LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT AN OFFICE BUILDING AND DAY CARE CENTER FOR PROPERTY IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT AT 4959 EXCELSIOR BOULEVARD BE IT RESOLVED by the City Council of the City of St. Louis Park: Findings 1. The St. Louis Park Medical Center has made application to the City Council for a special permit under Secton 14-124.101 of the St. Louis Park Ordinance Code for the purpose of permitting an office building and day care center located at 4959 Excelsior Boulevard for the legal description as follows, to -wit: Commencing at the intersection of the centerlines of Excelsior Boulevard and Quentin Avenue and extending westerly along the centerline of Excelsior Boulevard 430 feet, then extending southerly perpendicular to the cenerline of Excelsior Boulevard 350 feet, then extending easterly parallel to the centerline of Excelsior Boulevard 75 feet, then extending southerly along the east line of Lot 22, Block 1, Brookview Addition extended to the northerly line of West 40th Street, then extending easterly along the north line of West 40th Street a distance of 70 feet, then extending northerly along the centerline of Quentin Avenue to the point of beginning, except for that portion taken for right of way for Quentin Avenue and Excelsior Boulevard 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 78 -60 -SP and 82 -1 -SP) and the effect of the proposed office building and day care center on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed office building and day care center will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed office building and day care center are ini harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit an office building and day care center at the location described is granted based on the findings set forth above and subject to the following conditions: 1. Plans shall be prepared for paving and landscaping of the site in accordance with the Excelsior Boulevard Final General PUD Plan providing for not less than 156 parking spaces. 2. Not more than 3,800 square feet of floor area shall be utilized for day care center. 3. The playground area shall be developed in accordance with Exhibit A, Playground Plan. 4. Not more than 10 percent of the floor area of the building shall be utilized for retail services. 5. All outside air handling equipment, compressors, heating equipment, and trash facilities shall be screened within an enclosure. 6. All site work including parking lot improvements, landscaping, and equipment screening shall be completed by June 1, 1980. 7. The playground area associated with the day care center shall be completed prior to occupancy of the day care center. 8. That the parking plan, pedestrian plan, and landscape plan be complete as shown on Exhibit B except that an unexclusive lease be granted to the property at 4995 Excelsior Boulevard for 51 spaces and a similar lease be obtained from the owners of such property for the lease of 20 spaces at the southeast corner of the said property owned by Corrigan Properties. There is, however, flexibility with: layout of the parking spaces but not the total number, location of the landscaping but not the relative number and quality, and details of the pedestrian ways, plazas and play space but not the relative quality or general location. 9. That the pedestrian way and associated landscaping be completed by October 15, 1982. 10. That relocation of the play area and parking and driveway and all other parking elements be completed by October 15, 1983. 11. The agreement(s) for parking is subject to approval by the City Attorney prior to issuing a building permit. -2- 12. That easements be granted along the north side of the property for construction of pedestrian and bus plaza improvements prior to March 15, 1982. 13. Requirements in Conditions 1, 6, 8, 9 and 12 related to con- struction of the pedestian way are hereby deleted.
