REPLACEMENT
RESOLUTION NO. 85-138
A RESOLUTION RESCINDING RESOLUTION NO. 85-99 ADOPTED ON
JULY 15, 1985 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTION 14-123.100 AND SECTION 14-156(18) OF THE ST. LOUIS
PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW GRADING
AND THE CONSTRUCTION OF AN AUTOMOTIVE SERVICE CENTER FOR
PROPERTY LOCATED IN THE B-2, BUSINESS DISTRICT AND F-2, FLOOD
PLAIN DISTRICT AT 8500-8530 HIGHWAY 7.
FINDINGS
WHEREAS, Knollwood West Partners has made application to the City Council for a
special permit under Section 14-123.100 and Section 14-156(18) of the St. Louis Park
Ordinance Code to allow grading and construction at 8500-8530 Highway 7 within a B-2,
Business District and F-2, Flood Plain District District having the following legal description:
That part of Lot 1, Block 1, Pure's Knollwood Addition lying Westerly of
a line 87.00 feet Easterly of, as measured at right angles to the Westerly
line of said Lot 1 (Torrens)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 85 -61 -SP and 85 -37 -SP) and the effect of the proposed
grading and construction on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 85-99 of the St. Louis Park City Council dated July 15, 1985 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 85-99 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 85-99 (filed as Document
No. 1660638, Files of Registrar of Titles) is hereby rescinded and replaced by this resolution
which continues and amends a special permit to the subject property for the purposes of
permitting grading and construction within the B-2, Business District and F-2, Flood Plain
District at the location described above based on the following conditions:
1. The site be developed, used and maintained in accordance with Exhibit A - Site Plan;
Exhibit B - Grading and Drainage Plan; Exhibit C - Site Plan, Exhibit D - Floor Plan,
Exhibit E - Elevation Plan, and Exhibit F - Landscape Plan. (Exhibits are on file in
the City Development Department at the City of St. Louis Park.)
2. Structure on the property shall have a minimum floor elevation of 905.8 NGVD.
3. All trash storage on the site shall be located within the building in a separately
designated exclusive area or in an attached extension of the building, fully enclosed
with walls, roof and door designed and constructed of materials matching the building.
There shall be no outside storage of trash or trash containers.
4. No outside display of merchandise shall be permitted on the site.
5. Any rooftop equipment shall be screened with materials which are architecturally
compatible with the main structure.
6. The applicant shall furnish evidence of cross easements beween the subject property
and the adjacent property to the east allowing for joint use of parking and access
facilities prior to obtaining a construction permit.
7. Any exterior lighting on the site shall be provided such that light rays will be directed
perpendicular to the ground surface and will not be directly visible from off the site.
8. All improvements shall be completed by May 15, 1986.
