HomeMy WebLinkAbout2607-21 - ADMIN Ordinance - City Council - 2021/03/01Ordinance No. 2607-21 Ordinance regarding outdoor seating in the I-G General Industrial district The City of St. Louis Park does ordain: Whereas, an application was received from Dampfwerk Distillery to amend the I-G General Industrial district to allow outdoor seating as an accessory use, and Whereas, the City Council has considered the advice and recommendation of the planning commission (case no. 20-37-ZA), and Now, therefore be it resolved that the following amendments shall be made to the City Code: Section 1. Chapter 36, Section 36-244(e) of the St. Louis Park City Code is hereby amended to add the following underlined text to the list of land use descriptions. (10) Outdoor seating and service of food and beverages is permitted as an accessory use with the following conditions: a. The use must be separated from any adjacent residential use by a building wall or six- foot fence. This provision will not apply if the residential use is located on an upper story above the principal use. b. If the outdoor seating area is located within 500 feet of a residence, then no speaker or other electronic device which emits sound, or the playing of any band, orchestra, musician or group of musicians, or the use of any device to amplify the music of any band, orchestra, musician or group of musicians, are permitted where the noise or music is plainly audible at the residence above the normal conversation level occurring in the outdoor seating area. c. The hours of operation shall be limited to 7:00 a.m. to 10:00 p.m. if the use is located within 500 feet of a residential use. d. Additional parking will not be required if the outdoor seating area does not exceed 500 square feet or ten percent of the gross floor area of the principal use, whichever is less. Parking will be required at the same rate as the principal use for that port ion of outdoor seating area in excess of 500 square feet or ten percent of the gross building area, whichever is less. Section 2. This ordinance shall take effect March 26, 2021.
