A RESOLUTION RESCINDING RESOLUTION NO. 85-175 ADOPTED ON
OCTOBER 21, 1985, RESCINDING RESOLUTION NO. 85-101 ADOPTED
ON JULY 15, 1985, AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-124 OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO ALLOW THE CONSTRUCTION OF AN
OFFICE BUILDING AND PARKING FACILITY ON PROPERTY ZONED
DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT 1550 UTICA AVENUE
SOUTH
FINDINGS
WHEREAS, MEPC American Properties Incorporated has made application to the CityCouncilforaspecialpermitunderSection14-124 of the St. Louis Park Ordinance Code
to allow construction of an office building with a gross floor area of 242,204 square feet
and a parking facility at 1550 Utica Avenue within a DDD, Diversified Development District
having the following legal description:
All that part of the South Half of the Southwest Quarter of Section 30,
Township 29, Range 24, and of Tracts A and E, Registered Land SurveyNo. 864, Files of the Registrar of Titles, County of Hennepin, lying:
Easterly of the Southerly extension of the West line of said Registered
Land Survey No. 864,
Northerly of the Northerly line of Gamble Drive, as described in Ordinance
No. 1004 filed as Document No. 922588 in the Office of the Registrar
of Titles, and
Westerly of the Southerly extension of the East line of Tract B, said
Registered Land Survey No. 864.
And situate in Hennepin County, Minnesota
Torrens Certificate No. 573985)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 85 -38 -SP, 85 -67 -SP, and 86 -14 -SP) and the effect of the
proposed 242,204 square foot office building and parking facility on the health, safety,
and welfare of the occupants of the surrounding lands, existing and anticipated traffic
conditions, the effect on values of properties in the surrounding area and the effect of
the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant toResolutionNo. 85-175 of the St. Louis Park City Council dated October 21, 1985 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 85-175 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 85-175 (filed as Document
No. 1686815) is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting a 242,204
square foot office building and parking facility within the DDD, , Diversified Development
District at the location described above based on the following conditions:
1. That the site be developed, used and maintained in accordance with Exhibit A - Site
plan and Lighting Plan; Exhibit B - Grading Plan; Exhibit C - Utilities Plan; Exhibit
D - Landscape Plan; Exhibit E - Building Elevations; Exhibit F - Basement Floor
Level Plan; Exhibit G - Ground Floor Plan; Exhibit H - Second Floor Plan; and Exhibit
I - Typical Floor Plan, as modified by City Development on March 13, 1986. (The
floor plans are included to show general use and configurations only.) If the City
Council, in its sole discretion, determines that parking for the complex is inadequate,
the applicant hereby agrees to provide additional parking to meet the 3.9 parkingratiofortheentirecomplex.
2. That all walkways and improvements to public right-of-way are subject to submission
of construction plans and final approval of the City.
3. That easements be provided for transit stops where requested.
4. That all utilities be placed underground and proper provisions for water augmentation
in landscaped areas be provided.
5. Where the plan interfaces with previously approved special permits, that necessary
adjustments be made at the transitional points to insure continuity and proper transition.
6. That a provision for a landscaped walkway area to connect the site to the west be
provided generally along the south side of the subject building.
7. That all parking lots, paved areas and private roadways serving the proposed nine -
story office tower and the Gamble office building shall be delineated by poured -in-
place concrete curbing measuring at least six inches in height and depth above and
below grade, except for driveway openings and for dropped curbs at walkwayintersections.

8. That all improvements including buildings, roadways, pedestrian ways, plazas, parking
areas, and all other improvements as provided for on the exhibits be completed by
October 15, 1987.
