Ro 11 Ca 11 The fol lowing Commissioners were present at roll cal I: Bruce Battaglia, Torn Duffy, Keith Meland and Lyle Hanks. Also present were the Executive Director, City Attorney and Director of Community Development. Commissioners Allen Friedman, Larry Mitchell and Jane Tschida arrived within ten minutes. 3. Approval of June 5, 1989 minutes ) ) It was moved by Commissioner Hanks, seconded by Commissioner Meland, to approve the June 5, 1989 minutes. The motion passed unanimously. J 5. Approval of June 19, 1989 agenda lt was moved by Commissioner Meland, seconded by Commissioner Battaglia, to approve the agenda for June 19, 1989. The motion passed unanimously. 5. Reports a. Update on status of On the Avenue beautification project - The Executive Director referenced the report froii the consultant and concurred with the recommendation that the seeding be held up until August. No Authority action was required. 6. Unfinished Business None. 7. New Business I <J a. Can-American Realty: Cityscape project - The Executive Director said that at its last meeting, the EDA had scheduled a special meeting for this evening to review the contract for the 156-unit garden apartment project proposed by Can-Am for its Cityscape project . Bryan Weber, representing Can-Am, said he had reviewed the agreement with City staff and all were in agreeinent with the teris as drafted. le 'said from the City's standpoint the project is risk free in that the City is under no ED A m i n u t e s d u n e 19 , 19 8 9 2. obligation to fund a dollar to the project until the project is completed and fully assessed. Commissioner Battaglia asked if there were any thing reflected in the agreement which took into account previous concerns raised by the Authority as regards residential property abutting commercial property and the possibility of odor pollution, i.e. the City's liability in either instance. Mr. Weber said these concerns would fall under the special use permit and as an aside stated McGarvey Coffee was a full supporter of the Cityscape project. He said that attached to each lease agreement would be recognition of McGarvey's being next door and the potential of coffee aroma in the neighborhood. The City Attorney felt the City's liability in such an instance was minimal, at best, and that including a disclaimer in the agreement would be easily accomplished. It was moved by Commissioner Hanks, seconded by Commissioner Meland, to set a public hearing on the Cityscape project for July 10, 1989. The motion passed 7-0. 8. Communications and Bills a.
