HomeMy WebLinkAbout01-097 - ADMIN Resolution - City Council - 2001/09/04RESOLUTION NO. 01-097 A RESOLUTION AUTHORIZING REPLATTING OF CITY PROPERTY LOCATED BETWEEN THE PLAT OF "MINIKAHDA VISTA 2ND ADDITION, HENNEPIN COUNTY" AND REGISTERED LAND SURVEY NO. 2, AND THE PLAT OF WESTMORELAND PARK WHEREAS, the survey of the land in the proposed plat of PARK COMMONS EAST shows that the land in the plat of "Minikanda Vista 2nd Addition, Hennepin County" and the land in Registered Land Survey No. 2 appears to overlap the land in the plat of Westmoreland Park; and WHEREAS, the title examination relating to the land being platted as PARK COMMONS EAST revealed that the City appears to have an ownership interest in the overlap area, and WHEREAS, it is necessary to clear up all title issues relating to the land being platted as PARK COMMONS EAST, and WHEREAS, the City does not claim an ownership interest in or intend to own any property within the plat of PARK COMMONS EAST, save and except for the property that will be dedicated to the public for public use, including the streets, avenues, boulevards, drives, parkways, lanes, and drainage and utility easements as shown on the plat; and WHEREAS, in order to facilitate the platting of PARK COMMONS EAST and the future sale and development thereof, the St. Louis Park Economic Development Authonty requests that thc City join in the plat of PARK COMMONS EAST and, after the platting thereof, quit claim any interest the City may have in the land in PARK COMMONS EAST save and except for the property that will be dedicated to the public for public use, including the streets, avenues, boulevards, drives, parkways, lanes, and drainage and utility easements as shown on the plat. NOW, THEREFORE, THE ST. LOUIS PARK CITY COUNCIL RESOLVES AS FOLLOWS 1. The City Council hereby authorizes the Mayor and City Manager to execute all documents necessary in the opinion of the City Attorney to join in the final plat of PARK COMMONS EAST with respect to property that the City appears to own within the plat of PARK COMMONS EAST. 2. The City Council hereby authorizes the Mayor and City Clerk to execute all documents necessary in the opinion of the City Attorney to quit claim to the St. Louis Park Economic Development Authority any interest the City may have in any property within the plat of PARK COMMONS EAST, Save and except for the property to be dedicated to the public for public use, including the streets, avenues, boulevards, drives, parkways, lanes, and drainage and utility easements as shown on thc plat Resolution No. 01-097 Reviewed for Administration Attest: v Clerk y -2- Adopted by the City Council September 4, 2001 Nancy Stroth From: Matthew J Foli [Matthew@ck-law com] 'ent: Thursday, August 07, 2003 10'52 AM To: 'nstroth@stlouispark org' Cc: Carole J Hoeft Subject: Resolution 01-097 0210_001 pill Nancy Stroth It does not appear that Resolution 01-097 was ever filed with Hennepin County As a background on this resolution, in the fall of 2001, the developer's surveyor noted that the land to be platted as PARK COMMONS EAST overlapped with property to the north [Registered Land Survey No 2 and the plat of Westmoreland Park] which was owned by the City -- now Wolfe Park This office drafted Resolution 01-097 in anticipation that the City would join in the plat as an' owner of the overlap area and then convey any interest the City had in the PARK COMMONS EAST property to the St Louis Park EDA After the City Council passed Resolution 01-097, the developer's surveyor was able to determine an exact legal description for the overlap area, and the City quit claimed this overlap area to the EDA by a deed dated October 26, 2001 and recorded November 16, 2001 as Abstract Doc. No 7582488 (see attached deed) *dike the other Resolutions used to clear up title issues and filed with ennepin County in the fall of 2001, Resolution 01-097 did not need to be filed because the Deed for the overlap area was the ultimate document that cleared up the title issue The title insurance agent at Old Republic searched the property records and did not find that Resolution 01-097 was ever filed It does not need to be filed at this time This title issue is resolved Please call me if you need additional information Matthew J.
