LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT EXCAVATION AND FILL FOR PROPERTY ZONED C-2 GENERAL COMMERCIAL ZONING DISTRICT LOCATED AT 3400 REPUBLIC AVENUE AND 7015 WALKER STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. The City of St. Louis Park has made application to the City Council for a Conditional Use Permit under Section 36-79(b) of the St. Louis Park Ordinance Code for the purpose of excavation of fill within a C-2 General Commercial Zoning District located at 3400 Republic Avenue and 7015 Walker Street for the legal description as follows, to -wit: See attached legal description. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 17 -10 -CUP) and the effect of the proposed excavation of 2,160 cubic yards of material and proposed import of 500 cubic yards of material on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the excavation of 2,160 cubic yards of material and import of 500 cubic yards of material will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed stormwater system is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 1. The contents of Planning Case File 17 -10 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The Conditional Use Permit to permit export 2,160 cubic yards of material and import 500 cubic yards of material at the location described is granted based on the findings set forth above and subject to the following conditions: 1. Details 1 x. Details 2 xi. Details 3 a. Exhibit B: Truck and Construction Access Haul Routes 2. All required permits shall be obtained prior to starting construction, including but not limited to: a. NPDES Grading/Construction Permit. b. City of St. Louis Park Erosion Control and Building Permits. c. A stormwater management permit from the Minnehaha Creek Watershed District. 3. Stormwater Management: a. The drainage system shall be owned and maintained by the City of St. Louis Park. b. A complete soils report shall be submitted prior to permitting. c. Pond discharge shall be coordinated with the Minnehaha Creek Watershed District. 4. Prior to issuance of an erosion control permit, the developer and contractor shall follow the procedures and requirements for this development for Demolition and New Construction to single-family homes as required under City Code 6-71 Construction Management Plan. In addition to any other remedies, the developer or owner shall pay an administrative fee of $750 per violation of any condition of this approval. Under the Zoning Ordinance Code, this permit shall be revoked and cancelled if the building or structure for which the conditional use permit is granted is removed. Construction shall commence within two years from the date of this permit approval, with the ability to renew the permit annually for a period of up to three (3) years.
