HomeMy WebLinkAbout90-5 - ADMIN Resolution - City Council - 1990/01/16RESOLUTION NO. 90-5 A RESOLUTION RESCINDING RESOLUTION NO. 5926 ADOPTED ON DECEMBER 19, 1977 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-126(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A GOLF COURSE/COUNTRY CLUB PARKING LOT ADDITION AT 2001 FLAG AVENUE SOUTH FINDINGS WHEREAS, the Minneapolis Golf Club has made application to the City Council for a special permit under Section 14-126(2) of the St. Louis Park Ordinance Code to allow a golf course/country club parking lot addition at 2001 Flag Avenue South within a R-1, One Family Residence District having the following legal description: Lot 1, "Auditor's Subdivision Number 270, Hennepin County, Minnesota", and Lot 11, "Auditor's Subdivision Number 285, Hennepin County, Minnesota", Except that part of said Lot 1 lying within Block 2, Westwood Estates 2nd Addition, and except that part of said Lots 1 and 11 described as follows: Beginning at the Northwest corner of said Lot 11; thence East along the North line of said Lot 11 to a distance of 225 feet; thence South parallel with the West lines of said Lots 11 and 1 a distance of 400 feet; thence West, parallel with the North line of said Lot 11, a distance of 225 feet to the West line of said Lot 1; thence North along'the West lines of said Lots 1 and 11 to the point of beginning, and except that part lying within the most Westerly 33 feet of said Lot 1. That part of the Southwest Quarter of the Northeast Quarter, Section 7, Township 117, Range 21, Hennepin County, Minnesota, described as follows: Beginning at a point on the West line of the Northeast Quarter of said Section 7 distant 260 feet North from the Southwest corner of said Northeast Quarter; thence East, parallel with the South line of said Northeast Quarter, a distance of 30 feet; thence north, parallel with said West line, 177.65 feet; thence East, parallel with said South line, 135 feet; thence North, parallel with said West line, to the Southerly line of Lot 1, "Auditor's Subdivision Number 270, Hennepin County, Minnesota"; thence Westerly along the Southerly line of said Lot 1 to the West line of said Northeast Quarter; thence South along said West line to the point of beginning. Subject to an electric transmission line easement and other rights in connection therewith, in favor of Northern States Power Company, as created by agreement on file in Torrens Case No. 19393 over that part of the above land described in Document No. 1949659; WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case No. 89 -85 -SP and 77 -83 -SP and the effect of the proposed golf course/county club parking lot addition on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 5926 of the St. Louis Park City Council dated December 19, 1977 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 5926 to add the amendments now required, and to consolidate all conditions i applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case Files 89 -85 -SP and 77 -83 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. WHEREAS, the applicant has reduced the number of parking spaces in the proposed parking lot from 113 CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 5926, no document number filed, is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting a golf course/country club parking lot addition within the R-1, Single Family Residence District at the location described above based on the following conditions: 1. Refuse storage shall be located within an enclosed structure. 2. All construction, modifications, and conditions of this permit shall be completed by September 1, 1978. 3. Granting the permit will not limit the City's right to restrict on -street parking or to other wise restrict traffic on Flag Avenue if warranted based on land use, safety concerns, and/or congestion that might occur on Flag Avenue. 4. A parking lot shall be constructed by October 15, 1990 according to a plan agreed on by the applicant and staff, generally designed in accordance with the site plan dated August 28, 1989, and located east of the swimming pool and south of the north line of the access road proj ected easterly, but modified as follows: a: A five (5) foot high berm with appropriate shrubbery and six (6) blue spruce planted on the north side shall be installed along the north side of the parking lot between the northeast and northwest corners. A row of shrubs shall be planted along the north side of the access road between the northwest corner of the parking lot and the east line of the property fronting on Flag Avenue immediately north of the access road. b. The parking lot and access road shall be hard surfaced. c. B-612 curb and gutter and curb stops shall be installed. d. The access road to the parking lot shall be a minimum of 20 feet in width, widened to the south and not raised in elevation. e. The parking lot shall be sloped to drain in its entirety to a catch basin which shall be installed in the extreme southeast corner of the parking lot. f. An acceptable means of trapping pollutants and sediments from water draining off of the parking lot shall be installed. The parking lot shall be designed to accommodate the needs of the fire department for a turnaround. h. An entryway gate for the access road shall be installed at, but off of the right of way at Flag Avenue, which shall be closed between the hours of 10:00 p.m. and 6:00 a.m. between May 15, and October 1, and at all times between October 1 and May 15. g. 5. This special permit shall take effect upon submission of a site plan as described above that is agreed upon between the applicant and staff.
