A RESOLUTION RESCINDING RESOLUTION NO. 84-44 ADOPTED ON
APRIL 16, 1984, RESCINDING RESOLUTION NO. 4593 ADOPTED ON
MARCH 29, 1976, AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW A DRIVE-IN
BUSINESS IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT
5400 WEST 39TH STREET
FINDINGS
WHEREAS, The Automobile Club of Minneapolis has made application to the City
Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance
Code to allow a drive-in business at 5400 West 39th Street within a PUD, Planned Unit
Development District, having the following legal description:
That part of the South 24 feet of Lot 4 which lies West of the Northerly
extension of a line parallel with and 924 feet West of the East line of
the Northwest Quarter of the Northwest Quarter of Section 7, Township
28, Range 24, all in Block 2, PARK CENTER, according to the plat
thereof on file and of record in the office of the Register of Deeds, in
and for Hennepin County, Minnesota. (Abstract)
That part of the Northwest Quarter of the Northwest Quarter of Section
7, Township 28, Range 24, described as follows: Commencing at the
Northwest corner of the Northwest Quarter of the Northwest Quarter
of said Section 7; thence running South along the West line of said
Section a distance of 443.71 feet; thence East parallel with the North
line of said Section to the East line of the Northwest Quarter of the
Northwest Quarter; thence North along the East line of said Northwest
Quarter of the Northwest Quarter to the Northeast corner thereof; thence
West along the North line of said Section to the point of beginning,
except the East 924 feet thereof, except the West 80 feet thereof,
except the South 33 feet thereof, and except Parcel 6 Minnesota
Department of Transportation Right -Of -Way Plat 27-10. (Certificate
No. 523857)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case Nos. 75 -95 -SP, 84 -25 -SP and 87 -60 -SP) and the effect of the
proposed drive-in business on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 84-44 of the St. Louis Park City Council dated April 16, 1984 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 84-44 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;

CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 84-44 (Document not filed)
is hereby rescinded and replaced by this resolution which continues and amends a special
permit to the subject property for the purposes of permitting a drive-in business within
the PUD, Planned Unit Development District, at the location described above based on
the following conditions:
1. That the site be developed, used and maintained in accordance with Exhibit A - Site
Plan; Exhibit B - Main Floor Plan; Exhibit C - Lower Floor Plan; Exhibit D - Elevation
Plans (two pages); and Exhibit E - Landscape Plan. (Exhibits are on file in the City
Development office at the City of St. Louis Park)
2. That refuse storage dumpsters be screened from view and a solid gate provided.
3. That a parking lot be allowed near the southeast corner of the property for
approximately 24 cars in accordance with the following conditions:
a. That the site be developed, used and maintained in accordance with Exhibit F
Parking Lot Plan.
b. That, the parking lot be completed including concrete curbing, sidewalk, and
landscaping by October 15, 1984.
4. That one set of informational signs, containing 104 square feet, be permitted on each
of the four faces of the building to read as follows: "Automobile Club" (in 24 inch
high blue letters); "Travel Agency" (in 18 inch high red letters; and "Insurance Agency"
in 18 inch high red letters).
