HomeMy WebLinkAbout18-026 - ADMIN Resolution - City Council - 2018/02/05RESOLUTION NO. 18-026 RESOLUTION REVISING RESOLUTION NO. 17-196 LIMITING NUMBER OF OFF -SALE INTOXICATING LIQUOR LICENSES WHEREAS, on December 18, 2017 the City Council adopted Resolution No. 17-196 whereby the City Council restricted the number of off -sale intoxicating liquor licenses to fifteen (15); and WHEREAS, only thirteen (13) of the fifteen (15) licensed off -sale liquor licenses in the stores are being utilized by businesses that are still in operation; and WHEREAS, the City remains concerned about the number of off -sale intoxicating liquor licenses issued on a per capita basis compared to neighboring and other comparable cities; and WHEREAS, the City Council has regulatory concerns about this relatively high number and location of off -sale liquor establishments in the City; and WHEREAS, the City Council believes that it would be in the best interest of the City and its citizens to engage in more detailed studies to determine if additional regulations are needed; and WHEREAS, the City Council also believes that it is appropriate and in the best interest of the City and its citizens to limit the number of off -sale intoxicating liquor licenses to the existing number of issued licenses at this time that are currently being utilized while the City Council studies the issue; and WHEREAS, in accordance with State law, City Code Section 3-72 allows the City Council by resolution to restrict the number of any type of liquor license issued by the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park, Minnesota, that: 1. Pursuant to St. Louis Park City Code Section 3-72, the total number of off -sale intoxicating liquor licenses issued in the City will be restricted to thirteen (13). 2. The only off -sale intoxicating liquor license that will be issued will be for the continued operation of a liquor store by a new or existing owner at a location that is currently utilizing the existing licensed premises. 3.
