President Sanger called the meeting to order at 7:27 p.m.

The following Commissioners were present at roll call: Jim Brimeyer, Jeff Jacobs, Ron
Latz, Chris Nelson, Sue Santa, Sally Velick, and President Susan Sanger.
Also present were the City Manager (Mr. Meyer); City Attorney (Mr. Scott); Director of
Community Development (Mr. Harmening); City Clerk (Ms. Reichert); and Recording
Secretary (Ms. Samson).
Approval of M inutes

The minutes were approved as presented.
4. Approval of Agenda

It was moved by Commissioner Nelson, seconded by Commissioner Latz, to approve the
agenda.
The motion passed 7-0.
5. Reports
Sa. Vendor Claims
It was moved by Commissioner Santa, seconded by Commissioner Jacobs, to approve
vendor claims.
The motion passed 7-0.

7. New Business
7a. Allegory of Excelsior - Public Artwork
Tom Harmening, Director of Comm unity Development, said passage of this action would
authorize artist Andrea Myklebust to do detailed design work on the public artwork
consistent with what was presented to the Council one week ago. The contract amount is
$26,250, which is just for design services. Mr. Harm ening made a clarification regarding
the contract, see Ownership of Documents, Section 22, Page 10. Section 22 relates to what
the City may do with the design plans and the final finished product, and what rights are
afforded to the artist; it also contains copyright provisions. The City Attorney, Mr. Scott,
had raised questions regarding this artwork to be one-of-a-kind, and the City's use of a
picture of the Allegory of Excelsior in promotional material, e.g., an illustration of it in a
calendar or community handbook. Ms. Myklebust is in agreement with such use.
Ms. Myklebust was present and available for questions from the Commissioners, and she
stated the contract looks fine.
It was moved by Commissioner Brimeyer, seconded by Commissioner Santa, to authorize
the President and Executive Director to enter into a contract with Andrea Myklebust for
detailed design services for the Allegory of Excelsior public artwork in Park Commons
East/Excelsior and Grand.
The motion passed 7-0.
