HomeMy WebLinkAbout06-047 - ADMIN Resolution - City Council - 2006/04/25VARIANCE RESOLUTION NO. 06-047 cz y9(20 RESOLUTION OF FINDING REGARDING THE APPLICATION FOR A VARIANCE UNDER SECTION 36-163(F)(8) TO ALLOW AN ADDITION TO THE HOUSE WITH A 7 FOOT 2 INCH SIDE YARD INSTEAD OF THE REQUIRED 9 FEET 10 INCHES FOR PROPERTY LOCATED IN THE R-1 SINGLE FAMILY RESIDENTIAL DISTRICT, AT 2537 INGLEWOOD AVENUE SOUTH BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota FINDINGS 1. On November 22, 2005, John White filed an application seeking a vanance from Section 36-163(0(8) to allow an addition to the house with a 7 foot 2 inch side yard instead of the required 9 feet 10 inches for property located in the R-1 Single Family Residential Distnct for the following legal description, to wit: Lot 6 and South 5 feet of Lot 7, Block 7, Basswood, Hennepin County, Minnesota. 2. On January 5, 2006, the Board of Zoning Appeals held a public hearing, received testimony from the public, and discussed the application for Variance Case No. 05 -68 - VAR. 3. The Board failed to pass a motion granting or denying the vanance due to a 2-2 vote. The variance therefore stands as denied. 4. Mr. John White requested an appeal of Board of Zoning Appeals action. 5. On February 6, 2006 the City Council considered the appeal and the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, nsk to the public safety, the effect on values of property in the surrounding area, and the effect of the proposed variance upon the Comprehensive Plan. ID 6. Based on the testimony, evidence presented, and files and records, the City Council makes the following findings: Reitilutron No. 06-047 -2- a. The requested variance meets the requirements of Section 36-33(d)(5) of the Zoning Ordinance necessary to be met for a variance to be granted. The lot is both narrow and a corner lot, the combination of which makes it difficult to use the property in a reasonable manner. b. The requested addition is in keeping with the housing goals of the City of St. Louis Park, and is a reasonable use of the land. Additions similar in size and function are commonly built throughout St. Louis Park. c. The granting of the variance will not have an adverse impact on neighboring properties, and will not be visible from the public nght-of-ways. 7. The contents of the Board of Zoning Appeals Case File 05 -68 -VAR are hereby entered into and made part of the public hearing record and the record of decision for this case. 8. Under the Zoning Ordinance, this vanance shall be deemed to be abandoned, revoked, or canceled if the holder shall fail to complete the work on or before one year after the variance is granted. 9. Under the Zoning Ordinance, this variance shall be revoked and cancelled if the building or structure for which the vanance is granted is removed. CONCLUSION The applicant's request for a variance from 36-163(0(8) to allow an addition to the house with a 7 foot 2 inch side yard instead of the required 9 feet 10 inches for the above legally descnbed property is hereby approved based on the findings set forth above and with the following conditions: 1. The addition be constructed in accordance with the approved exhibits; and 2. The variance is granted to allow a one-story addition to the home. A second story shall not be constructed over that portion of the home for which the variance was granted. STATE OF MINNESOTA ) COUNTY OF HENNEPIN ) ss CITY OF ST.
