HomeMy WebLinkAbout14-160 - ADMIN Resolution - City Council - 2014/11/17• • RESOLUTION NO. 14-160 RESOLUTION AUTHORIZING THE SPECIAL ASSESSMENT FOR THE REPAIR OF THE WATER SERVICE LINE AT 2037 UTAH AVENUE SOUTH, ST. LOUIS PARK, MINNESOTA P.I.D. 07-117-21-11-0022 WHEREAS, the Property Owner at 2037 Utah Avenue South, has petitioned the City of St. Louis Park to authorize a special assessment for the repair of the water service line for the single family residence located at 2037 Utah Avenue South; and WHEREAS, the Property Owner has agreed to waive the right to a public heanng, nght of notice and right of appeal pursuant to Minnesota Statute, Chapter 429; and WHEREAS, the City Council of the City of St. Louis Park has received a report from the Utility Superintendent related to the repair of the water service line. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park, Minnesota, that: 1. The petition from the Property Owner requesting the approval and special assessment for the water service line repair is hereby accepted. 2. The water service line repair that was done in conformance with the plans and specifications approved by the Public Works Division and Department of Inspections is hereby accepted. 3. The total cost for the repair of the water service line is accepted at $4,800.00. 4. The Property Owner has agreed to waive the right to a public hearing, notice and appeal from the special assessment; whether provided by Minnesota Statutes, Chapter 429, or by other statutes, or by ordinance, City Charter, the constitution, or common law. 5. The Property Owner has agreed to pay the City for the total cost of the above improvements through a special assessment over a ten (10) year period at the interest rate of 5.85 %. roperty Owner has executed an agreement with the City and all other documents eces • . ry to implement the repair of the water service line and the special assessment of all costs a.sociated therewith.
