Vice Chair Robertson called the meeting to order.

Commissioner Person made a motion to approve the minutes of January 18, 2017.
Commissioner Carper seconded the motion, and the motion passed on a vote of 5-

The Elmwood Redevelopment
Location: 5605 36th Street W.
Applicant: 36th Street LLC

Jennifer Monson, Planner, presented the staff report. The applicant proposes to
demolish the existing building and construct a 6-story, mixed-use building with
85 residential units, 20 of which will be affordable at 60% area median income,
4,400 square feet of commercial space, and 196 parking stalls.
Ms. Monson discussed the preliminary and final plat. She noted that the applicant
has requested to vacate the alley that lies between the south property line and the
Burlington Coat Factory parcel. Staff supports vacating the northern eight feet of
the alley.
Ms. Monson presented the zoning analysis for the PUD request.

Ms. Monson spoke about the traffic study. She said normally a study is not done
for a project of this size but due to the increase in density they wanted to see how
a development for 55 + compares to a market rate development. She said the
study found that in the afternoon peak, a 70-unit senior housing development
generates the same amount of traffic as a 50-unit market rate housing
development. Furthermore, the peak hour traffic generation is about the same as
the existing American Legion and commercial office space.
Ms. Monson discussed landscaping. She explained that the project does not meet
the number of tree and shrub planting required by the city, so the plan provides
alternative landscaping measures in order to meet the landscaping ordinance.
These measures include outdoor fireplaces, pergola structures, outdoor space on
the roof and public art.
Ms. Monson discussed the Designed Outdoor Recreation Area (DORA). The
plan exceeds the City’s minimum 12% DORA requirements and provides
approximately 21.6% of the project.
Ms. Monson stated that a neighborhood meeting was held on November 29, 2016.
Concerns included parking and compliance with zoning code regarding building
façade. Comments were also expressed about height. Concerns were lessened
when it was determined that the proposed building was only 10 feet higher than
Hoigaard Village across the street.
Commissioner Carper asked if there would be a rain garden or underground
storage.
Ms. Monson said the site is under one acre so they are not required to do any on-
site stormwater retention. They are reducing the amount of impervious surface to
about 72%. She added that the applicant will be paying for a portion of the
Hoigaard Village pond which the city constructed.
Commissioner Carper commented on the shadow study. Ms. Monson explained
that the ordinance allows up to 50% of the building wall to be covered for up to
two hours a day between the hours of 9 a.m. and 3 p.m. for up to 60 days. The
applicant supplemented their original shadow study to show that it meets that
requirement. The Hoigaard Village Harmony Vista south building wall will never
be shadowed more than 50% during the hours of 9 a.m. and 3 p.m. by The
Elmwood building.
Commissioner Carper asked about pets, community garden, electric charging
stations and recycling of demolition materials.

Commissioner Kanne spoke about alternative landscaping measures being used to
help meet the intent of the landscaping ordinance. She spoke about outdoor
structures aging, and being less desirable than trees.
Ms. Monson said the zoning ordinance requires one tree per unit which would be
85 trees for this site. She said there isn’t enough room for 85 trees with this
development. Staff looks at the cost of all components of DORA and amenities
to see if that is approximately the same as what they would be required to pay for
trees and planting. They found that it is pretty similar. She said as regards aging
of pergolas, outdoor fireplaces, etc., they will have to keep up with the property
maintenance so it looks and remains functional for the life of the building.
Commissioner Tatalovich asked for more information about the alley.
Ms. Monson said there is currently an unused alley between the Burlington site
and the Elmwood site. The southern 8 feet of the alley is planted with trees. The
city supports vacating the northern half of the alley.
Don Kasbohm, 36th Street LLC, said the building will be marketed as a 55+
building. He noted that one person signing a lease for a unit must be 55+.
Dean Dovolis, DJR Architecture, spoke about the design and landscaping. He
said the building has the capacity for expansion of retail on street level.
Scott England, DJR Architecture, said the DORA is extensive. He said there is
some potential on the north side to do a small, narrow rain garden. He spoke
about south side DORA which could be available for residents to garden. He
spoke about recycling measures within the building. Mr. England said the
materials used for outdoor hardscape amenities will be very durable, long lasting
pre-conditioned aluminum. He said they will be recycling existing materials and
construction debris.
Commissioner Kanne said she thought some landscaping could be shorter,
flowering trees with width to try to get the tree number back up. Maybe there
could be less shrubs and more flowering trees.
Commissioner Kanne commented that many 55+ people are working and that
should be considered in the traffic study. She said many 55+ tenants may be
moving back to St. Louis Park to be closer to their children and grandchildren.
She asked if there were open places for grandparents to watch children during the
day. She said such open areas would be a selling point.
Mr. England replied that there are parks in the neighborhood. He spoke about the
hardscape areas of the DORA which includes grass, raised planters and some
trees.

Mr. Dovolis spoke about the availability of SWLRT transit close by for the
development residents.
Commissioner Person and Mr. Kasbohm discussed the 60% area median income
and how it relates to the 55 + population.
Mr. England stated that electric stations for cars will be available.
Commissioner Robertson asked about flexibility to convert units to
condominiums.
Mr. England said the physical structure is set up in such a way that units could be
converted.
Mr. Kasbohm added that his intent is not to convert to condominiums. He said
he is a long-term holder of apartment buildings in good locations.
Commissioner Rickert and Mr. England spoke about the haul route for
construction materials.
Vice Chair Robertson opened the public hearing. He closed the public hearing as
no one was present wishing to speak.
Commissioner Carper stated he liked the project design. He commented on the
variety of landscaping, adding that more trees could be added as recommended.
He said he was very much in favor of the project.
Commissioner Kanne spoke about the emphasis on children and the elderly in the
city and she really likes that part of the proposal. She commented on the street
needing a facelift and she likes having new life and landscaping added to that
area. She said overall she finds that it is a really good project.
Vice Chair Robertson said the design and amenities are top notch. He said he
does have an issue with the project as the area is guided as Mixed Use in the
Comprehensive Plan. He said it isn’t really a mixed-use project. He said he
brought this up at the Commission study session. He said when he looks at the
designation of mixed-use this project is too short on commercial on the lower
level. He said it is a strong street and he’d like to keep the commercial strength of
it at the street level. He said he can’t get over that hurdle.
Mr. Dovolis said they designed the first floor to be flexible so that as the street
evolves more commercial intensive the building could adapt with it. It is sized for
the present situation. But over time the commercial mixed-use could be
strengthened.

Vice Chair Robertson said that is a step in the right direction but he’d prefer to see
the commercial aspect emphasized at this stage rather than later.
Mr. Kasbohm spoke about the difficulty of the commercial market, including
commercial at Hoigaard Village and Excelsior & Grand. He said he believes in
the location and creating a destination.
Commissioner Carper made a motion to recommend approval of the preliminary
and final plat. Commissioner Kanne seconded the motion, and the motion passed
on a vote of 5-0.
Commissioner Carper made a motion to recommend approval of the preliminary
and final planned unit development. Commissioner Person seconded the motion,
and the motion passed on a vote of 4-1 (Robertson opposed).
B. Zoning Text Amendment
Dwelling Units as Accessory Use to Religious Institutions
Applicant: Tracy Schultz, Thai Buddhist Center of Minnesota
Case No.: 17-01-ZA
Gary Morrison, Assistant Zoning Administrator, presented the staff report. He
explained that the applicant purchased the former church property at 2544 State
Highway 100. The applicant is requesting an amendment to the Zoning
Ordinance to allow up to 15 people to live at a religious institution in the R-1
Single-Family Residence Zoning District. Mr. Morrison noted that if the zoning
code is amended, staff has recommended the regulations apply to all residential
zoning districts.
Mr. Morrison reviewed the applicant’s intent to renovate the building into a Thai
Buddhist Temple that will serve as a place of worship and meditation. He
explained the tradition to have monks living at the temple for varying lengths of
time. He reviewed zoning regulations for R-1 Single Family Residential District.
He reviewed current conditions for religious institutions in Residence Districts by
Conditional Use Permit. He reviewed proposed provisions for accessory dwelling
units or living quarters affiliated with a Religious Institution.
Commissioner Robertson asked how the 15 person cap was determined,
commenting that certain properties were large enough to accommodate more than
15.
Mr. Morrison responded there is a little bit of flexibility in that number. The
applicant is requesting up to 15. When staff calculates the density for this

property it is just over 15 dwelling units. Looking at potential uses in the future
staff is comfortable with this number.
Sean Walther, Planning and Zoning Administrator, added that this is relatively
new for the city. He said the cap of 15 people seems appropriate. The principal
use of the property should remain the religious institution, and the dwelling units
remain an accessory use. Allowing too many people could change that balance.
Commissioner Carper asked about other religious institutions in St. Louis Park
that have clergy living on site.
Mr. Morrison spoke about two parishes with clergy living on site. He also
mentioned the Yeshiva of Mpls. boy’s high school and dormitory.
Tracy Schultz, applicant, and Yin Srichoochat board director Wat Thai of
Minnesota, introduced themselves.
Commissioner Person asked if the average occupancy would be less than 15.
Ms. Srichoochat said normally there are about five monks living on site.
Vice Chair Robertson opened the public hearing.
Sharon Lehrman, 2610 Vernon Ave. S., said she is thrilled to welcome their new
neighbors. She asked about any new structures on the site to house monks.
Mr. Morrison said if the zoning text amendment is adopted the applicant will be
submitting a conditional use permit. Detailed drawings would be available at that
time. He said he understood plans were currently being drawn up and would be
presented at a neighborhood meeting.
Ms. Schultz said currently there are no plans to build an accessory structure. She
discussed the community garden and said it is their intention to work with the
neighborhood to retain some of that.
Amy McTavish, 2624 Yosemite Ave. S., said the garden plots were plowed away
last year.
Mr. Walther stated that the city’s Natural Resources Coordinator, Jim Vaughan,
will coordinate with the new owners on replacing the garden plots.
Vice Chair Robertson closed the public hearing. He said the proposal works very
well and strengthens the neighborhood.

Commissioner Person spoke about the interior of the building. He said he is very
much in favor of the proposal.
Commissioner Kanne said that she is very pleased with the proposal.
Commissioner Person made a motion to recommend approval of the zoning
ordinance amendment pertaining to Religious Institutions. Commissioner Kanne
seconded the motion, and the motion passed on a vote of 5-0.

Mr. Walther reminded commissioners about the February 27 Boards and
Commissions annual meeting.
Mr. Walther spoke about the Vision 3.0 process. He provided information about
the upcoming Facilitator Training and the first Town Hall meeting.

Traffic Study Review (Jack Sullivan)
Traffic Study
Jack Sullivan reviewed the traffic studies that have been completed for W 36th Street and
Wooddale Avenue. Mr. Sullivan presented four options that were identified to remedy
any traffic concerns in the area. The best option to fix traffic issues in the area is to widen
the Wooddale Ave bridge over Hwy 7 to better accommodate pedestrians and bicycles.
The bridge widening project will be completed as part of the SWLRT project, and
signalized intersections at the on and off ramps will be installed.

A discussion of Level of Service (LOS) occurred. The city’s policy is to maintain an
overall LOS Level D. The PLACE development provides LOS D on opening day 2020,
and continues to operate at LOS D in 2030 and 2040.
A summary of the evolution of PLACE’s site plan was presented. The original project
was all located on the north side of the SWLRT line and the traffic numbers did not work.
The current proposal splits the site north and south of the SWLRT line, and the project
maintains an acceptable LOS.
Mobility Plan Review
Chris Velasco representing PLACE presented the non-profit’s mission of creating great
places and transforming communities, and how they plan to accomplish that mission in
St. Louis Park by providing a transit oriented development. The goal is to have people
live and work on site so they do not have to rely on vehicle, but can use alternate
transportation. The mobility plan includes car free living, on site job opportunities, car
shares, bike shares, a stipend for car free living, and a local shuttle service until LRT
opens.
A discussion occurred on the normal factors a traffic study takes into consideration.
Heather mentioned the traffic study did account for proximity to transit and shared uses,
but did not include discounts for the additional mobility plan elements. These mobility
plan elements reduce the traffic impact PLACE has on area traffic.
Parking Study
PLACE is providing significantly less parking than is normally required for development
in St. Louis Park. Discussions included a summary of parking analysis done by city staff
and an independent parking analysis completed by Walker Parking Consultants. St. Louis
Park’s standard parking requirements do not allow for discounts for proximity to a highly
reliable transit system like LRT. The city staff and consulting firm analysis show that
adequate parking is being provided by PLACE. However, since this is a large change in
what is normally required in the city, a proof of parking plan will be required.
The city will need to manage/regulate parking around LRT stations regardless of PLACE.

3A. Knollwood Mall Preliminary and Final PUD

Recommended Motion: Motion to recommend approval of the Preliminary and Final
Shops at Knollwood Planned Unit Development subject to the conditions
recommended by Staff, and rezoning the Knollwood PUD properties to the Shops at
Knollwood PUD.
REQUEST: Chick-fil-A (CFA) submitted an application for a Preliminary and Final Planned
Unit Development (PUD) for the Shops at Knollwood site. The purpose of the PUD is two-fold:
1. Convert the existing Knollwood Mall PUD to the current PUD format which requires
creation of a new PUD zoning district that is specific to the Shops at Knollwood
development. Converting the old PUD to the new PUD will require a rezoning of the
property from C-2 General Commercial to the new PUD zoning district. If approved, the
new PUD district will be called “PUD 10” on the zoning map, and known as “Shops at
Knollwood”.
2. Redevelop the existing TCF bank building with in-vehicle service (drive-thru) into a
proposed CFA restaurant with a drive-thru.

Comprehensive Plan: The Comprehensive Plan designates the site for commercial use. The
proposed PUD would create a new zoning district and zoning regulations for uses and
dimensional standards that are unique to this site and the proposed site and building plans.
Staff finds that this site is suitable for the existing and proposed uses and meets many of the
objectives of the Comprehensive Plan. The site provides a mixture of commercial uses and
opportunities for the neighborhood and for the region.

Subject: Shops at Knollwood Planned Unit Development
BACKGROUND: The current Knollwood PUD was approved on February 7, 2000 as an
overlay to the C-2 General Commercial district. Prior to that, Knollwood Mall approval was
granted under a special permit. The last amendment to the PUD was in 2013 when the PUD was
amended to:
1. Replace the mall with 25,000 sf of “junior box” retail spaces.
2. Construct an 11,500 sf building at the Highway 7/Aquila Ave intersection.
3. Renovate the parking lot.
4. Bring the property into compliance with stormwater regulations.
The new retail building, mall renovation and parking lot renovation are complete. The
stormwater improvements will be constructed during the summer of 2017.
The TCF Bank building was vacated in 2014 when the new TCF building was constructed north
of Super Target at the corner of 36th Street and Boone Avenue.
PUD ANALYSIS: The applicant requests approval of a preliminary and final PUD. A PUD is a
rezoning and zoning text amendment that establishes the regulations for a specific property.
The PUD is separated into three main components. The following is a description of the existing
PUD and the proposed changes.
West of Aquila Ave. This section of the PUD consists of a fast food restaurant and a bank.
Both uses include a drive-thru. These two buildings have existed since the early 1980s for
the most part unchanged.
Shops at Knollwood. This shopping center has changed in many ways since it was first
constructed in 1955. The shopping center consists of large to small retailers including
Kohl’s, Cub Foods and others. The shopping center also consists of a small three tenant
building at the corner of Highway 7 and Aquila Avenue that was constructed in 2014.
TCF site. The TCF site is located at the corner of Highway 7 and Texas Ave. It consists
of a single free-standing building with a drive-thru. The building was constructed in 1973.
The building has been vacant since the TCF Bank relocated to its new building in 2014.
There are no changes proposed for the area west of Aquila Ave. The Shops at Knollwood
shopping center will remain unchanged with the exception of some alterations of the parking lot
between the TCF site and the shopping center. The intent of these changes are to accommodate
the new CFA, and to improve vehicular and pedestrian movement from Texas Ave to the
shopping center.
Therefore, staff is proposing that all the exhibits approved under the 2013 PUD be carried
forward and approved with this PUD request with the conditions and modifications detailed
within this report.

Subject: Shops at Knollwood Planned Unit Development
Proposed Chick-fil-A (CFA). The proposed CFA will be constructed where the existing TCF
Bank building is currently located. The two-story TCF building is approximately 12,000 square
feet in area, and will be replaced with a one-story fast food restaurant that is approximately 5,000
square feet in area.
Drive-Thru. Both the TCF and CFA have a drive-thru facility. The CFA drive-thru will wrap
around the east and north side of the building in the same manner as the TCF drive-thru currently
does. The most notable difference between the two is that the entrance to the CFA drive-thru
will be located approximately 200 feet from Texas Ave. This is an improvement over the current
TCF design where the entrance to the drive-thru is located 40 feet from Texas Ave. CFA made
this change at the request of the City Engineering Department with the intent of improving safety
and traffic flow at the right-in only shopping center entrance located at Texas Ave.
Traffic. The City Engineering Department reviewed the proposed CFA development and had the
following comments regarding traffic counts and traffic flow.
The traffic for the existing and the proposed development was estimated using the
Institute of Transportation Engineers Trip Generation ITE traffic manual. As shown
below, the proposed development reduces the estimated daily trips generated by this site
by 477, and reduces the trips in the PM peak hour by 411. The road system surrounding
the site has adequate capacity for the trips from this development.
Traffic generation for the 11,971 gross square foot (GSF) TCF bank (Drive-in Bank)
2,957 trips daily. (247 per 1,000 GSF)
646 trips during the PM peak. (54 per 1,000 GSF)
Traffic generation for the proposed development, a 5,000 GSF drive-thru restaurant:
2,480 trips daily. (496 per 1,000 GSF)
235 trips during PM peak. (47 per 1,000 GSF)
In addition to the estimated reduction in traffic resulting from the CFA restaurant, improvements
were made to the site plan with the intent of improving vehicular and pedestrian movements.
1. The entrance to the CFA drive-thru is proposed to be 200 feet away from the Texas Ave
shopping center entrance. The existing entrance to the TCF drive-thru is located 40 feet
from Texas Ave.
2. A sidewalk will be installed from Texas Ave along the south side of the CFA site. The
sidewalk will complete a pedestrian connection from Texas Ave to the shopping center.
This connection, along with the pedestrian improvements made in 2014, makes it
possible for pedestrians to walk across the PUD from Texas Ave to Aquila Ave entirely
on ADA compliant sidewalks.

Parking: The parking calculations below were calculated for the entire PUD. The shopping
center category includes all buildings within the PUD located east of Aquila. By code, the only
exception calculated separately from shopping center is restaurants with full wait staff.
Applebee’s is the only restaurant in the PUD that is required to be calculated separately. Burger
King and Midwest Bank are calculated separately because they are located on separate parcels
that are not adjacent to the shopping center parcel.
The table below shows the minimum number of spaces required per use, and the total proposed
for the entire PUD after the CFA is constructed. As shown, the site will have 528 spaces more
than required by code.
There is sufficient parking for the PUD as proposed.

CFA proposes to install eight bicycle parking spaces on-site, which is the minimum required by
code.
Stormwater: The PUD was required to come into compliance with current stormwater
requirements when the PUD was amended in 2013. Construction of the required stormwater
improvements are required to be completed by October 1, 2017. The stormwater improvements
consist of lift stations and an infiltration pond located at the northwest corner of the site (Aquila
Ave and 36th Street). The proposed plans include the TCF site, so there are no additional
stormwater requirements resulting from the proposed CFA.
Permits for the improvements are currently being reviewed, and some modifications may be
required for the pond to comply with design standards. Specifically, city staff is concerned about
the proximity of the infiltration pond to the public sidewalks and the slope of the pond. Staff
will be asking that the edge of the pond be at least 10 feet from the sidewalk, that a slope of the
pond be reviewed, and include a flat area at the high-water level as a condition of permit
approvals. Staff is discussing the changes with the property owner, and revised plans will be
incorporated into the exhibits of the proposed PUD.
Landscaping: The PUD received substantial landscaping improvements as a result of the 2013
PUD amendment. The PUD, however, did not address the TCF site as it was anticipated to be
redeveloped soon. The CFA landscaping plan will be added to the shopping center landscaping
plan and incorporated into the new PUD.

CFA is proposing to remove 15 mature trees. Seven of the trees are located within the
construction limits of the proposed CFA. These trees are required to be removed to facilitate the
new building, drive-thru and parking lot. They will be replaced as required by city code.
The remaining eight trees are located elsewhere in the southeast corner of the PUD. Four of
them are located in the MNDOT right-of-way, three in the landscaped islands between the CFA
and Highway 7, and one located northeast of the CFA at the corner of Texas Ave and the
shopping center entrance.
Staff met on-site with representatives from CFA, Shops at Knollwood and MNDOT to discuss
the proposed tree removal. CFA representatives expressed their desire to remove the trees to
improve visibility to the CFA restaurant. Staff agreed that four of the trees could be removed.
Staff, however, stated that the remaining four trees requested for removal must be preserved for
the following reasons:
1. Mature trees should be preserved whenever possible. They provide the full aesthetic and
environmental benefits desired by the city when requiring landscaping.

2. The mature trees provide visual barriers and shade to the large paved area found at the
Shops at Knollwood.
3. The trees are healthy.
4. Improving visibility to the proposed CFA fast food restaurant does not justify the
removal of eight mature trees.
Three of the trees in question are located in the MNDOT right-of-way. Removal of the trees is
acceptable to MNDOT, however, MNDOT will defer to the city. As noted, staff recommends
the trees be preserved. The city may allow the trees to be trimmed to improve visibility.
CFA is willing to trim several trees, however, they are still proposing to remove the trees despite
staff’s recommendation to preserve them.
Additionally, a tree replacement calculation has not been provided. So while CFA is proposing
to plant some trees around the new building and in the parking lot, staff has not determined that
the proposed landscaping meets the required replacement.
Therefore, staff is recommending the following:
1. The four trees highlighted in green in the exhibit above be preserved.
2. All mature trees may be trimmed under staff supervision
3. A tree replacement calculation shall be submitted and the landscaping plan shall be
revised to incorporate additional trees as may be required by the calculations.
Lighting: City code requires the average lighting levels in parking lots to fall between 0.4 and
1.0 foot candles. The average lighting for the CFA as proposed is 2.7. The lighting plan needs
to be revised to reduce the lighting to a level that meets code.
Signage: The Shops at Knollwood currently meets the maximum amount of signage allowed for
a shopping center of this size. Therefore, CFA can have wall signage as allowed for shopping
centers, which includes separate buildings on the same parcel, but there is not enough available
signage for another freestanding sign within the PUD.
Staff believes that given the large size of the Shops at Knollwood PUD, a second multi-tenant
sign is reasonable. The PUD has only one sign, which is located at the Highway 7 and Aquila
intersection. Staff is recommending that a second multi-tenant sign be allowed at the Highway 7
and Texas Ave intersection. The second sign should be similar in size and design as the existing
sign. The proposed PUD includes a provision allowing for the second sign.
Public Input: A neighborhood meeting was conducted on February 22, 2017. Over 20 people
attended the meeting. While support was expressed for the CFA some concerns were expressed
focusing on the following:
1. Traffic on Texas Ave. Residents were concerned that the CFA would result in excessive
traffic levels on Texas Ave.
2. Lighting. Residents expressed concerns that lighting levels would be a nuisance to the
residents east of Texas.

3. Concerns were also expressed about CFA as a company, siting comments made by the
CEO regarding LGBT values.
STAFF RECOMMENDATIONS: Staff recommends approval of the Shops at Knollwood
Preliminary and Final PUD subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with the conditions of
this ordinance, approved Official Exhibits, and City Code.
2. The on-site storm water management system shall incorporate the revisions required by
the Minnehaha Creek Watershed District and the city through the permitting process.
3. All utility service structures shall be buried. If any utility service structure cannot be
buried (i.e. electric transformer), it shall be integrated into the building design and 100%
screened from off-site with materials consistent with the primary façade materials.
4. Prior to starting any land disturbing activities, the following conditions shall be met:
a. Assent Form and Official Exhibits must be signed by the applicant and property
owner.
b. A preconstruction meeting shall be held with the appropriate development,
construction, private utility, and City representatives.
c. All necessary permits shall be obtained.
d. A performance guarantee in the form of cash escrow or irrevocable letter of credit
shall be provided to the City of St. Louis Park for all public improvements (street,
sidewalks, boulevards, utility, street lights, landscaping, etc.) and the private site
stormwater management system and landscaping.
5. Prior to issuance of building permits, the following conditions shall be met:
a. The developer shall sign the City's Assent Form and the Official Exhibits.
b. A Planning Development Contract shall be executed between the property owner
and City that addresses, at a minimum:
i. The conditions of PUD approval as applicable or appropriate.
ii. The installation of all public improvements including, but not limited to:
sidewalks and boulevard improvements and the execution of any
necessary agreements related to the maintenance of such improvements.
iii. Easements related to electronic communication and fiber infrastructure.
iv. A performance guarantee in the form of cash escrow or irrevocable letter
of credit shall be provided to the City of St. Louis Park in the amount of
1.25 times of the costs of all public improvements (sidewalks and
boulevards), and the private site stormwater management system and
landscaping.
v. The developer shall reimburse City attorney’s fees in drafting/reviewing
such documents as required in the final PUD approval.
vi. The Mayor and City Manager are authorized to execute said Planning
Development Contract.

c. Final construction plans for all public improvements and private stormwater
system shall be signed by a registered engineer and submitted to the City
Engineer for review and approval.
6. The developer shall comply with the following conditions during construction:
d. All City noise ordinances shall be complied with, including that there be no
construction activity between the hours of 10 p.m. and 7 a.m. Monday through
Friday, and between 10 p.m. and 9 a.m. on weekends and holidays.
e. The site shall be kept free of dust and debris that could blow onto neighboring
properties.
f. Public streets shall be maintained free of dirt and shall be cleaned as necessary.
g. The City shall be contacted a minimum of 72 hours prior to any work in a public
street.
h. Work in a public street shall take place only upon the determination by the City
Engineer (or designee) that appropriate safety measures have been taken to ensure
motorist and pedestrian safety.
7. The lighting plan shall be adjusted to show an average foot candle (fc) measurement of
0.4 and 1 foot candle.
8. The landscaping plan shall be revised to:
i. Preserve all trees in the MNDOT right-of-way with the exception of one tree
identified by staff to be removed.
j. Preserve the overstory tree in the landscaped island between the MNDOT right-
of-way and the proposed CFA.
k. Complete a tree replacement calculation.
l. Incorporate all trees on-site as required by the replacement calculation.

Findings
Sec. 1. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 17-08-PUD) for amending the Zoning Ordinance to create a new Planned
Unit Development (PUD) Zoning District.
Sec. 2. The Comprehensive Plan designates this property as C-2 General Commercial.
Sec. 3. The Zoning Map shall be amended by reclassifying the following described lands
from C-2 General Commercial to PUD 10:

(c) Accessory Uses. The following uses shall be permitted accessory uses in PUD 10.
(1) Incidental repair or processing which is necessary to conduct a permitted use and
does not exceed ten percent of the gross floor area of the associated permitted use.
(2) Catering, if accessory to food service, delicatessen or retail bakery.
(3) Food service.
(4) Outdoor seating and service of food and beverages with the following conditions:
a. No speakers or other electronic devices which emit sound are permitted outside
of the principal structure if the use is located within 500 feet of a residential
use.
b. Hours of operation shall be limited to 7:00 a.m. to 10:00 p.m. if located within
500 feet of a residential use.
c. Additional parking will not be required if the outdoor seating area does not
exceed 500 square feet or ten percent of the gross floor area of the principal
use, whichever is less. Parking will be required at the same rate as the principal
use for that portion of outdoor seating area in excess of 500 square feet or ten
percent of the gross building area, whichever is less.
(5) In-vehicle sales or service, limited to restaurants, banks, and pharmacies.

a. Drive-through facilities and stacking areas shall not be located within 100 feet
of any parcel that is zoned residential and used or subdivided for residential
use, or has an occupied institutional building, including but not limited to
schools, religious institutions, and community centers, unless the entire facility
and stacking areas are separated from the lot in an R district by a building wall.
b. Stacking shall be provided for six cars per customer service point and shall
comply with all yard requirements.
c. This use shall only be permitted when it can be demonstrated that the operation
will not have a significant adverse effect on the existing level of service on
adjacent streets and intersections.
d. The drive-through facility shall be designed so it does not impede traffic or
impair vehicular and pedestrian traffic movement, or exacerbate the potential
for pedestrian or vehicular conflicts.
e. Access shall be to a roadway identified in the comprehensive plan as a
collector or arterial or shall be otherwise located so that access can be provided
without generating significant traffic on local residential streets.
f. Any canopy constructed as part of this use shall be compatible with the
architectural design and materials of the principal structure.
g. The use is in conformance with the comprehensive plan including any
provisions of the redevelopment chapter and the plan by neighborhood policies
for the neighborhood in which it is located and conditions of approval may be
added as a means of satisfying this requirement.
(d) Special Performance Standards
(1) All general zoning requirements not specifically addressed in this ordinance shall
be met, including but not limited to: outdoor lighting, architectural design,
landscaping, parking and screening requirements.
(2) Signage shall be subject to the regulations found in Section 36-362 pertaining to
signs. PUD 10 shall be subject to the C-2 regulations with the following
clarifications and modifications:
a. The maximum sign area shall be increased by 240 square feet with the
condition that the additional signage be used in its entirety for a free-standing
sign located at the corner of Highway 7 and Texas Ave S. The sign shall be
double sided, and not exceed 120 square feet per side.
(3) Awnings shall be constructed of heavy canvas fabric, metal and/or glass. Plastic
and vinyl awnings are prohibited. Backlit awnings are prohibited.
Sec. 4. The contents of Planning Case File 17-08-PUD are hereby entered into and made
part of the public hearing record and the record of decision for this case.
Sec. 5. This Ordinance shall take effect fifteen days after its publication.

Description of Request: Douglas Corporation applied for a conditional use permit (CUP) for the
property at 3520 Xenwood Avenue to allow excavation of more than 400 cubic yards of soil. The
plan is to excavate 2,150 cubic yards in order to install two underground detention tanks to collect
rainwater which will be captured from the roof, stored in the buried tanks, and then pumped into
the facility for treatment and reuse in the industrial process.

Existing Conditions: The subject property is used for industrial purposes. Douglas Corporation
is a metal-plating company. There is currently no on-site stormwater management and the site does
not meet today’s zoning regulations for the number of parking stalls or landscaping. The proposed
plans bring the site closer to compliance as much as possible. There are no proposed changes to
the existing building.
Background: The Minnesota Pollution Control Agency (MPCA) determined that Douglas
Corporation was the source of pollution contaminating Lake Calhoun. Prior to 2010, the company
used chemicals in the manufacturing process that contaminated the stormwater on the site. Once
the company realized their potential harm, they ceased using the products and found alternatives;
however, the chemicals accumulated on the roof. Since 2010, Douglas Corporation has worked
with the MPCA to replace the roof, roof vents, tanks and other structures, but there are still traces
of pollution on the property contaminating stormwater runoff.
Douglas Corporation’s goal is to stop the stormwater contamination by capturing runoff from the
property before it leaves the site, filtering/treating the water, and reusing the water in its industrial
process. The capture, filter, and reuse system is an improvement that is supported by the MPCA
and will help protect the area’s surface waters and groundwater.
Proposal: Douglas Corporation proposes to construct an underground stormwater capture, filter,
and reuse system to reduce the concentration of chemicals that are currently having a negative
impact on Lake Calhoun. This project supports the City’s Comprehensive Plan by improving the
quality and reducing the quantity of stormwater discharge.
Conditional Use Permit for Excavating: A conditional use permit is required to import or export
more than 400 cubic yards of soil. The proposed plan requires the excavation of approximately
2,150 cubic yards of soil. It is anticipated that it will take approximately 180 trucks to remove the
material. Primary haul routes include Xenwood Ave, 36th Street West, and Hwy 100.
Construction Hours: City Ordinance allows construction to occur Monday through Friday 7 a.m.
to 10 p.m. and is allowed on weekends from 9 a.m. to 10 p.m. However, the applicant proposes
to limit construction to Monday through Friday from 8 a.m. to 5 p.m. unless special circumstances
require otherwise.
Construction Duration: Construction for the stormwater system is proposed to begin in May or
June 2017. Construction is anticipated to last one month.
Parking During Construction: The applicant is contacting area property owners to lease unused
parking spaces to accommodate Douglas Corporation’s employees during the construction time
period. Potential parking locations include the city-owned Nash Frame site, the city-owned
municipal parking lot along W 36th Street, and Burlington Coat Factory.

Site Plan: The proposed underground stormwater system will be located on the west side of the
property underneath the existing parking lot. The parking lot will be excavated, the stormwater
system installed, and reconstructed to the existing conditions.
There are no proposed changes to the exterior of the existing building.
Landscaping: The applicant is not proposing the removal of any trees from the site, however, the
existing landscaping does not meet the city’s landscaping requirement of one canopy tree per 1,000
gross square feet of industrial space. This equates to 28 canopy trees. There are currently 10
canopy and 2 ornamental trees on the site. This means an additional 17 trees are required to meet
code. The applicant proposes to plant two more canopy trees and one ornamental trees to the site.
Adding more trees than proposed is not feasible due to the location of existing canopy trees and
overhead utility lines.
Parking: The applicant’s existing surface parking lot has 33 vehicle spaces and zero bicycle
parking spaces. This does not meet the city’s current parking code for a manufacturing facility.
Today’s zoning ordinance requires five parking spaces plus one space per each 500 square feet of
floor area (61 spaces), and bicycle parking spaces equal to ten percent of the automobile parking
space requirement (6 spaces). It is not feasible or necessary to require additional vehicular parking

parking spaces to bring the property closer to conformity with today’s parking requirements.
The applicant is proposes to add a 5-Loop wave style bicycle rack, adding 6 bicycle parking spaces
to the north side of the building. These types of bicycle racks do not meet city code. The applicant
has agreed to amend the type of bicycle racks to meet city code design requirements.
Neighborhood Meeting: A neighborhood meeting was held on February 28 at Union
Congregational Church. There were no members of the community in attendance.
Staff Recommendation: Staff recommends approval of the Conditional Use Permit for 2,150
cubic yards of excavation to allow construction of the underground stormwater detention system.
1. The site shall be developed, used and maintained in conformance with the Official Exhibits.
2. All required permits shall be obtained prior to starting construction, including but not limited
to:
a. NPDES Grading/Construction Permit.
b. City of St. Louis Park Erosion Control and Building Permits.
c. A stormwater management permit from the Minnehaha Creek Watershed District.
3. Stormwater Management:
a. The drainage system shall be owned and maintained by the Douglas Corporation.
b. A complete soils report shall be submitted prior to permitting for City Engineering
Department review and approval.

6. ACCESS CONSTRAINTS TO BE PLACED ON THE CONTRACTOR FOR THE PROJECT ARE SPECIFIED IN
SECTION 01110 OF THE SPECIFICATIONS.
7. CONTRACTOR SHALL MAINTAIN ACCESS TO ALL SITE FACILITIES DURING CONSTRUCTION. CONTRACTOR
SHALL PLAN HIS WORK SEQUENCE AND ACTIVITIES TO ENSURE THAT HIS WORK DOES NOT INTERFERE
WITH PUBLIC NEEDS OR PUBLIC FACILITIES OPERATIONS, DELIVERIES, PICKUPS OR OTHER ACCESS
NEEDS.
8. THE CONTRACTOR SHALL COORDINATE THE ACTIVITIES OF HIS PERSONNEL, SUBCONTRACTORS, AND
UTILITIES PERFORMING WORK ON THIS PROJECT. THE CONTRACTOR SHALL ALSO COORDINATE WITH
CITY CREWS AND OTHER CONTRACTORS WORKING IN OR NEAR THE PROJECT AREA.
9. THE CONTRACTOR SHALL MAINTAIN ON FILE WITH THE OWNER AND ENGINEER A CURRENT LIST OF
EMERGENCY TELEPHONE NUMBERS FOR THE CONTRACTORS SUPERVISORY PERSONNEL ASSIGNED TO
THIS PROJECT. NO LESS THAN 2 NAMES WITH 24 HOUR PHONE NUMBERS SHALL BE INCLUDED.
10. ELEVATIONS CALLED OUT ON THE DRAWINGS ARE TYPICALLY AT THE "INVERT" OR BOTTOM OF PIPES
AND STRUCTURES, ALONG THE FLOW LINE IN GUTTERS AND SWALES, AND AT THE "RIM" OR TOP
(FINISHED GRADE) OF THE FRAME AND COVERS. OTHER ELEVATIONS ARE SPECIFICALLY NOTED.
11. UNLESS NOTED OTHERWISE RESTORATION OF EXISTING SANITARY SEWERS AND SERVICE LINES,
WATER MAINS AND SERVICE LINES, STORM SEWERS, OTHER UTILITIES, SIDEWALKS, CURBS,
DRIVEWAYS, STREETS OR OTHER IMPROVEMENTS NOT SHOWN AS BEING REMOVED, REPLACED OR
MODIFIED BY THE PROJECT IS REQUIRED ONLY TO THE EXTENT THEY ARE DAMAGED OR DISTURBED BY
CONSTRUCTION ACTIVITIES. THE CONTRACTOR SHALL RESTORE ALL DAMAGED AND DISTURBED
IMPROVEMENTS TO THE OWNERS AND ENGINEERS SATISFACTION.
12. WHERE NEW WORK ABUTS EXISTING CURBS, SIDEWALK, DRIVES, OR OTHER PAVEMENTS WHICH ARE TO
REMAIN IN PLACE, THE CONTRACTOR SHALL PROVIDE NEAT SAWCUTS, FULL DEPTH AT THE LIMIT OF
CONSTRUCTION.
13. CONTRACTOR SHALL PROVIDE SUPPORT AND SHALL MAINTAIN SERVICE TO ALL ABOVE AND BELOW
GRADE UTILITIES INCLUDING POLES, CABLES, WIRES, WATER, GAS, STORM , AND SANITARY FACILITIES,
OR WITH THE WRITTEN CONCURRENCE OF THE UTILITY OWNER, MAY REMOVE, STORE, REINSTALL AND
REPLACE AS NECESSARY.
14. CONTRACTOR IS RESPONSIBLE FOR SITE SAFETY DURING CONSTRUCTION OF THE PROJECT.
15. THE CONTRACTOR SHALL PROTECT ALL PROPERTY PINS (STEEL REBARS, PIPES, CAPPED PINS, ETC.)
WHICH WERE FOUND OR LOCATED ON THE PROJECT SITE WHETHER SHOWN ON THE PLANS OR
ENCOUNTERED DURING CONSTRUCTION FROM BEING DAMAGED, DESTROYED OR MOVED. IF
PROPERTY PINS ARE DAMAGED, DESTROYED OR MOVED, THE CONTRACTOR SHALL PROVIDE THE
SERVICES OF A REGISTERED MINNESOTA LAND SURVEYOR TO REPLACE THEM AT NO COST TO THE
OWNER.
16. AS PART OF THE CONTRACTORS RESPONSIBILITIES A DETAILED SET OF RECORD DRAWINGS SHALL BE
KEPT TO RECORD CHANGES OR DEVIATIONS FROM THE PLANS AND TO SHOW EXISTING UNDERGROUND
UTILITIES OR OTHER FEATURES ENCOUNTERED DURING CONSTRUCTION.

8. COMPLETE GRADING, PLACE TOPSOIL (6-INCHES MINIMUM) AND SODDING OR
SURFACE RESTORATION WITHIN 7 DAYS OF LAST CONSTRUCTION ACTIVITY IN
AREA.
9. WHEN ALL CONSTRUCTION ACTIVITIES ARE COMPLETE AND SITE IS STABILIZED,
REMOVE TEMPORARY EROSION CONTROL PER PROJECT ENGINEER APPROVAL.

OF ANY APPLICABLE WATER QUALITY STANDARDS OR THE SWPPP DOES NOT INCORPORATE
THE REQUIREMENTS RELATED TO AN APPROVED TOTAL MAXIMUM DAILY LOAD (TMDL).
THE PERMITTEE MUST IMPLEMENT THE SWPPP AND INSTALL BMPS IDENTIFIED IN THE SWPPP IN AN
APPROPRIATE AND FUNCTIONAL MANNER.
THE LOCATION OF AREAS NOT TO BE DISTURBED MUST BE DELINEATED ON THE SITE BEFORE
CONSTRUCTION BEGINS.
ALL SEDIMENT DEPOSITS WITHIN SURFACE WATERS MUST BE REMOVED AND RESTABILIZED WITHIN
7 DAYS OF DISCOVERY. THIS INCLUDES DELTAS AND STORM SEWER SEDIMENT DEPOSITS.

2. HAZARDOUS MATERIALS: OIL, GASOLINE, PAINT, AND ANY HAZARDOUS SUBSTANCES MUST BE
STORED, INCLUDING SECONDARY CONTAINMENT, TO PREVENT SPILLS, LEAKS OR OTHER
DISCHARGES. RESTRICTED ACCESS TO STORAGE AREAS MUST BE PROVIDED TO PREVENT
VANDALISM. STORAGE AND DISPOSAL OF HAZARDOUS WASTE MUST COMPLY WITH MPCA AND
