LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW THE CONSTRUCTION OF AN OFFICE BUILDING AND PARKING FACILITY AT 1550 UTICA AVENUE SOUTH FINDINGS WHEREAS, MEPC American Properties Incorporated has made application to the City Council for a special permit under Section 14-124 of the St. Louis Park Ordinance Code to allow construction of an office building with a gross floor area of 262,200 square feet of floor area with 6,000 square feet of retail space, and a parking facility at 1550 Utica Avenue within a DDD, Diversified Development District having the following legal description: All that part of the South Half of the Southwest Quarter of Section 30, Township 29, Range 24, and of Tracts A and E, Registered Land Survey No. 864, Files of the Registrar of Titles, County of Hennepin, lying: Easterly of the Southerly extension of the West line of said Registered Land Survey No. 864, Northerly of the Northerly line of Gamble Drive, as described in Ordinance No. 1004 filed as Document No. 922588 in the Office of the Registrar of Titles, and Westerly of the Southerly extension of the East line of Tract B, said Registered Land Survey No. 864. And situate in Hennepin County, Minnesota WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 85 -38 -SP and 85 -67 -SP) and the effect of the proposed 262,200 square foot office building and parking facility on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 85-101 of the St. Louis Park City Council dated July 15, 1985 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 85-101 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution;
