspection requirement, given the robust rental licensing program in St. Louis Park. The requirement of landlords will be that they need to be in compliance with their rental license. Project Based vouchers: will be able to be approved through a non- competitive process; written requests shall be required to be submitted to the HA Board. The board will be allowed to approve up to 50% of the vouchers allocated to be project based. Elimination of PBV project caps and HA is committed to only project basing units that are 2 bedrooms and larger. Additional preference for lease in place Additional language to preserve eligibility for non-citizen applicants. The citizenship eligibility requirements for the SLPHA BIH program will be determined using the eligibility criteria outlined in Chapter 3-II.B of the current HCV admin plan. Housing assistance is available only to individuals who are U.S. citizens, U.S. nationals (herein referred to as citizens and nationals), or noncitizens that have eligible immigration status. At least one family member must be a citizen, national, or noncitizen with eligible immigration status in order for the family to qualify for any level of assistance. Next Steps: As part of the application MN Housing conducts a pre award risk assessment. This requires that no current principals of a potential grantee have been convicted of a felony financial crime within the last 10 years. A principal is defined as a public official, board member, or staff (paid or volunteer) with authority to access funds or determine how funds are used. HA Board members will need to complete the Certification of No Convictions of Felony Financial Crimes by a Principal form. Policy consideration: Does the Housing Authority Board agree with the proposed amendments to the ACOP? Summary: The Housing Authority is required to have an Admissions and Continued Occupancy Policy (ACOP) outlining policies and processes related to the administration of the Public Housing program. The policy allows for transparency, equity and objectivity. The ACOP allows others to understand the HA process, standardizes processes and decisions across HA staff, and ensures just treatment across cases. The ACOP must be in accordance with HUD regulations and requirements, be available for public review, and must be adopted by the HA Board. The HA contracts with Nan McKay for model updates to the ACOP to incorporate HUD rules and regulations. Nan McKay released a revision of the Model ACOP that was fully updated for HOTMA 102/104 and the HA board approved changes to the ACOP at the October 2024 board meeting. HUD has pushed back the compliance date for HOTMA 102/104 and HAs cannot fully apply the previous revisions which creates challenges for agencies who must continue to operate their programs under pre-HOTMA 102/104 policies while also managing a version of their policy that can be used immediately upon the HOTMA 102/104 compliance date. Nan McKay released a new update in early 2025to be applicable to both pre- and post-HOTMA 102/104 requirements. The update calls out policies that will be effective prior to the HA’s HOTMA 102/104 compliance date and those that will become effective upon the HA’s compliance date. These changes are in line with the policy approvals in October and do not require additional approvals by the HA board. The following additional policy changes are recommended for approval by the HA board: Chapter 4-III.B. Selection Method: Added local preferences to account for changes brought about by the HOTMA Voucher Final Rule affecting public housing. Chapter 13: Added policy section on asset limitation only applying at eligibility and clarified policy language regarding notice to vacate. HOTMA Appendix: Added a new appendix per recent HUD guidance to explicitly call out HOTMA 102/104 policies that are on hold until implementation. LOUIS PARK Resolution No. 772 Amendment to the Admissions and Continued Occupancy Policy (ACOP) WHEREAS, HUD requires housing authorities administering the Public Housing Program to have an Admissions and Continued Occupancy Policy (ACOP) for the effective administration and operation of its Public Housing program, and WHEREAS, the St. Louis Park Housing Authority has updated the ACOP to reflect changes to HUD Regulations and Requirements, and WHEREAS, the Housing Authority has updated the ACOP to reflect changes to HA policy as deemed appropriate, and WHEREAS, the Housing Authority has updated the following sections to the ACOP: Chapter 4-III.B. SELECTION METHOD, Chapter 13-III.C. OTHER AUTHORIZED REASONS FOR TERMINATION and 13-IV.D. SELECTION METHOD PHAs must describe the method for selecting applicant families from the waiting list, including the system of admission preferences that the PHA will use. Local Preferences [24 CFR 960.206] PHAs are permitted to establish local preferences and to give priority to serving families that meet those criteria. HUD specifically authorizes and places restrictions on certain types of local preferences. HUD also permits the PHA to establish other local preferences, at its discretion. Any local preferences established must be consistent with the PHA plan and the consolidated plan and must be based on local housing needs and priorities that can be documented by generally accepted data sources [24 CFR 960.206(a)]. If the PHA has a Housing Choice Voucher program, the PHA must offer, and if accepted, provide the family a selection preference for an appropriate-sized public housing unit that first becomes available for occupancy after the time period expires for an HCV family whose HAP contract is being terminated due to an owner failing to make required repairs within the required time frame, and who are unable to lease a new unit within the term of the voucher [24 CFR 982.404(e)(2)]. HA Policy Local preferences will be aggregated using a system in which each preference will receive an allocation of points. The more preference points an applicant has, the higher the applicant’s place on the waiting list. The PHA will use the following local preferences: Emergency VAWA Transfer Preference (1 point): The PHA will offer a preference to a family that includes a victim of domestic violence, dating violence, sexual assault, stalking, or human trafficking who are seeking an emergency transfer under VAWA from the PHA’s Housing Choice Voucher program or other covered housing program operated by the PHA. HCV Abatement-Affected Family Preference (2 points): The PHA will provide a preference for an HCV family whose HAP contract is being terminated due to an owner failing to make required repairs within the required time frame, and who were unable to lease a new unit within the term of the voucher. 9 Housing Authority meeting of April 9, 2025 (Item No. 6b) Page 4 Title: Approve Amendments to the Housing Authority Admissions and Continued Occupancy Policy (ACOP), Resolution No. 772 13-III.C. OTHER AUTHORIZED REASONS FOR TERMINATION [24 CFR 966.4(l)(2) and (5)(ii)(B)] Upon the PHA’s HOTMA 102/104 compliance date, the below section on the asset limitation is added: Asset Limitation [24 CFR 5.618; Notice PIH 2023-27] The PHA has discretion with respect to the application of the asset limitation at annual and interim reexamination. The PHA may adopt a written policy of total nonenforcement, enforcement, or limited enforcement as well as adopting exception policies. HA Policy The HA has adopted a policy of total nonenforcement of the asset limitation for all program participants. The asset limitation only applies to initial eligibility determinations for new admissions to the HA’s public housing program. 13-IV.D. LEASE TERMINATION NOTICE [24 CFR 966.4(l)(3) Form, Delivery, and Content of the Notice HA Policy The HA will attempt to deliver notices of lease termination directly to the tenant or an adult member of the household. If such attempt fails, the notice will be sent send the termination notice by first-class mail the same day. The HA may also deliver notices via email, the resident portal or attempt to deliver the termination notice directly to the tenant or tenant’s unit. All notices of lease termination will include a copy of the forms HUD-5382 and HUD-5380 to accompany the termination notice. Any tenant who claims that the cause for termination involves domestic violence, dating violence, sexual assault, stalking, or human trafficking of which the tenant or affiliated individual of the tenant is the victim will be given the opportunity to provide documentation in accordance with the policies in sections 13-III.F and 16-VII.D. Timing of the Notice [24 CFR 966.4(l)(3)(i) HA Policy Any Notice to Vacate or Notice to Quit that is required by state or local law will be combined with the Notice of Lease Termination under this section. 10 Housing Authority meeting of April 9, 2025 (Item No. 6b) Page 5 Title: Approve Amendments to the Housing Authority Admissions and Continued Occupancy Policy (ACOP), Resolution No. 772 HOTMA 102/104 Appendix to the ACOP Purpose of the Appendix HUD published a final rule on February 14, 2023, revising regulations related to income, assets, adjusted income, verification, and reexams (among others) to implement Sections 102 and 104 of HOTMA. While the new regulations were effective January 1, 2024, HUD has delayed the compliance date for HOTMA 102/104. Initially, HUD published a delayed compliance date of January 1, 2025, but HUD again delayed the compliance date for HOTMA 102/104 and no new date has been provided. Compliance with Sections 102 and 104 of HOTMA means not only applying HOTMA 102/104 regulations to affected programs but also reporting in HUD’s new Housing Information Portal (HIP) system. Currently, PHAs remain unable to comply with HOTMA 102/104 because compliance depends on transitioning from HUD’s IMS/PIC system (which is unable to accept HOTMA-compliant Form HUD-50058) to HUD’s new HIP system (which will be the only system that accepts HOTMA-compliant Form HUD-50058). PHAs cannot transition to HOTMA until HIP is in place, HOTMA-compliant, and accessible. However, HUD has determined that a few HOTMA 102/104 policies are not dependent on transition systems and easily isolated from other HOTMA 102/104 policy changes. These policies may be implemented prior to the migration to HIP. HUD stated that PHAs may update their policy documents before determining the date at which they will transition to all HOTMA Section 102 and 104 policies. HUD stated that in order to update their policy documents for HOTMA in this circumstance, PHAs may create an appendix that contains the HOTMA policies that will be incorporated at a later date. The model policy adopts such an approach. HOTMA 102/104 policies are provided in each affected area of the model policy. However, with the exception of the policies HUD has indicated may be adopted early, HOTMA policies that are “on hold” are indicated in the model policy as such.
