RESOLUTION RESCINDING RESOLUTION NO. 84-46 ADOPTED ON APRIL 16, 1984 AND GRANTING PERMIT UNDER SECTION 14-124 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW RETAIL SALES AND WAREHOUSING ON PROPERTY LOCATED IN THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT 1551 VERNON AVENUE SOUTH FINDINGS WHEREAS, Space Center, Inc. (M. F. Bank and Co.) has made application to the City Council for a special permit under Section 14-124 of the St. Louis Park Ordinance Code to allow retail sales and warehousing at 1551 Vernon Avenue South within a DDD, Diversified Development District having the following legal description: That part of the Southwest Quarter of the Southwest Quarter of Section 30, Township 29 North, Range 24 West of the 4th Principal Meridian, lying North of a line drawn parallel with and 200 feet South, measured at right angles from the North line of said Southwest Quarter of the Southwest Quarter and lying West of the Southerly extension of the West line of the East 20.87 acres of the Northwest Quarter of the Southwest Quarter of said Section, EXCEPT the West 40 feet thereof, all lying in Hennepin County, Minnesota (Abstract and Torrens) WHEREAS, the City Council has considered the advice and recommendation of the 10 Planning Commission (Case No. 84 -28 -SP) and the effect of the proposed retail sales and warehousing on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the ' effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the Resolution No. 84-46 of the St. Louis Park City Council contained conditions applicable to said property; and subject property pursuant to dated April 16, 1984 which WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 84-46 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 84-46 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting retail sales and warehousing within the DDD, Diversified Development District at the location described above based on the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A, Site Plan Sheet 2; Exhibit B, Floor Plan Sheet 2; and Exhibit C, Floor Plan Sheet 3 or Floor Plan Sheet 4. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. That the site be improved for parking of 395 vehicles permitting a portion of the spaces next to the south side of the building to be used only when loading dock access is not necessary. 4. That the applicant and owners agree and understand that the City does not intend to allow any on -street parking adjacent to or nearby the subject property and that the owner and/tenants on the subject p property orboncadproperty acentpropert es should the demand nsible to provide additional parking or need occur. 5. That all outdoor lighting be directed perpendicular to the ground and no lighting, if installed, be mounted at a height greater than 30 feet. 6. That all parking improvements, striping, landscaping, sidewalks, and all other items included on the exhibits be completion of leted tree and shructober b planting, 1984, and installation of pt installation of the parking lot dividers, peton the sidewalk which shall be completed by May 15, 1986.
