HomeMy WebLinkAbout23-058 - ADMIN Resolution - City Council - 2023/05/01Resolution No. 23-058 Resolution accepting conveyance of real property (conveyance parcel 2021-0067) Whereas the Minnesota Department of Transportation (the “department”) is the owner of certain real property located at the 2800 block of Toledo Avenue South, St. Louis Park, MN, as legally described on the attached exhibit A ("property"); and Whereas the department is proposing to convey property to the city for consideration of zero dollars, as conveyance parcel 2021-0067, as outlined in an offer letter that was submitted to the city on November 15, 2022 (“offer”); and Whereas the department proposes a restriction on the use of the property which requires a covenant in the deed that the city will use the property for park purposes; and Whereas the City of St. Louis Park desires to acquire the property for public park purposes; and Whereas the city has determined that acquiring the property is necessary for public purposes and is in the best interests of the city to acquire the property; and Whereas Minn. stat. § 462.356, subd. 2 requires that the planning commission review the city's proposed acquisition of real property for compliance with the comprehensive plan and to report to the city council in writing its findings; and Whereas Minn. stat. § 462.356, subd. 2 provides for an exception from the requirement for review by the planning commission upon 2/3 vote of the city council dispensing with the requirement and finding that the acquisition or disposal of the real property has no relationship to the comprehensive municipal plan. Now ther efore be it resolved by the city council of the City of St. Louis Park, Minnesota, that: 1. The conveyance of the property has no relationship to the comprehensive municipal plan and review by the planning commission of the acquisition of the subject property is hereby dispensed with. 2. The department’s offer proposing conveyance of the property from the department to the city is hereby accepted, subject to the restrictions on use as outlined in the offer. 3. The mayor and city manager are authorized and directed to execute all documents and take all appropriate measures necessary to effectuate the conveyance of the property, including but not limited to the execution of any and all documents necessary to transfer title to the city, subject to the applicable restrictions on use. The city manager is directed to take all necessary steps to utilize the property for public park purposes consistent with the restrictions on use. 5. This resolution shall take effect immediately upon adoption.
