RESOLUTION NO. 88 7 41111 A RESOLUTION RESCINDING RESOLUTION NO. 85-61 ADOPTED ON MAY 6, 1985, RESCINDING RESOLUTION NO. 5688 ADOPTED ON FEBRUARY 7, 1977, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-141(9) AND SECTION 14-195 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A 108 -UNIT APARTMENT BUILDING AND A 45 -UNIT APARTMENT BUILDING ON PROPERTY ZONED R-4, MULTIPLE FAMILY RESIDENCE DISTRICT, AT 1341, 1351 AND 1361 HAMPSHIRE AVENUE FINDINGS WHEREAS, .Ted Bigos Investment Company (Richard Gilbertson) has made application to the City Council for a special permit under Section 14-141(9) AND Section 14-195 of the St. Louis Park Ordinance Code to allow a 108 -unit apartment building and a 45 -unit apartment building at 1341, 1351 and 1361 Hampshire Avenue within a R-4, Multiple Family Residence District, having the following legal description: Lot 5, Block 1, Lou Park Addition (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 77 -3 -SP, 85 -33 -SP and 87 -91 -SP) and the effect of the proposed 108 -unit apartment building and 45 -unit apartment building on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 85-61 of the St. Louis Park City Council dated May 6, 1985 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 85-61 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; INCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 85-61 (filed as Document No. 4998469) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting apartment buildings within the R-4, Multiple Family Residence District, at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan (from Case No. 77 -3 -SP); Exhibit B - Landscape Plan (from Case No. 77 -3 -SP); Exhibit C - Floor Plans (from Case No. 77 -3 -SP); and Exhibit D - Elevation Plans from Case No. 77 -3 -SP). (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. No building permits shall be granted until the City Engineer approves a complete drainage and utility plan for the 108 -unit apartment building. 3. The building shall be provided throughout with an automatic fire extinguishing system. 4. All construction, paving, striping, landscaping, lighting and recreation facilities shall be completed by September 1, 1978, providing, however, said Exhibits specified in Condition No. 1 are hereby amended to allow 1 additional unit bringing the total number of units to 108 instead of the previously approved number of 107 units. 5. That an additional 45 -unit apartment building is hereby permitted at the southeast corner of the property, subject to the following conditions: a. The site shall be developed, used and maintained in accordance with Exhibit A Site Plan; Exhibit B - Grading, Drainage and Utilities Plan; Exhibit C - Landscape Plan as modified by City Development on December 18, 1987; Exhibit D - Garage and Entry Level Floor Plan; Exhibit E - East and South Elevation Plan; and Exhibit F - North and West Elevation Plan, except as modified by the following: b. Exhibit B - Grading, Drainage and Utilities Plan is subject to modifications as may be required by Public Works. c. Exhibit D - Garage and Entry Level Floor Plan is for general purposes of identifying the relative number of parking spaces and general layout. d. There shall be no outdoor storage of trash or trash containers, and all trash and trash containers shall be stored completely within the building. e. All floors shall be sprinklered or otherwise modified to meet the requirements of the fire marshall. f. A minimum floor_ elevation for the parking garage shall be 879 N.G.V.D., and the applicant and its successors and assigns hereby recognize their responsibility relative to design for prevention of water infiltration into the garage -first floor level. g.
