1. POST Board Presentation and Q&A (Executive Director Eric Misselt)
Overview
Officers licenses renew every three years through the POST Board. Website has much of the
information available; Jurisdiction is important particularly regarding the local level. POST
discipline and Agency discipline are two very different things.
POST was created in 1977 by legislation. One of the first licensing systems in the country.
(Wisconsin is a certification state; licensing and certification are different approaches) POST
Board is relatively stable, was “stagnant” for 40 years. Expectation of the Board has
changed and the Board is changing along with public perception. “What is the role of the
POST Board?”

POST has a Rules and Legislative Coordinator and an Advisory Committee to the Board.
Licensing and Regulatory Agency. Board Membership is appointed by the Governor. 17
Members on the POST Board. Oversee testing, licensing, continuing ed. (48 hrs per 3 year
license), and standards of conduct. POST Board does not have its own investigators, but the
Executive Director has the authority to order an investigation.
417 Law Enforcement Agencies, 307 Municipal PDs.
Standards of Conduct
Standards of Conduct is currently undergoing rule-making changes. The Board feels there
should be the ability to get involved with a charge, instead of getting a conviction. Excessive
Use of Force is not within the POST Board Jurisdiction; being added through rule-making.
Complaint Process
Complaint Investigation Committee (CIC) is made up of 4 Board Members. POST receives
complaints from any sources; review the complaint for jurisdiction, mail a receipt letter
regarding the complaint. Many are misunderstanding regarding if Officer has the authority.

License Disciplinary Process
Licensing sanctions are completely separate issues from any other discipline administered
by the employers or criminal sanctions.
Subject of complaint informed, brought before a hearing, two attorneys for the Board (one
for the CIC, one for the Board). One of two happens:
• CIC proposes settlement agreement and consent order with licensee
OR
• An administrative hearing in front of an administrative law judge (ALS)
After the above, the issue goes before the FULL Board for action
Disciplinary Data Classification
If there is final disciplinary action the data becomes public. (Public License Portal)
Legislative Session
Proposed bills to increase or provide funding for:
• Recruitment of Officers
• Retention of Officers
• Increasing diversity in applicants
• Reimbursement of higher education costs
• Reimbursement of schools providing free Use of Force training
POST related legislation: removing criminal conviction as the only way for a license to be
revoked, and funding a large increase in staff to conduct investigations and complete
compliance reviews.
Mandatory Misconduct Reporting
Violations in standard of conduct and policies need to be reported in real time. (Model
Policies)
