Adjournment MEMORAND UM T o: THROUGH: FROM: DATE: SUBJECT: Economic Development Authority Charles Meyer, Executive Director(©Un, Dave Hagen, Director of Community DevelopmentJ9t/- March 7, 1994 Approval of Fast Food Restaurant Use and Construction Plans - (Addendum to EDA Item 5a) ) In the memo on this subject provided to the EDA last Thursday, staff recommended approval of the fast food restaurant use for the Frauenshuh site and construction plans for it contingent on Frauenshuh Companies agreeing to an amendment to the contract indicating that conveyance of the fast food site not be required until financing evidence has been provided for all the buildings. At the time that memo was written staff was operating on the assumption that financing for all buildings would be secured at the same time and that evidence of such financing would be provided prior to conveyance of the fast food site. On Friday staff became aware that financing is in place for the fast food restaurant and the sit down restaurant only. Staff is somewhat concerned that financing has not yet been secured for the theater/retail building. The posting of a $250,000 letter of credit (which can be drawn upon in the event Frauenshuh defaults on its obligation to construct the remainder of the project) prior to conveyance of the fast food restaurant site is an indication that Frauenshuh Companies is confident that they will be able to perform on the balance of the project. MODIFIED RECOMMENDATION By motion approve the fast food restaurant use for the Frauenshuh site and the construction plans for the fast food restaurant contingent on Frauenshuh Companies agreeing to an amendment to the contract that would not require conveyance of the fast food site until financing evidence satisfactory to the EDA has been provided for the sit down restaurant building. 4853:GEN44 R E QU EST FOR EDA ACTION March 7, 1994 DATE AGENDA SECTION: Reports NO. 5 ORIGINATING DEPARTMENT: Community Development ITEM: NO. 5a APPROVED: Approval of Fast Food Restaurant] fl/ Use and Construction Plans /\}} David Hagen, Director BACKGROUND Attached is a letter from Frauenshuh Companies, Inc. requesting approvals by the EDA of fast food restaurant use of a portion of the site being conveyed to Frauenshuh. Under the agreement with Frauenshuh, the EDA has the right to reject or approve of the fast food restaurant use. Also attached are construction plans for the fast food restaurant which also are subject to EDA approval. The EDA's attorney and staff are concerned that evidence of financing has not yet been provided for any of the buildings. The portion of the site proposed for fast food use is the most accessible and thus most desirable portion. Of particular concern is that the marketability of the portion of the site retained by the EDA would not be as good if the fast food restaurant is in place. O The EDA may approve the fast food restaurant use and construction plans or reject the use and construction plans. If the construction plans are rejected, the EDA is required to specify the basis for rejection. The concern relating to the lack of financing could be addressed by making the approval of the fast food restaurant use and construction plans contingent on Frauenshuh showing evidence of financing for all the buildings. The Authority's obligation to complete any legally required cleanup of releases from such underground tanks shall be subject to Section 3.3 of the Contract It is the intent of the parties to maintain the division of risk and liability for environmental matters that is set forth in Section 3.3 of the Contract and the parties agree that the work to be performed pursuant to this Amendment shall not act to modify or change the provisions of Section 3.3. Background: On February 22, 1994 the EDA awarded a contract to Minger Construction, Inc. (Minger) to prepare the Tower Place site for development by the Frauenshuh Companies (Frauenshuh). During its deliberations, the EDA was advised by staff that it had identified a cost saving option for the EDA - the hauling of excavated material from Tower Place to Wolfe Park and the Oak Park Village soccer field site. Based on information provided, the EDA directed staff to negotiate a contract cost reduction which»reflects contractor savings related to the reduced hauling requirements. Discussion: Staff has completed its negotiations with Minger and has received a $10,000 contract reduction for the contractor savings. Minger has completed its haul to the Wolfe Park site and the material haul to Oak Park Village will be completed soon. In an effort to further reduce EDA costs, EDA staff is conducting negotiations with Minger to provide for the on-site use of a mobile crushing plant. The parties intend to use the plant to crush demolition debris and re-use the material as a granular backfill. Preliminary estimates indicate the EDA may experience an approximate $10,000 contract savings if the parties can successfully complete negotiations regarding hours of operation and noise generation. The two major issues that have emerged out of the process so far are the effect of the severe time constraint on the public input process and the degree to which special assessments will be used to finance the project. T he proposal from DSU that was accepted by the EDA required an abbreviated master plan phase for the entire corridor prior to preparation of final. design plan for the first section of the streetscape improvements in conjunction with the Park Nicollet and ) Frauenshuh projects between Highway 100 and Quentin. Concerns have been raised at the meeting of owners and occupants of properties along and near Excelsior Boulevard as well as by the design review committee that there has not been adequate public input to determine the final streetscape plan for the first section. In response to this concern, only sidewalk and underground wiring for the lighting system will be installed as part of the street project on Excelsior Boulevard, Park Center Boulevard and Park Nicollet Boulevard. According to Park Nicollet and Frauenshuh these are the bare minimum streetscape elements that need to be completed this year. Because of the time constraints in getting these improvements installed, none of their costs may be assessed. In addition, the boulevard trees to be installed by Park Nicollet and Frauenshuh will be installed this year. Concern has been expressed by Park Nicollet and Frauenshuh as to the cost that the City would assess against their projects for the streetscape element. This question has also been raised by other owners and occupants along Excelsior Boulevard. The response to this concern has been that an estimate of the total project costs needs to be developed before we give owners an indication as to how much might be assessed. ST. LOUIS PARK CITY HALL ) A: Introduction to Project Dave Hagen provided a brief history of the City's involvement in Excelsior Boulevard. Geoff Martin presented the scope of the project, defining the phases and schedule. He referred to the attached handouts that were available to attendees on a table at the rear of the Council Chambers. Handouts related to issues and concerns, preliminary goals and objectives, design framework and preliminary work program and schedule. B: Background Analysis Geoff Martin gave a slide presentation which included pictures of the Excelsior Boulevard corridor and also of streetscape projects from other cities. He used these to describe the current image of the corridor and to show some of the possibilities of what improvements may be appropriate. C: Issues and Concerns The following listed on the business owners: issues and concerns in handout were identified addition to those by residents and * Not all persons attending had received a notice of the meeting. There was concern that a better method of providing notice be adopted. * The slides were taken in the summ er and did not reflect the snow storage issues of winter. S ome businesses depend on street parking for their businesses and would be concerned if parking was taken off of Excelsior Boulevard. M any of the Excelsior Boulevard businesses' customers come from outside the immediate area. The businesses cannot rely only on neighboring residential neighborhoods to support their business. T he schedule is too tight and will not allow for reasonable citizen participation. T he consultant identified the portion the north side of the Excelsior Boulevard corridor between Monterey and Quentin Avenue as an entertainment area. There was concern about the conflict between this area and the surrounding residential areas. * The image of "boulevard" and the reality of Excelsior Boulevard are in conflict. The traffic is heavy (20,000 plus trips per day) and fast (35mph speed limit) and not pedestrian friendly. * The surrounding residential areas may not be dense enough to support design concepts that have been used in other cities. * An analysis of pedestrian use including bus ridership is needed. * Corridor needs to have a better image for the businesses. * Business owners are concerned about the cost of the improvements and how that cost will be assessed. * Both resident and business owners need to be on the technical committee. Those who do participate need to have a broad interest and not be only self serving. * The question of who will maintain the corridor will need to be addressed. Most persons agreed that the corridor is in need upgrading. D. Preliminary Goals and Objectives The persons who were present were asked to use adhesive dots to vote for the most important issues and goals that had been previously identified.
