A RESOLUTION RESCINDING RESOLUTION NO. 85-69 ADOPTED ONMAY20, 1985, AND GRANTING SPECIAL (CONDITIONAL USE) PERMITUNDERSECTIONS14-131(1) AND 14-126(5) OF THE ST. LOUIS PARKORDINANCECODERELATINGTOZONINGTOALLOWTHECONSTRUCTIONOFCLUSTERHOUSINGWITHINANR-2, SINGLEFAMILYRESIDENCEDISTRICT, AT 7741, 7743, 7745, AND 7747 13 1/2STREETWEST
FINDINGS
WHEREAS, John J. Glynn (Dan -Bar Homes and DABCO Development) has made
application to the City Council for a special permit under Sections 14-131(1) and 14-126(5) of the St. Louis Park Ordinance Code to allow the construction of cluster housing at7741, 7743, 7745 and 7747 13i Street West within an R-2, Single Family Residence Districthavingthefollowinglegaldescription:
Lots 1 and 3, Block 1, Linners Addition (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of thePlanningCommission (Case Nos. 84 -110 -SP and 86 -2 -SP) and the effect of the proposedclusterhousingonthehealth, safety, and welfare of the occupants of the surroundinglands, existing and anticipated traffic conditions, the effect on values of properties inthesurroundingareaandtheeffectoftheuseontheComprehensivePlan; and
WHEREAS, a special permit was issued regarding the subject property pursuant toResolutionNo. 85-69 of the St. Louis Park City Council dated May 20, 1985 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are nownecessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 85-69 to add the amendments now required, andtoconsolidateallconditionsapplicabletothesubjectpropertyinthisresolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 85-69 (filed as DocumentNo. 4999300 is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting clusterhousingwithintheR-2, Single Family Residence District at the location described abovebasedonthefollowingconditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - SitePlan/Landscape Plan, Exhibit B - Elevation, and Exhibit C - Utilities, except as
modified by the following (Exhibits are on file in the City Development DepartmentattheCityofSt. Louis Park)
a. The utility plans shall be modified to show the manhole and water shut -offs
located on the right-of-way of Rhode Island Avenue.
b. All improvements shall be completed by May 15, 1986
2. Exhibit A - Site Plan/Landscape Plan is hereby amended by Exhibit Al - Amended
Site Plan/Landscape Plan with respect to the building size and location and with
respect to the landscape screen along the northerly lot line of said Lot 3 and its
westerly projection to the west line of said Lot 1; and Exhibit B - Elevation shall
be amended by Exhibit 81 - Elevation dated December 1, 1985; subject to the following:
a. The creation of a separate lot for the ,single family home is approved with a
rear yard setback of 11 feet instead of the normally required 30_ feet.
b. All improvements shall be completed by October 15, 1986
