1. Call to Order
The meeting was called to order at 7:00 p.m. by president Keith
Meland.
2. Roll call
The following commissioners were present at roll call: Jeff
Jacobs, George Haun, Allen Friedman, Lyle Hanks, Larry Mitchell,
Gail Dorfman and Keith Meland.
Also present were the Executive Director (Mr. Meyer),
Attorney (Mr. Steilen), Director of Community Development
Hagen) and Director of Public Works (Mr. Grube).
3. Approval of minutes

It was moved by Commissioner Hanks, seconded by Commissioner
Jacobs, to approve the minutes of the October 18, 1993 EDA
meeting. The motion passed 7-0.
4. Approval of agenda
It was moved by Commissioner Jacobs, seconded by Commissioner
Mitchell, to approve the agenda for November 1, 1993. The motion
passed 7-0.
5. Reports
a. Contract amendment: Traffic study contract with Strgar-Roscoe-
Fausch
It was moved by Commissioner Hanks, seconded by Commissioner
Mitchell, to authorize execution of an amendment to Contract 2-93
with Strgar-Roscoe-Fausch increasing contract amount of $50,460.
Commissioner Dorfman had a concern about the small amount of
money that was incurred at the neighborhood meeting which was out
of the ordinary. She hoped in the future that additional costs
would not be incurred from consultants re neighborhood meetings.
The motion passed 7-0.
Sb. Early access agreement for soil testing
It was moved by Commissioner Mitchell, seconded by Commissioner
Dorfman, to approve the agreement and authorize its execution
subject to EDA attorney approval.

Sc. Temporary easement for Park Nicollet on the Frauenshuh site
It was moved by Commissioner Hanks, seconded by Commission
Jacobs, to approve the temporary easement contingent on the two
conditions contained in staff's report.
The motion passed 6-0.
Sd. Early access agreement: Frauenshuh
It was moved by Commissioner Jacobs, seconded by Commissioner
Haun, to approve the early access agreement and authorize its
execution subject to EDA attorney approval.
The motion passed 7-0.
There was some concern expressed that the EDA attorney had not
had an opportunity to review the agreement. It was the consensus
that EDA attorney approval be secured before items come to the
EDA.
It was moved by Commissioner Hanks, seconded by Commissioner
Mitchell, to reconsider the motion. The motion passed 6-1
(Commissioner Haun opposed).
It was moved by Commissioner Hanks, seconded by Commissioner
Friedman, that the EDA would approve the access agreement and
authorize its execution subject to the EDA attorney's approval.
The motion passed 7-0.
e. Closed meeting - Pending litigation (Wilkins)
Mr. Steilen said there might be a chance a vote will be taken on.
this item.
If there were no new developments, Commissioner Hanks, seconded
by Commissioner Haun, voted not to pursue litigation.
Commissioner Jacobs said he would prefer to talk first with the
attorney in a closed session before casting a vote.
Commissioner Hanks withdrew his motion.
The closed meeting was held at the end of the regular business
meeting.

It was moved by Commissioner Jacobs, seconded by Commissioner
Mitchell, to approve. The motion passed 7-0.
b. Vendor claims
It was moved by Commissioner Jacobs, seconded by Commissioner
Dorfman, to approve the vendor claims and authorize payment. The
motion passed 7-0.
9. Adjournment
It was moved by Commissioner Hanks, seconded by Commissioner
Jacobs, to adjourn the meeting at 7:30 p.m. The motion passed
7-0.
