RESOLUTION NO. 86- 49
RESOLUTION AUTHORIZING PURCHASE OF PROPERTY
FOR THE EXCELSIOR BOULEVARD WIDENING PROJECT
6001 Excelsior Boulevard
WHEREAS, the City Council of St. Louis Park has authorized and directed
the City Manager to negotiate with Kingstone Co., the owners of property
for the purchase of necessary Quit Claim Deeds and construction easements
for the construction of the project.
WHEREAS, Kingstone Co., pursuant to such negotiations, indicated their
desire to sell said property to the City by Quit Claim Deed for a permanent
easement for highway purposes and a construction easement. For the sum
of $3,122.00;
NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park
that the City of St. Louis Park purchase from Kingstone Co. the following
described property in Hennepin County, Minnesota, to -wit:
A permanent easement for highway purposes over all that part of the following
described tract:
All of Lot 1, except the South 80 feet thereof, and all that part of
Lot 2 described as follows: Commencing on the Northeast corner of Lot
2, thence Southerly along Easterly line of said lot, 72 feet; thence
Westerly parallel to the Southerly line of said lot, 16.5 feet; thence
parallel to the East line of said lot to the Northerly line thereof;
thence Easterly along Northerly line of said lot to beginning; also
including right of way over the North 4 feet of South 80 feet of Lot
1, in Brookside Subdivision No. 2; subject to an easement over the South
4 feet of Lot One (1) except South 80 feet thereof, in Brookside Subdivision
No. 2.
Which lies Northwesterly of the following described line:
Beginning at a point on the East line of said Lot 1 distant 16 feet
South of the Northeast corner of said Lot 1; thence Southwesterly parallel
with the Northwest line of said Lot 1 for a distance of 12 feet; thence
deflect right 90 degrees for a distance of 2 feet; thence deflect left
90 degrees for a distance of 50 feet; thence Westerly to a point on
the West line of the above described tract distant 12 feet South of
the Northwest corner thereof.

Temporary construction over that part of the following described tract:
All of Lot 1, except the South 80 feet thereof, and all
that part of Lot 2 described as follows: Commencing on theNortheastcornerofLot2, thence Southerly along Easterlylineofsaidlot, 72 feet; thence Westerly parallel to the
Southerly line of said lot, 16.5 feet; thence parallel to the
East line of said lot to the Northerly line thereof; thence
Easterly along Northerly line of said lot to beginning; also
including right of way over the North 4 feet of South 80 feetoflot1, in Brookside Subdivision No. 2; subject to an ease-
ment over the South 4 feet of Lot One (1) except South 80 feetthereof, in Brookside Subdivision No. 2.
Which lies Southeasterly of the following described line:
Beginning at a point on the East line of said Lot 1 distant
16 feet South of the Northeast corner of said Lot 1; thence
Southwesterly parallel with the Northwest line of said Lot 1
for a distance of 12 feet; thence deflect right 90 degrees
for a distance of 2 feet; thence deflect left 90 degrees
for a distance of 50 feet; thence Westerly to a point on
the West line of the above described tract distant 12 feet
South of the Northwest corner thereof.
And Northerly of the North Westerly Line of the Building
Westerly of the East line of said Lot 1 and the East line
of the building. Said construction easement shall expire
October 31, 1986.
and the Mayor and City Manager are hereby authorized to execute any and
all instruments necessary to complete the purchase of said properties,
and the City Manager is herby authorized and directed to accept deliveryofthedeedsandpaythesumof $3,122.00 from the Special Assessment Construc-
tion Fund +25-4470=964=7W to said Kingstone Co. upon delivery by the seller
of a Quit Claim Deed and Construction Easement to said property accompanied
by an Abstract of Title or Owner's Certificate of Title showing good and
marketable title of record to said property, together with an opinion of
the Law Department of the City of St. Louis Park approving the execution
of the deed and the seller's abstract or certificate.
