January 5, 2004
1. Call to Order
Mayor Jacobs called the meeting to order at 7:30 p.m.
Prior to calling the roll, Mayor Jacobs asked that Judge Allen Oleisky swear in new
Councilmembers. Judge Oleisky read the oath of office for the following
Councilmembers for offices indicated:
Jeffrey W. Jacobs Mayor Four Year Term
Paul G. Omodt Councilmember At-Large A Four Year Term
Phillip Finkelstein Councilmember At-Large B Four Year Term
John W. Basill Councilmember Ward Two Two Year Term
Following the swearing in ceremony, roll was taken with the following Councilmembers
present: John Basill, Paul Omodt, Sue Santa, Sue Sanger, Sally Velick and Mayor Jeff
Jacobs.
Also present were the Interim City Manager/Community Development Director (Mr.
Harmening); City Attorney (Mr. Scott); and City Clerk (Ms. Reichert)

3. Approval of Minutes
3a. City Council Minutes of December 15, 2003
From Councilmember Santa: The minutes as presented did not indicate the names of the
recipients of the Human Rights Awards. Council directed staff to correct the minutes by
adding the names of the recipients. With that correction the minutes were approved as
presented.
3b. City Council Special Meeting Minutes of December 22, 2003
The minutes were approved as presented.
4. Approval of Agenda and Items on Consent Calendar

4h Approve the Bilateral Compliance Agreement with the Minnesota Department of
Health and authorize the City Manager to execute the agreement for the City
4i Accept Fire Civil Service Commission Minutes of February 3, 2003
4j Approve execution of a lease with Benilde-St. Margaret’s School for a locker
facility located under the west side bleachers of the west arena in the St. Louis
Park Rec Center
4k Accept Vendor Claims for filing (Supplement)
Interim City Manager, Tom Harmening, suggested that item 4g Motion to adopt resolution
declaring 2004 City Council meeting dates be moved to the regular agenda as item 8b.
It was moved by Councilmember Sanger, seconded by Councilmember Santa, to approve the
Agenda and items listed on the Consent Calendar as amended.
The motion passed 7-0.
5. Boards and Commissions
5a. Appointments to Boards and Commissions
It was moved by Councilmember Santa, seconded by Councilmember Velick, to appoint
Michael Baum, Joan Cichosz, Maureen Gormley, Jim Lanenberg, Sharon Berry, Anthony
Del Percio, C. Marie Campion, and Carl Ohlinger to the Police Advisory Commission.
The motion passed 7-0.
6. Public Hearings
6a. Public Hearing to consider granting an on-sale intoxicating and Sunday sale
liquor license to ABG Restaurant Corporation DBA Europa, 600 South Hwy
169, St. Louis Park MN

Ms. Reichert stated that all requirements of the license had been met and staff
recommended approval contingent upon receipt of the Certificate of Occupancy.
With no one wishing to speak, Mayor Jacobs closed the public hearing.
It was moved by Councilmember Velick and seconded by Councilmember Basill to
approve an on-sale intoxicating and Sunday sale liquor license effective January 15,
2004, contingent upon issuance of Certificate of Occupancy.
Motion passed 7-0.
7. Requests, Petitions, and Communications from the Public: None
8. Resolutions, Ordinances, Motions
8a. Election of Mayor Pro-Tem. Resolution No. 04-001
It was moved by Councilmember Velick, seconded by Councilmember Santa, to adopt
Resolution No. 04-001 appointing Councilmember Sanger as Mayor Pro-tem.
The motion passed 7-0.
8b. Declaring 2004 City Council meeting dates. Resolution No. 04-002
Mr. Harmening informed the council that the council meeting schedule as presented
called for a meeting on April 5th which would fall on Passover. He suggested that the
schedule be changed to reflect no meeting the week of April 5th with a regular meeting
and study session to be held the following week on April 12th.
It was moved by Councilmember Santa, seconded by Councilmember Basill to adopt
Resolution No. 04-002 declaring 2004 City Council meeting dates as amended.
The motion passed 7-0.
Ms. Reichert pointed out that meeting dates are set in advance for planning purposes, but
the date of any meeting can be changed in accordance with the Council Rules and
Procedures with proper notice.

WHEREAS, Carolyn Irrgang began her employment with the City of St. Louis Park on February 5,
1979; and
WHEREAS, throughout her career in a support position in the Police Department, Carolyn has
served as a liaison to several City prosecutors and the Hennepin County court system; and
WHEREAS, through her enthusiasm and tenacity, Carolyn has earned the respect of peers and

WHEREAS, Lorin Kramer began his employment with the City of St. Louis Park over 28 years ago
on November 3, 1975; and
WHEREAS, through his enthusiasm and tenacity, Lorin has earned the respect of peers and citizens;
and
WHEREAS, Lorin has made countless contributions in his commitment to his job and has served the
City in the Police Department as a patrol officer, undercover officer, investigator, patrol sergeant,
investigations sergeant; and
WHEREAS, Lorin received numerous awards for his service to the citizens of St. Louis Park; and
WHEREAS, Lorin has volunteered for Training Officer, the Departments Emergency Response
Unit, to serve on the Human Rights Commission; and
WHEREAS, Lorin has shown great devotion and commitment to his wife Sue;

WHEREAS, Rodney has made countless contributions in his commitment to his job and has served
the City in the Police Department as a patrol officer, undercover officer, investigator, patrol sergeant,
investigations sergeant, captain, and interim chief of police; and
WHEREAS, Rodney received numerous awards for his service to the Citizens of St. Louis Park; and
WHEREAS, Rodney has volunteered for Training Officer, Range Officer, the Departments
Emergency Response Unit, Emergency Response Unit Supervisor; and
WHEREAS, Rodney has shown great devotion and commitment to his children and is committed to
an active involvement with his children;

June 10, 1966; and
WHEREAS, through her enthusiasm and tenacity, Bridget has earned the respect of peers, citizens,
boards and commissions; and
WHEREAS, Bridget has made countless contributions in her commitment to her job in Parks and
Recreation and in her service on committees such as serving as liaison to Parktacular, Historical Society,
and youth associations over the years, organized the Youth Activities Grant; and
WHEREAS, Bridget received the Spirit of St. Louis Park Award; and
WHEREAS, Bridget is active in creative art activities and spending time with her grandchildren.

WHEREAS, Dennis Johnson began his employment with the City of St. Louis Park on July 28,
1969; and
WHEREAS, through his enthusiasm and tenacity, Denny has earned the respect of peers and
citizens; and
WHEREAS, Denny has made countless contributions in his commitment to his job and in his service
to the public in Public Works as an Engineering Technician in designing and inspecting a significant
number of capital improvement projects for the City including street reconstruction, water main
installation, storm sewer and sanitary sewer replacement, and sidewalk construction; and
WHEREAS, Denny is known for his attention to detail, technical knowledge, and sound judgment in
relation to providing services to the public; and
WHEREAS, Denny plans to remain active spending time with his family while continuing his
interests in hunting and woodworking;
NOW THEREFORE BE IT RESOLVED that the City Council of the City of St. Louis Park,
Minnesota, by this resolution and public record, would like to thank Dennis Johnson for his great

1966; and
WHEREAS, through his enthusiasm and tenacity, Bob has earned the respect of peers and citizens;

WHEREAS, Bob has made countless contributions in his commitment to his job and in his service to
the public in Public Works as an Engineering Technician through his surveying work such as numerous
capital improvement projects, street reconstruction, alley construction, water main replacement, and
sewer construction; and
WHEREAS, Bob is active in building and restoring classic cars and will continue to pursue other
interests;

4b. Adoption of a Snow and Ice Control Policy
BACKGROUND: In April of 1988, City Staff adopted a practice for snow and ice control.
Since that time many changes have occurred to the transportation system outdating that practice
statement. In 1999, the League of Minnesota Cities recommended we adopt a written policy. A
written policy would address the timing of plowing and/or ice control, priorities in routes and
procedures, general guidelines for use of materials and equipment, and flexibility to change
procedures in response to weather and road conditions. It can also help inform residents about
what to expect from the City and provide them with fair and uniform treatment during snow
removal operations. Policies that balance the competing needs of road safety, employee safety,
and fiscal constraints, can offer some protection against liability for accidents or litigation. A
policy can also help employees and residents to understand the timing and importance of all
operations by setting priorities.
In September, 2000, Council adopted the City’s first formal snow and ice control policy.
Recently, Council adopted revisions to the snow parking ordinance changing the effective depth
of the parking ban from 2 inches to 3 inches, and eliminating the 8:00 a.m. to 5:00 p.m.
restriction on the hours of the parking ban. The attached snow policy updates the 2000 policy
with changes resulting from the recent ordinance revisions, budget reductions, equipment
upgrades, and sidewalk/trail additions.
No significant changes were made to the existing Snow and Ice Control Policy. Most revisions
were due to the switch from sand/salt to salt only for ice control, the consolidation of plow routes
and the revision of the snow removal parking ordinance.
RECOMMENDED ACTION: Motion to adopt the attached resolution accepting the revised
City of St. Louis Park Snow and Ice Control Policy.
The City Attorney has reviewed the revised policy.

RESOLUTION REVISING (OR UPDATING) THE CITY’S
SNOW AND ICE CONTROL POLICY
WHEREAS, the City adopted a Snow and Ice Control Policy with Resolution No.00-121
in September 2000; and
WHEREAS, the City Council of the City of St. Louis Park wishes to revise their snow
and ice control policy due to recent ordinance revisions; and
WHEREAS, the policy attached to this resolution titled “Snow and Ice Control Policy –
January 20, 2004” has been updated by staff for Council for just such a purpose
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis
Park, that the City hereby:
1. Rescinds Resolution 00-121, Resolution Establishing a City Snow and Ice Control
Policy (dated September 18, 2000).
2. Adopts the Snow and Ice Control Policy Attached as Exhibit A to this resolution
(dated September 20, 2004).

SNOW AND ICE CONTROL POLICY
JANUARY 20, 2004
I. PURPOSE AND NEED
The City of St. Louis Park, being an established City, needs to routinely review their policy
regarding efficient and timely removal of snow and control of ice. Reasonable snow and ice
control is necessary for routine and emergency travel by the motoring public. The City will
provide such control in a cost-effective manner keeping in mind safety, budget, personnel, and
environmental concerns. The City will use city employees, equipment, and/or private contractors
to provide this service. This policy outlines the current practice within the Public Works
Department in order to accomplish this goal.
II. PRACTICE FOR SNOW PLOWING, SANDING/SALTING, REMOVAL, ETC.
Each year the Public Works Department updates its snow removal map of the City that
establishes priority systems for snow removal. Under the direction of the Public Works Director
items may be added to or deleted from the attached priority listings. Staff will determine the
priority for alleys, trails, sidewalks, bus stops, bridges, recreational areas, parking lots, and
streets within the system. For purposes of snow and ice control our city is divided into eleven
(11) street plow routes, four (4) cul-de-sac/parking lot routes, two (2) alley routes, three (3)
sidewalk/trail routes, and two (2) bridge/bus stop routes. These routes are periodically reviewed
and revised to correspond with the budgetary, equipment and personnel resources available.
Within each of the areas, the City has classified their snow removal efforts based on function and
the importance to the welfare of the community. The priorities listed as “A” will generally be
cleared first. These facilities connect major sections of the city with access points to the
Metropolitan Highway System and provide access for fire, police and medical services including
the Fire and PD driveways. The priorities listed as “B” will generally be cleared second. These
facilities provide direct service to residential neighborhoods, schools, commercial property,
parking lots with scheduled events and other facilities with similar type activities. Due to
scheduling at the Recreation Center, City Hall or other City facilities these lots may need to be
cleared prior to the scheduled event. If so, staff will make every effort to clear these lots prior to
the events. The priorities listed as “C” will generally be cleared third. These are facilities such as
low volume residential streets, City-owned parking lots, city alleys, park and ride lots, highly
used skating rinks/ped bridges/sidewalks/trails, and other facilities with similar type activities.
The priority “D” will generally be cleared fourth. These facilities are areas such as cul-de-sacs,
less used ped bridges/trails/sidewalks/skating rinks, bus stops, other municipal lots, and other
facilities with similar type activities. The Priority “E” will generally be cleared last. This

generally consists of clearing and/or removal of stored snow from facilities such as storage areas,
bus stops, bridge approaches, parking lots, intersections, low use open skating rinks, and other
facilities with similar type activities. These activities will generally begin after clearing
operations have ceased and as weather conditions, safety related items, and personnel resources
dictate. Generally, with a typical snow event, all snow removal priorities can begin immediately
upon commencement of operations. However, this is dependent on such things as the type of
storm, personnel available or the equipment resources available.
The Public Works Operations Superintendent, Street Supervisor, or their designee (herein
referred to as “Supervisor”), with the assistance of the Police Department, will monitor the
weather and street conditions prior to and during snow and ice events. The Supervisor will
determine the timing, amount of equipment, and personnel necessary to safely clear the streets.
The Supervisor has the responsibility of determining the plow routes and the sequencing of
operations based on budgetary implications, equipment, personnel resources available and other
conditions warranting change. The Supervisor shall retain the flexibility to adjust sequencing or
route assignments at any time. These routes will be periodically reviewed and revised based on
economic, political, or budgetary implications to accomplish a balanced as well as economical
approach to snow removal.
III. COMMENCEMENT OF OPERATIONS
Snow clearing and/or ice control operations shall commence under the direction of the
Supervisor. This action may include application of a sand/salt mixture for ice control,
implementation of snow clearing procedures, or snow removal procedures. During and following
a snowfall or ice event the Supervisor will determine the manpower and equipment needed based
on the environmental conditions and the provisions of this policy.
In general, snow removal operations shall commence when one of the following occurs:
• Snow accumulation of 3", with continual snow fall, warrants commencement of full
operations and the initiation of snow removal parking restrictions as stipulated in
Ordinance #30-158.
• Snow accumulation less than 3” or drifting of snow may warrant commencement of
partial or full operations depending upon conditions, but snow removal parking
restrictions will not be initiated.
• Icing of pavements may warrant partial or full operation depending upon extent and
conditions.
• Any other type of emergency as determined by the Supervisor.
IV. HOW SNOW WILL BE CLEARED
Snow shall be cleared in a manner so as to minimize traffic obstructions. The center of the
roadway will be cleared first. The snow shall then be pushed from left to right with the
discharge going onto the boulevard area of the right-of-way. It is the Department’s goal to have
the entire system cleared after a “typical” snowfall in approximately 12 hours. The sidewalk/trail

system may require more than 12 hours to complete based on event conditions, availability of
personnel, and equipment resources available. Generally, with a “typical” snowfall, all snow
removal priorities can begin immediately upon commencement of operations. In the event of a
major snowfall all available equipment and/or personnel may be assigned in accordance with the
priority provisions of this City Policy. With all major snowfalls the Supervisor will direct staff to
follow the priority system listed in exhibit “A”. With any event the Supervisor reserves
flexibility to evaluate each event, set the priorities, and determine start times. Normally, ice
control and snow removal operations will begin early enough to allow the City forces to prepare
the priority “A” and priority “B” streets prior to morning rush hour traffic. Snow removal of
areas listed as priority “C” and “D” shall generally commence after the clearing of priorities “A”
and “B” has been completed. The city’s snow removal parking ban is in effect on most
residential streets whenever snow accumulation exceeds 3” in order to provide the most effective
method for snow removal (Ordinance Section 30-158). Clearing of sidewalks and trails shall
generally commence with the priority “B” streets. Depending on snowfall conditions and
duration of the storm, cleanup operations can fluctuate widely. Widening and clean-up
operations may continue immediately or on following workdays depending upon conditions and
circumstances. The City will provide an operator and equipment to maintain access for
emergency, fire, police and medical services during major snowstorms to the best of their ability.
City maintenance employees will attempt every day to leave the streets in good winter driving
condition as they go out of service.
V. USE OF SAND AND SALT
The City is concerned about the effect of sand and salt on the environment and will limit its use
for that reason. Application of the sand/salt mixture is generally limited to major routes, steep
grades, and intersections. Application is limited on lower volume streets and cul-de-sacs. The
City cannot be responsible for damage to grass caused by the sand/salt mixture and therefore will
not make repairs or compensate residents for salt damage to turf areas in the street right-of-way.
VI. SUSPENSION OF OPERATIONS
Generally, operations shall continue until all roads are passable. Safety of the plow operators and
the public is important. Therefore, snow fighting operations may be terminated after 10-12 hours
of continual clearing to allow personnel adequate time for rest within a 24 hour period. There
may be instances when this is not possible depending on storm conditions and other
circumstances. Operations may also be suspended during periods of limited visibility and/or
severe weather conditions. Any decision to suspend operations shall be made by the Supervisor.
Suspending operations shall be based on the conditions of the storm, safety, and effectiveness of
the clearing operation.
VII. PROPERTY DAMAGE
Snow removal and ice control operations can cause property damage even under the best of
circumstances and care on the part of the operators. The major types of damage are to
improvements installed by residents within the City right-of-way that extend beyond the curb

location. This right-of-way area is often misconstrued as private property. The intent of the
right-of-way is to provide room for snow storage, utilities, sidewalks and other City uses. The
City is not liable for private installations within this right-of-way area. However, certain private
improvements such as mailboxes are required within this area. Therefore, the City will
cooperate with the property owner to determine if any damage is the responsibility of the City
and when it shall be the responsibility of the resident. The City accepts responsibility and will
repair or replace mailboxes if the damage is by physically being struck by a plow blade, wing, or
other piece of equipment. Mailboxes should be constructed sturdily enough to withstand snow
rolling off a plow or a wing. Therefore, damage resulting from the weight of the snow is the
responsibility of the resident. Damage to fences, trees, or other structures will be repaired or
replaced by the City only if they are on private property. Grass areas on public right of way that
are scraped or gouged by City equipment will be repaired by top dressing and seeding the
following spring. Residents are responsible for watering, if necessary, the areas that have been
repaired.
In instances where there is disagreement as to the source of the damage and the responsibility
therefore, the Director of Public Works and/or the Operations Superintendent shall determine the
responsibility.
VIII. DRIVEWAYS OR SIDEWALK OUTWALKS
One of the most frequent and frustrating problems for City personnel and the public is the
clearing of snow from public streets that results in snow being deposited in driveway, outwalk,
or sidewalk openings. Snow that accumulates on the plow blade has no place to go but in those
areas. The City’s plow operators make every reasonable attempt to minimize the amount of
snow deposited in these areas, but the amount can still be significant. City personnel do not
provide private driveway, sidewalk, or outwalk cleaning.
IX. MAIL DELIVERY
The snow plow operators make every effort to remove snow as close to the curb line as practical
and to provide access to mailboxes for the Postal Department. However, it is not possible to
provide perfect conditions and minimize damage to mailboxes with the size and type of
equipment the City operates. Therefore, the final cleaning adjacent to mailboxes is the
responsibility of each resident.
X. PARKING RESTRICTIONS AND SIDEWALK SNOW REMOVAL
St. Louis Park Ordinance Section 30-158 restricts parking on residential streets anytime (day or
night) there is three (3) inches or more of fresh snow on the ground. The ordinance does allow
for the issuance of free parking permits for those households that do not have sufficient space to
park at least two cars off of the street. Additionally, Council has established specific areas
within the city (mostly commercial and high density, multi-family housing areas with
insufficient parking) which are exempt from the parking restrictions. Exempt areas are
authorized by Resolution 03-180 and listed in Attachment L. Council has also adopted a fee-

based parking permit system for those households with adequate off-street parking for two
vehicles but own three or more vehicles. The fee-based permit system is authorized by
Resolution 03-153.

XI. COMPLAINTS
Complaints regarding snow/ice control or damage shall be taken during normal working hours
and handled in accordance with the City’s complaint procedures. Complaints involving access to
property, safety, or problems requiring immediate attention shall be handled on a priority basis.
Response time should not exceed forty-eight (48) hours for any complaint. Responses are to
ensure that the provisions of this policy have been fulfilled and that all residents of the City have
been treated uniformly.
XII. EMERGENCY NOTIFICATION OF CHANGING CONDITIONS
The Supervisor normally is notified of snow and ice condition after hours, on weekends, and
during holidays by the Police Department. Icing of pavements may warrant a partial or full
operation. The responding individual shall assess the conditions, assign manpower, and
equipment as the conditions require. For commencement of snow removal operations the
Supervisor reserves flexibility to evaluate storms and determine start times. A notification may
be required for one or more of the following:
• General snow removal questions.
• Snow accumulation of 2", with continual snowfall.
• Drifting of snow warranting commencement of partial or full operation.

SNOW, RUBBISH REMOVAL Sec. 24-341. Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Current service means one or more of the following activities by the city: (1) Removal of dangerous snow, ice or rubbish from public sidewalks and public rights-of-way; and (2) Repair of unsafe sidewalks. Sec. 24-342. Snow, ice and rubbish a public nuisance on sidewalks; removal by owner. (a) All snow, ice and rubbish being on a public sidewalk or public right-of-way in such quantities, or in such a manner, as to render the use of the sidewalk by a pedestrian unsafe, is hereby declared a public nuisance. (b) The owner or occupant of any property abutting a public sidewalk shall remove and clear away all snow, ice and rubbish from so much of the sidewalk as is in front of or abuts on the property as follows: (1) Snow and ice shall be removed from all sidewalks in all business and industrial districts within four business hours after the cessation of any fall of snow, sleet or freezing rain or by the beginning of business hours of the next business day following such fall, whichever period is shorter. Snow and ice shall be removed from all other sidewalks on the same day of the cessation of any fall of snow, sleet or freezing rain when at least six hours of daylight remain after the cessation, or otherwise by noon on the following day, whichever period is longer. (2) Rubbish shall be removed from all sidewalks within 12 hours after its accumulation thereon.

Sec. 24-343. Sidewalk in disrepair a public nuisance; duty of owner. (a) A public sidewalk in such a condition of disrepair as to render its use by a pedestrian unsafe is hereby declared a public nuisance. (b) The owner or occupant of any property within the city abutting a public sidewalk shall keep the sidewalk in repair and safe for use by pedestrians. Repairs shall be made in accordance with standard specifications on file with the city. Sec. 24-344. Abatement notices. (a) Snow, ice and rubbish removal. When an owner or occupant permits a nuisance to exist in violation of section 24-342, the city may serve a notice on the owner of the property ordering removal, elimination or repair of the nuisance within one day after the service. The notice shall state that in the event of noncompliance, removal or elimination may be done by the city at the owner's expense, and, that if the expenses are not paid prior to the following September 1, the charge for the work will be made a special assessment against the property. When no owner or agent of the owner can be found, notice shall be sent by certified mail to the person who is listed on the records of the county auditor or county treasurer as the owner. Service will be complete upon mailing. (b) Sidewalk repair. When an owner or occupant permits a nuisance to exist in violation of section 24-343, the city shall serve a notice on the owner of the property ordering removal, elimination or repair of the nuisance within two days after the service of the notice. The notice shall state that in the event of noncompliance, removal or elimination will be done by the city at the owner's expense, and, that if the expenses are not paid prior to the following September 1, the charge for the work will be made a special assessment against the property. When no owner or agent of the owner can be found, notice shall be sent by certified mail to the person who is listed on the records of the county auditor or county treasurer as the owner. Service will be completed upon mailing. Sec. 24-345. Abatement by city. If the owner or occupant fails to comply with the notice within the period allowed for compliance after service, or if no owner, occupant or agent can be found, the director of public works may:

(1) Cause the snow or ice or rubbish constituting the nuisance to be removed; or (2) In the case of a public sidewalk which is unsafe and in need of repairs, report the facts to the city manager who in turn shall report them to the city council. The council thereupon, by resolution, may order the city manager to cause the sidewalk to be repaired and made safe for pedestrians by city crews or by contract let in accordance with law. Abatement by the city after failure of the owner or occupant to do so shall not relieve such owner or occupant of a violation of this Code. Sec. 24-346. Personal liability. The owner of property for which service under section 24-345 has been provided by the city shall be personally liable for the cost of such service. As soon as the current service has been completed and its cost determined, the city manager shall prepare a bill stating the amount due for such service, and stating that if the bill is not paid prior to September 1, the same will be made a special assessment against the property concerned, and shall mail the bill and notice to the owner, and thereupon the amount shall be immediately due and payable to the city. Sec. 24-347. Assessment. After September 1 of each year, the clerk shall list the total unpaid charges for each type of service provided under section 24-345 against each separate lot or tract of land to which they are attributable under this article. The council may then spread the charges against property benefited as a special assessment under M.S.A. § 429.101 and other pertinent statutes, for certification to the county auditor and collection for the following year along with current taxes.

Sec. 30-153. General parking restrictions. No person shall stop, park or leave standing any vehicle, whether attended or unattended, upon the paved or improved or main traveled part of any street or highway in this city when it is practical to stop, park or so leave such vehicle off such part of the street or highway, but in every event a clear and unobstructed width of at least 20 feet of such part of the street or highway shall be left for the free passage of other vehicles, and a clear view of such stopped vehicle shall be available for a distance of 200 feet in each direction upon such street or highway. No vehicle shall be parked continuously at any place in any public street for a period of more than 48 hours.

(1) Definition of Street: Street as used in this section shall mean the entire right-of-
way, including sidewalks, boulevards, curb and gutter as well as the traveled portion of
any City street, alley, highway, thoroughfare, county road, or state highway within the
City of St. Louis Park.
(2) Snow Fall Parking Restrictions:
(a) Except as provided in Subparagraph (b) and (c) herein, no person shall park
a vehicle on any public street anytime after a snowfall of three (3) inches or
more has accumulated, until the street has been plowed curb to curb.
(b) The City Council will establish by resolution the public streets which are not
subject to the snowfall parking ban. The exempted streets will generally be
non-residential streets and residential streets without off-street parking.
(c) The City Manager or designee is authorized to issue parking permits
allowing on-street parking adjacent to the permittee’s residence when the
snow fall parking ban is in effect. The permits may only be issued to City
residents who do not have off-street parking available to them. Each permit
will be issued for an identified vehicle and must be displayed in the vehicle.
No more than two vehicle permits will be issued for each residential
dwelling unit, except as provided in subparagraph (d) herein.
(d) In addition to permits authorized in subparagraph (c) herein, the City
Council may by resolution authorize the issuance of parking permits
allowing on-street parking adjacent to the permittee’s residence when the
snowfall parking ban is in effect. The additional permits may be allowed by
resolution when either the residential dwelling does not have adequate off-
street parking or does not have any off-street parking and permits for more
than two vehicles is determined to be appropriate. The council shall
establish the appropriate fee for these permits by resolution.
(3) Obstruction of Street by Private Snow Plowing Removal Prohibited. No person
shall deposit any snow or ice, plowed or removed from private property, onto a public
street.

(4) Parking Interference with Clean-Up Snowplowing. No person shall park any
vehicle on a public street within 50 feet of any area of a public street which is unplowed
after City equipment has previously plowed snow and ice from other portions of said
street, nor otherwise park in such a manner as to interfere with City clean-up
snowplowing operations.
(5) Off-Street Parking Areas and Private Streets. No person who is an owner or
manager of the premises shall allow or permit snow and ice accumulation in an area of
required off-street parking under the provisions of the Zoning Ordinance or a special
permit issued thereunder or private streets established under a special permit in such a
manner as to reduce such private street area or the number of parking stalls available for
such use, commencing 24 hours after the cessation of snowfall.
(6) Special Posted Now Removal Parking Restrictions. In addition to the parking ban
set forth in Subsection (2) herein, the City Manager or designee is authorized to post no
parking signs for snow removal along public streets of the City where snow removal
operations will require the use of the entire width of the street by snow plowing and
removing the equipment. Such signs shall be posted at frequent intervals at least four (4)
hours prior to the time when snow removal commences on the street so posted, and such
signs shall be removed promptly after completion of the snow removal operation. Snow
removal shall be done on any street so posted as soon as possible following a lapse of
four (4) hours after posting the signs. No person shall park any vehicle, nor leave any
vehicle which was parked at the time of posting for a period of more than two (2) hours
thereafter, of any block on any street so posted during the time the said signs are posted
thereon, and it shall be unlawful for any person other than an authorized representative of
the City or Police Department of the City to remove said signs.
(7) Snow Emergency. The City Manager or designee is authorized to declare a snow
emergency and to impose parking restrictions on City streets as necessary in the event
curbside snow accumulations cause streets to become impassable to emergency vehicles
or snow removal equipment in conjunction with on-street parking.
(8) Towing of Vehicles. In addition to the penalty provision imposed for a violation
of this section, vehicles parked on a public street in violation of any provision of this
section may be towed and impounded.

RESOLUTION RESCINDING RESOLUTION NO. 03-152 AND
EXEMPTING STREETS FROM THE SNOWFALL PARKING BAN
WHEREAS, the City Council established a list of streets exempt from the snowfall
parking ban; and
WHEREAS, the City Council now deems it necessary to revise the list of exempt streets;
and
WHEREAS, due to these changes in the list of exempt streets, Resolution 03-152 is no
longer current or valid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis
Park, that the City hereby:
1. Rescinds Resolution 03-152, Resolution Exempting Streets from the
Snowfall Parking Ban.
2. Exempts the streets set forth on Exhibit “L” hereto and incorporated herein by
reference, from the three inch (3”) snowfall parking ban pursuant to Section 30-
158 of the City Code.

4c. Motion to approve resolution authorizing renewal of premises permit for
Community Charities of Minnesota, operating at Park Tavern Lounge and Lanes,
3401 Louisiana Ave S.
Background:
Communty Charities of Minnesota has submitted an application for renewal of a Gambling
Premises Permit at Park Tavern Lounge and Lanes, 3401 Louisiana Ave S in St. Louis Park.
This organization has operated in the City only since September of 2003. Normally, a premises
permit is approved by the city and issued by the State Gambling Board for a two-year period. In
this case, however, the approval given in September of 2003 was for the addition of a new
location to their already existing permit. That permit is due for renewal in March of this year.
Following this approval, they will be back on the regular two-year cycle.
All requirements for issuance of the license have been met. An additional investigation was not
warranted as officers and employees of the organization were thoroughly investigated for their
September 2003 approval and no changes have been made in personnel since that time.
The City Council must act to approve or deny the renewal before it is submitted to the State
Gambling Control Board. If approved, a copy of the resolution passed by the Council will be
submitted to the State.

FOR LAWFUL GAMBLING
Community Charities of Minnesota
At Park Tavern Lounge and lanes, 3401 Louisiana Ave S
WHEREAS, Minnesota Statutes Chapter 349 and St. Louis Park Ordinance Code
Chapter 15 , provide for lawful gambling licensing by the State Gambling Control Board; and
WHEREAS, a licensed organization may not conduct lawful gambling at any site unless
it has first obtained from the Board a premise permit for the site; and
WHEREAS, the Board may not issue or renew a premises permit unless the organization
submits a resolution from the City Council approving the premises permit; therefore,
BE IT RESOLVED by the City of St. Louis Park City Council that the applicant listed
above meets the criteria necessary to receive a premises permit, and the application is hereby
approved.

Vice-Chair Bissonnette called the meeting to order at 6:00 p.m.
2. Approval of Minutes of November 19, 2003
Commissioner Gothberg requested that the motion on page 4, paragraph 1 include the
condition he proposed, i.e., developer to maintain good, clear, and well-marked access to
the park, the trail area around the north side and, perhaps, good access for residents in
the existing buildings to the east.
It was moved by Commissioner Gothberg to approve the minutes of November 19, 2003
as amended. The motion passed 6-0.
3. Hearings:
A. Case No. 03-72-CP--Amendment to Comprehensive Plan 2000-2020 to amend the
5-year Capital Improvement Plan (CIP) reflecting years 2004 to 2008
Vice-Chair Bissonnette opened the public hearing.
Planning Coordinator Judie Erickson presented a staff report. Ms. Erickson reported that
the Metropolitan Land Planning Act requires that Metropolitan Communities include in
their comprehensive plans a Capital Improvement Program (CIP) that identifies the
timing and financing of public improvements directed in the Comprehensive Plan. The
CIP addresses such items as transportation, sewers, parks, water supply, and open space
facilities. In her staff report, Ms. Erickson stated that the CIP is considered by the State
of Minnesota and the Metropolitan Council to be a part of the Comprehensive Plan. As
such, it must be reviewed by the Planning Commission and be found consistent with the

goals and policies stated in the Comprehensive Plan. The City Council must then adopt
the CIP by resolution.
Jean McGann, Director of Finance, said in addition to insuring the CIP follows the
Comprehensive Plan, the City uses the CIP as a planning tool. Ms. McGann said the
Comprehensive Plan does not include technology replacement; and she briefly discussed
park improvements.
Vice-Chair Bissonnette closed the public hearing.
Commissioner Gothberg complimented City staff on the quality of the CIP for this year;
it was more complete and detailed.
Commissioner Morris asked if it is typical for the municipal taxing district to extend CIP
projects into the school taxing district in terms of doing capital projects for the school
district, asking if that is a separate financial issue (he referred to the junior high school
field improvements). Ms. Erickson said the Parks and Recreation department and the
school district have had an overlay of responsibilities and duties, and sometimes they
share resources and costs.
Commissioner Morris inquired about project 1198. He asked if the City continues to
carry CIP projects through their four-to-five year extention? Ms. McGann responded
that project 1198 is anticipated to start in 2004, therefore, it is listed in the 2004-2008
CIP.
It was moved by Commissioner Finkelstein to find the CIP consistent with the
Comprehensive Plan 2000-2020 and recommend the City Council adopt a resolution
amending Comprehensive Plan 2000-2020 to incorporate the CIP 2004-2008 subject to
Metropolitan Council approval and subject to amendments to Chapter T,
Communications, to incorporate projects related to radio, cable, and telephone systems
replacements. Direct staff to schedule a public hearing for the additional amendments.
The motion passed 6-0.

Commissioner Morris congratulated Commissioners Finkelstein and Timian on their
election victories. He inquired about the process and timeline for appointing a new
commissioner to replace Commissioner Finkelstein. Ms. Erickson responded that the
City Clerk's office coordinates recruitment and appointments for commissions. Staff will
update the Commission on the schedule at the next Planning Commission meeting.

a. Review of Agency Plan for Fiscal Year Beginning 2004 – Draft
Ms. Schnitker presented the draft of the Agency Plan and explained that in 2004 the
HA is entitled to use the streamlined plan. The HA will still administer the same
programs and provide the same kind of back-up information in the large Agency Plan,
such as a budget, action plan, FSS, etc. The HA is still required to hold a Public
Hearing which will done be at the January 14, 2004 Board meeting.
b. Hamilton House Non-Smoking Petition
Ms. Anderson explained that staff met with the Fire Marshal and Chief Building
Official who provided suggestions that will be untaken in units where tenants are
being impacted by secondhand smoke. Additionally, an air purifier has been ordered.

c. Project for Pride in Living – Update on Louisiana Court
Ms. Schnitker provided an update on the financial status of Louisiana Court. Because
of the great number of vacancies in their development they will not be meeting some
of their financial obligations this year; however, they are still making all their loan
payments. Staff will report back quarterly on their situation.
7. Communications from Executive Director
Ted Bigos has agreed to sign a short term extension (120 days) for the project-based,
Section 8 rental assistance units at Lou Park.

Kirk Hawkinson moved to approve the minutes of the September 17, 2003 meeting, Tom
Worthington seconded. The motion passed 7-0.

A. Raj & Seema Maddali Presentation Regarding Soccer
The Commission and staff members introduced themselves to Mr. and Mrs. Maddali. Seema
and Raj Maddali thanked the Commission and complimented the Parks and Recreation staff
for the great job they do on activities and facilities. The Maddali’s informed the Commission
their presentation is from 10 months of researching issues regarding the Soccer
Association’s in-house soccer expenses. Maddali’s goal is to have affordable soccer offered
in St. Louis Park. The Maddali’s reviewed a slide presentation with Commission members
(attached). They also distributed tax returns from the Soccer Association, the Constitution
and Bylaws of the St. Louis Park Soccer Association, the Subcommittee Review of
Affordable In House Soccer, and their Proposal For Affordable In House Soccer in Saint
Louis Park to the Soccer Association to lower their costs. After reviewing the distributed
documents with the Commissions, the Maddali’s advised the Soccer Association Board
rejected their proposal which is why they are interested in forming a Soccer Club in St.
Louis Park.
Nancy Nelson inquired if the Soccer Club would provide soccer activities grades K-3. The
Maddali’s indicated that if the Parks and Recreation Department would provide an in-house

soccer program for children K - 3, the Soccer Club would not run the program. The Soccer
Club would not compete with what the Parks and Recreation Department runs. Dana Strong
asked how many kids they feel would be in this program and what age group. Mr. Maddali
advised there are 600 kids in the program now which includes U6, U8, U10, U12 or 5 - 12
year olds. The Maddali’s advised that each child plays one game per week along with one
night of practice. Maddali’s recommend a cost of $50 or less each for in-house soccer.
Traveling soccer begins at age 10 which has approximately 150 kids per that age group.
Ms. Nelson suggested the issue isn’t the existing Soccer Association but that the
Commission needs to determine what program should be handled by the Soccer Club or the
Parks and Recreation Department. Mr. Strong inquired if the Parks and Recreation
Department provide the in-house soccer program, would the needs of children be met. Kirk
Hawkinson inquired if this is feasible with the budget cuts. Cindy Walsh advised the
program would need to support itself. Mr. Strong inquired if certification is required of
coaches. Rick Birno informed there is specialized training or orientation for each sport.
Ms. Nelson stopped the presentation and advised the Commission that the discussion would
be to discuss resolutions to keep costs reasonable. She indicated the Commission needs to
discuss the solution. Ms. Walsh asked if there are other things you would like to see in new
programs. Ms. Maddali continued the presentation indicating this is an information session
to the Commission of issues that need to be addressed.
Mr. Strong inquired if Parks and Recreation were to create the program, would it be summer
or fall soccer. Maddali’s indicated both and would like to see Parks and Recreation run the
program. Susan Santa confirmed the two proposals: (1) new Soccer Club has been formed in
St. Louis Park and plan on providing in-house soccer to children in St. Louis Park; (2)
request of the Parks and Recreation Advisory Commission to consider providing in-house
soccer through the Parks and Recreation Department. Ms. Santa stated that at the point the
City may choose to offer the program, the St. Louis Park Soccer Club would be absorbed.
The Maddali’s indicate that is correct. Mr. Hawkinson reviewed that individuals would have
the option of entering the City’s activity or the Soccer Association’s activity. The Maddali’s
indicate that is correct.
Mr. Strong indicated that the Commission cannot modify behavior of the Soccer Association
but the Commission could discuss if the Parks and Recreation Department should offer in-
house soccer. Commission members inquired what the deadline is for summer soccer. Mr.
Maddali indicated he would research and advise the Commission. Ms. Walsh advised the
Maddali’s the Commission meets the third Wednesday of every month. Ms. Maddali advised
she would like to know before the holidays if staff will be offer in-house soccer as the
Soccer Association has already started accepting registration. Ms. Nelson inquired if it is
possible for staff to review and advise the Commission by the end of the year. Mr. Strong
asked the Maddali’s for time until 1/1/04 to make a decision. Mr. & Ms. Maddali indicated
that advertising should begin before the holidays. Mr. Cornwall inquired if the City could
research and advise the Commission if they can offer on December 17, 2003. Ms. Maddali
indicated she is willing to work with the City. Ms. Walsh indicated the Commission meets
on December 17 and will advise the Maddali’s following that meeting in which the
Maddali’s approved. The Maddali’s advised they would follow the process to establish a

Soccer Club as an association in St. Louis Park. Ms. Walsh suggested they not market yet
until finalized.
Mr. Strong thanked the Maddali’s for their effort and attempt to work with the Soccer
Association and indicated positive and constructive decisions need to be reviewed.
Seema and Raj Maddali thanked the Commission and staff.
Mr. Johnson inquired if there are enough soccer fields available and Ms. Walsh advised staff
could make it work. Mr. Worthington feels not all statements about the Soccer Association
were accurate. Mr. Johnson inquired what would people on the Soccer Association’s board
be gaining personally. Mr. Worthington explained some are paid positions but no fee goes to
the board members meaning it’s a non-member/non-profit group. Ms. Nelson indicated she
has heard these issues before but neither the City nor Commission has the authority over
associations. Mr. Birno indicated fields may be an issue and staff needs to treat all
organizations (like AAU and Soccer Club) equally. Mr. Cornwall expressed he is worried
about having another association in the mix and what it does for the community. He
indicated he prefers the City to run the program. Commission members discussed having the
City offer the program and suggested a meeting with the Soccer Association to discuss. Ms.
Walsh inquired if the Commission would like staff to discuss providing an in-house soccer
program. Mr. Worthington feels the Soccer Association should be notified and discussed
with them prior to initiating. Commission members agreed. Commission members discussed
and some feel the City should offer, others feel the Soccer Club may be the best option. Ms.
Nelson advised the Parks and Recreation Advisory Commission is asking City staff to
research offering in-house soccer for ages K – 4th grade in the summer and fall.
The Commission will discuss staff’s recommendations at their December meeting.
B. Wildlife Management Presentation by Jim Vaughan
Jim Vaughan distributed “Deer Density Objectives and Goals” which he reviewed with the
Commission. Mr. Vaughan indicated City Manager, Charlie Meyer, spearheaded the deer
management policy which is used for management but not formally adopted by Council at
this time. Staff is trying to appease different groups while managing wildlife which does not
make everyone happy. Staff is using the policy as a guide for controlling deer. Ms. Walsh
indicated that if staff would go through official Council direction at this time, awareness
would not be increased. Ms. Walsh advised staff still has removal at Westwood Hills Nature
Center but not other places at this time. If complaints, deer counts, etc. increase in the future,
staff will discuss this document again and discuss how to remove the deer. Mr. Vaughan
feels a task force that’s more objective may be beneficial. In the future, past Task Force
members and the Parks and Recreation Advisory Commission will be involved. Mr. Strong
inquired on the objective of the task force. Mr. Vaughan advised the task force would create
a deer-feeding ban, increase awareness, monitor browse damage, and control deer when
needed. Ms. Walsh advised the Task Force did not agree on deer density. Mr. Vaughan
recommended the density would be worked out with residents.
Mr. Vaughan reviewed the Deer Habitat & Density in St. Louis Park – 2003 tables with
Commission members. He advised he would work with Golden Valley and Minneapolis
regarding population, as they do not feel there is a problem. Mr. Vaughan advised staff will
harvest 16 deer from the Westwood Hills Nature Center in December. Mr. Vaughan

indicated in the future, they may bow hunt instead of having a sharp shooter harvest the deer.
Mr. Vaughan advised he would use Environment Management Unit numbers for future deer
research and also buckthorn removal. Mr. Vaughan indicated the task force might reconvene
if other problems in the City occur. Ms. Nelson feels it would be helpful for people to
understand the difference between deer and damage caused by too many deer. The
Commission requested more information and Mr. Vaughan advised he would review the
numbers with the Commission annually.
Mr. Vaughan distributed information regarding The Canada Goose Program and reviewed it
with the Commission. Mr. Vaughan indicated staff would continue their attempt at
controlling Canada Geese. The biggest issue staff is trying to control is migration which
happens late August/September to December.
Mr. Vaughan advised the deer and geese are the biggest population issues. He also indicated
a lot of crows died this year from West Nile disease and the Mosquito Control Agency is
continually working to reduce the number of mosquito’s and track the carriers of the West
Nile disease.
The Commission thanked Jim Vaughan for his presentation.
5. Old Business
A. Code of Conduct Discussion
Mr. Worthington distributed the Elements of Code of Conduct Implementation information
that was compiled after reviewing code of conducts from other cities. Mr. Worthington
reviewed these with the Commission and advised they are suggested implementations. A
draft for the code of conduct for St. Louis Park was distributed and briefly discussed. Mr.
Strong indicated it is a good start and advised he is concerned with funds available for
training. Ms. Walsh indicated staff could incorporate into existing training sessions. Ms.
Lindenberg advised there is the option of training through the High School group. Mr.
Strong suggested all activities require a registration form which includes participants
signature under behavior code. Ms. Nelson advised the associations indicated an interest in a
universal code of conduct at their last annual meeting. Ms. Nelson suggested St. Louis
Park’s code of conduct be ready for the meeting with the associations in January.
Mr. Worthington advised the next step is to discuss the draft. Mr. Strong feels associations
should review code and be required to sign and return to City for enforcement. Mr.
Worthington suggested the Commission discuss other options for the code of conduct at the
December meeting including where to post signs and how to present to the associations. The
Commission discussed sign posting and if a statement should be included on the registration
forms. Ms. Nelson suggested the wording include a statement that parents have a
responsibility to assist others to adhere to code. Mr. Hawkinson indicated the code should be
posted at fields, etc. so if relatives or friends attend, they will also be aware. The
Commission agreed. Ms. Walsh feels the code of conduct should be complete by the
December meeting so it can be finalized prior to the associations meeting in January. Mr.
Worthington will work with members to finalize the draft.
Mr. Worthington indicated the invitations for the January youth association meeting should
be sent in December. The Commission will discuss the invitation draft and association
listing at their December meeting.

Mr. Strong inquired on the field reservation policy for Louisiana Oaks and how they will be
handled. Mr. Birno advised staff will schedule the historical users first then fill in others. Mr.
Birno advised the field usage policy would be adhered to.
Mr. Johnson portrayed some fund raising suggestions to the Commission members which
included a twilight swim at the aquatic park from 7:30 – 10 p.m. Members would sell tickets
at $2 per person or $6 per family. The only expenses would be lifeguards, as the
Commission members would sell tickets and run the concession stand for the scholarship
fund. This event would show the Commission has an interest in fund raising and increase
marketing of the aquatic park. Commission members agreed and volunteered. Mr. Johnson
also suggested events such as a movie at the aquatic park; a 5K run which would be in the
future; and build an event at the Wolfe Park Amphitheater. Mr. Johnson feels it is the
responsibility of the Commission to organize fund raising events, as fee assistance money is
needed. Commission members discussed what is needed for scholarships and also agreed
these events would increase awareness of facilities available for use.
Mr. Strong suggested the Commission and staff get together for a working session prior to
the official meeting in December to streamline decisions that need to be made at that
meeting. Staff and Commission members agree to have an informal meeting on Monday,
December 8 at 6 p.m. in the programmer’s office area.
C. Program Report – Rick Birno
Mr. Birno advised the Commission the Recreation Supervisor position was offered to Jim
Lombardi and staff is waiting to hear if he accepts.
D. Director’s Report
Ms. Walsh advised the Commission will receive an update on the Oak Hill Park project at
the December meeting.

and awards. Commission members discussed the difference in ages 6 and under, grades
1 – 2, and grades 3 – 4. The Commission is in favor of staff offering in-house soccer
and will motion to approve at their regular meeting on December 17, 2003.
B. Code of Conduct Discussion
The Commission discussed the Code and that it would be distributed or posted to
include participants, parents/spectators, and coaches. The Commission is in favor of
establishing a Code of Conduct and will motion to approve it at their regular meeting on
December 17, 2003.

Background:
On December 22, 2003 Council interviewed Tom Harmening as candidate for City Manager.
Following the interview, Council approved the following motion:
It was moved by Councilmember Santa and seconded by Councilmember Velick to appoint Thomas K.
Harmening as City Manager contingent on an approved contract, and further, that Mayor Jacobs,
Councilmember Sanger and Councilmember Brimeyer would enter into contract discussions with Mr.
Harmening. The motion passed 7-0.
Over the past several weeks negotiations have taken place with Mr. Harmening to develop the
employment agreement. After many discussions an employment agreement was finalized for Council
approval. This action before the Council will formally appoint Mr. Harmening to the position of City
Manager and approve the employment agreement. Listed below is a summary of actions authorized by
the resolution:
Appointment to City Manager:
• Full authority as City Manager to act as City Manager of the City of St. Louis Park with powers
granted by State Statute, City Charter, City Ordinance and Council resolution.
• Full authority as City Manager to conduct financial transactions on behalf of the city.
• Appointment of City Manager as Executive Director for Housing Authority and Economic
Development Authority.
Employment Agreement:
• Appointment of Thomas K. Harmening as City Manager.
• Setting the effective date as January 5, 2004.
• Setting pay for City Manager at $114,000.
• Insurance/benefits/holidays/flex leave set in accordance with city policies for other exempt
employees. Professional development consistent with city policies.

WHEREAS, on December 22, 2003, the City Council approved by motion the appointment of

EXHIBIT “A”
EMPLOYMENT AGREEMENT
THIS AGREEMENT is made and entered into this ________ day of _______________,
2004, by and between the CITY OF ST. LOUIS PARK, a political subdivision of the State of
Minnesota (the “City”), and THOMAS K. HARMENING (the “Manager”).
IN CONSIDERATION OF THE TERMS AND CONDITIONS CONTAINED HEREIN,
THE PARTIES AGREE AS FOLLOWS:
1. EMPLOYMENT. During the term of this Agreement, the Manager shall serve as City
Manager of the City, and shall assume and perform, in a conscientious and diligent manner at all times,
all of the duties and responsibilities as are prescribed or permitted by charter, statute or ordinance and
incidental to such position as defined herein and as are assigned to him from time to time by the City
Council. Manager shall use his best efforts in the performance of his duties, and shall spend
substantially his full time in connection therewith.
2. TERM. This Agreement shall be effective as of January 5, 2004, and shall continue
indefinitely unless or until earlier terminated as provided in Section 5 below. Manager shall remain in
the exclusive employment of the City during the term of this Agreement. For the purposes of this
section, “exclusive employment” shall exclude any teaching, writing, consulting, speaking, or military
reserve service undertaken by Manager during his non-work hours, which do not interfere or conflict
with his ability to perform pursuant to this Agreement.
3. COMPENSATION. As base compensation for services rendered, Manager shall
receive $114,000 per year, less applicable taxes, payable in equal installments at the same time as the
City pays its other City employees. After six months, Manager shall be given a performance
evaluation. If the performance evaluation is satisfactory, the City Council will adjust Manager’s salary
to not less than $116,600, but not to exceed $121,600, the projected 2004 midpoint of City Manager
salary range based upon the ICMA Regional Survey, subject to statutory limitations. After completion
of each subsequent year of this Agreement, the City may conduct an annual review of Manager’s
performance. The base salary and/or benefits for calendar year 2005, and thereafter, shall be set when
salaries are established for other non-union employees.
4. BENEFITS. Manager shall receive the following benefits at no cost to him:
a. Flex Leave. Manager shall accrue and use flex leave in accordance with City
policies for other exempt employees.
b. Insurance/Holidays/Benefits Manager shall be provided benefits, insurance and
holidays in accordance with City policies for other exempt employees.
c. Retirement and Deferred Compensation Plan Contributions. Manager is
currently a member of PERA and may chose to continue to participate in that
plan. The amount of the City’s contribution shall be equal to the same
percentage of base salary that the City contributes for all other employees. He
may also opt out of PERA and participate in an approved deferred compensation

plan. The City’s contribution to an approved deferred compensation plan shall
be in the same amount as the PERA contribution.
d. Car Allowance. The City will provide a $600.00 car allowance per month for
use of Manager’s personal car while on City business within the Twin Cities
metro area. In addition, Manager will be reimbursed for use of his personal car
while traveling outside the metro area on City business, per applicable
regulations and City policy. If Manager names the City as an additional insured
on his automobile insurance policy, the City shall reimburse Manager for the
cost of the liability portion of his automobile insurance premium.
e. Professional Development. Dues and fees for the following, provided that such
items are reasonably necessary to the professional development of Manager, and
consistent with City policies:
1) Licenses, journals, publications;
2) Seminars, conferences, and short courses;
3) Membership in professional associations and one other local service
organization.
f. Payment of Expenses. Direct payment or reimbursement for reasonable and
necessary meals, travel, lodging, and entertainment expenses, properly
documented and actually incurred by Manager in connection with the affairs of
the City and the professional development described in paragraph 4e above.
The City agrees to pay directly to the vendor for cell phone, PDA and other
similar expenses of the Manager.
5. TERMINATION OF EMPLOYMENT. Manager is an at-will employee of the City.
As such, he may be terminated by the City Council in its sole discretion at any time, with or without
cause. Upon termination of Manager’s employment, and subject to the termination benefit provisions
of Section 6 below, all rights and obligations under this Agreement shall cease at that time, other than
those which have accrued prior thereto.
6. TERMINATION BENEFITS. In the event that Manager is involuntarily terminated
by the City during such time that Manager is willing and able to perform the duties of Manager, then in
that event, City agrees to pay Manager at the time of receipt of his last pay check a lump sum cash
payment or periodic payments over six months equal to six months aggregate salary, at Manager’s
option, and to continue the City contribution on behalf of Manager to the cafeteria benefit plan at the
same level as other exempt nonunion employees for six months, (collectively “termination benefits”).
However, in the event the Manager is terminated by the City Council for substantiated and proven
malfeasance in office, as defined by Minn. Stat. 466.07, and interpretive case law, or intentional
misconduct, then the City shall have no obligation to pay the sums specified above. Intentional
misconduct is defined as substantiated and proven sexual, racial, or other unlawful harassment,
distribution of pornography, or acts of physical violence in the work place. “Intentional misconduct”
and “malfeasance” do not include poor performance or neglect of duties.
If the City at any time during the employment term reduces the salary or other financial benefits of
Manager in a greater percentage than across-the-board reduction for all non-union employees, or if the

City refuses, following written notice, to comply with any other provisions of this Agreement
benefiting Manager or Manager resigns following a formal suggestion by the City Council that he
resign, then Manager may, at his option, be deemed to be “terminated” on the effective date of
Manager’s resignation and the Manager shall also be entitled to receive the termination benefits set
forth above.
If Manager voluntarily resigns his position with the City, Manager agrees to give the City sixty (60)
days advance notice. If Manager voluntarily resigns his position with the City, there shall be no
termination benefits due to Manager.
7. LEGALITY. The parties covenant and agree that the provisions contained herein are
reasonable and are not known or believed to be in violation of any federal or state law or regulation. In
the event a court of competent jurisdiction finds any provision contained herein to be illegal or
unenforceable, such court may modify such provision to make it valid and enforceable. Such
modification shall not affect the remainder of this Agreement which shall continue at all times to be
valid and enforceable. No payment may be made under this Agreement in excess of the maximum
amount permitted by applicable law.
8. INDEMNIFICATION. City shall defend and indemnify Manager pursuant to Minn.
Stat. 466.07 and 465.76. City shall defend, hold harmless, and indemnify Manager from all torts, civil
damages, penalties, and fines; violation of statutes, laws, rules, and ordinances, provided the Manager
was acting in the performance of the duties of his position.
9. INTERPRETATION. This Agreement constitutes the entire agreement between the
parties and supersedes any prior oral or written agreements between the parties. This Agreement can
only be modified by a writing signed by both parties. This Agreement shall be interpreted in
accordance with the laws of the State of Minnesota. If the parties disagree upon the interpretation of
this Agreement, and cannot resolve their differences in good faith, then both parties may agree to
request mediation from the Minnesota Bureau of Mediation Services. Each party will be responsible
for its own attorneys’ fees, and the parties will split equally any other mediation fees.
IN WITNESS WHEREOF, the parties have caused the execution of this Agreement the day and
year stated above.

A 2-year agreement for Sergeants settling the City and Union for 2004 & 05.

Motion to adopt the attached resolution approving a Labor
Agreement between the City and Law Enforcement Labor
Services (LELS) #218, establishing terms and conditions of
employment for two years: 1/1/04 – 12/31/05.
Background:
The City had one brief negotiation session with the Sergeants. This group came to the table and
proposed the following changes to the contract:
• 2 year agreement
• 2004 wage increase 2% January 1, 1% July 1,
• 2004 increase in employer contribution $45/mo. ($650/mo in 2003, to $695/mo. in 2004).
• 2005 wage increase 3% January 1, 2005
• 2005 increase in employer contribution same as other exempt employees.
The increases recommended for 2004 are same given to non-union employees for wages and
employer contribution. This will be our first 2005 settlement.
The City is very pleased that the Sergeants came to the table with this offer and recommend
approval.
The proposed contract is on file with the City Clerk. More detail is available upon request.
Recommendation: It is recommended that the City Council adopt the attached resolution
approving a Labor Agreement between the City and Law Enforcement Labor Services #218,
Police Sergeants, establishing terms and conditions of employment for the duration of 1/1/04 –
12/31/05.

JANUARY 1, 2004–DECEMBER 31, 2005
WHEREAS, the City and the Union have reached a negotiated settlement covering the
terms and conditions of a Labor Agreement as permitted by the State of Minnesota Public
Employees Labor Relations Act, and
WHEREAS, the City Council may enter into such agreements as authorized by its
Charter; now therefore,
BE IT RESOLVED by the City Council of the City of St. Louis Park that the Mayor and
