On motion of Councilman Middleton, seconded by Councilman Hurd, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION REFUNDING 0-47 ALLEY GRADING #497 ASSESSMENT
WHEREAS it appears that on June 19, 1950, the Minneapolis, Northfield and
Southern Railway paid the Village of St. Louis Park #24.50 (Receipt #4136, full
payment for the above assessment; and
WHEREAS the County Auditor's Office inadvertantly failed to remove the 1951
installment from their rolls, resulting in the Railway's paying the 1951 amount of
10.06 again on the tax statement; therefore
BE IT RESOLVED by the City .Council of the City of St. Louis Park that the 1951
installment of such assessment heretofore paid in the respective amount set forth
below be refunded to the respective property owner, and, upon receipt of a signed
yerified claim and the paid tax statement, that the City Manager, the City Clerk,
and the City Treasurer be hereby authorized to issue warrants in payment of such
refund to the respective property owner.

Resolution No. 48 Adopted April 4, 1955
On motion of Councilman Bolmgren, seconded by Councilman Middleton, the follow-
ing resolution was adopted by unaniiiious vote of all Members of the Council present:
RESOLUTION REFUNDING GARBAGE DISPOSAL ASSESSMENT
WHEREAS, it appears that by resolution of the Village Council levying assessments
for Garbage Disposal, the following property was inadvertantly assessed for five pick-
ups instead of one pickup; therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that four of the
1952 thru 1954 instalments of such assessment heretofore paid in the respective
amounts set forth below be refunded to the respective property owner, and, upon re-
ceipt of a signed verified'claim and the paid tax statements, that the City Manager,
the City Clerk, and.the City Treasurer be hereby authorized to issue warrants in
payment of such refund to the respedtive property owner.

The following resolution having been read by the Secretary, it was moved by
Councilman Bolmgren, seconded by Councilman Perkins; and adopted by unanimous
vote of all Members of the Council present.
RESOLUTION ORDERING WATER MAIN CONSTRUCTION
WHEREAS the City Council has met.at the time and place specified in the notice
published in the St. Louis Park Dispatch March 31 and April 7, 1955 relating to the
public improvements hereinafter described and has heard all interested persons
appearing at said meeting and has secured from the City Engineer a report advising
it in a preliminary way as to whether each proposed improvement is feasible and as
to whether it should best be made as proposed or in connection with soige other im-
provement, and the estimated cost of the improvements as recommended; therefore,

BE IT RESOLVED by the City Council of the City of St. Louis Park that the follow-
ing public improvements be hereby ordered in accordance with plans and specifications
which have been prepared by the City Engineer and filed with the City Clerk, and the CLty
City Clerk is hereby directed to advertise for bids which will be opened at the
meeting of the Council May 9, 1955.

The following resolution, having been read by the Secretary, it was moved by
Councilman Hurd, seconded by Councilman Middleton, and adopted by unanimous vote
of all Members of the Council present:
RESOLUTION
WHEREAS it appears from evidence submitted to the Council by Mr, William A.
Reiners, head of Parks and Playgrounds Department, gleaned from his detailed in-
spection of boulevard trees with Elmer H. Lesch, Entomologist of t he Standard
Oil Company, from conferences with Mr. Hodson, entomologist -from the University
of Minnesota, and inspection of certain clippings of affected limbs and branches,
and
WHEREAS it appears that severe damage to the boulevard trees will occur if the
pest infestation, blight and other diseases are not arrested by immediate treatment,
and
WHEREAS, the experts consulted have advised that action taken later than 7 days
from the date hereof will not be effective to control the progress of damage caused
as above described, and
WHEREAS, the need for spraying to control this condition has been created by
the unseasonable high temperatures and budding of leaves, and
WHEREAS investigation has been made to determine the program of spraying work
in neighboring municipalities which indicates that Hopkins, Morningside, Minnea-
polis and St. Paul have begun spraying programs, and
WHEREAS inquiry has been made concerning the cost of performing the work and
bids received from Gopher State Tree Service at $1.15 per tree, Homedale Nursery
at $1.75 per tree, and Hughes Brothers at $1.15 per tree, and inquiry has disclosed
that Hopkins is paying $1.50 per tree and Morningside is paying $1.50 per tree, and
WHEREAS it appears from the Council's interpretation of Sections 5.05 and 5.06
of the Home Rule Charter that the Charter does not require the publication of bids
