HomeMy WebLinkAbout98-79 - ADMIN Resolution - City Council - 1998/05/18RESOLUTION NO 98 ' 7 9 Amends Resolutions 89-108 89-36 A RESOLUTION, AMENDING RESOLUTION NO 89-108 ADOPTED ON JULY 31, 1989, AND, GRANTING AN AMENDMENT TO A CONTINUED SPECIAL USE PERMIT UNDER SECTION 14 8-6.4 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A NURSING HOME AND ENCLOSED PEDESTRIAN WALKWAY FOR PROPERTY ZONED RC - MULTIPLE FAMILY RESIDENTIAL AT 3620 PHILLIPS PARKWAY FINDINGS WHEREAS, Sholom Home West, Inc. (Sholom Community Alliance) has made application to the City Council for a special use permit under Section 14 8-6 4 of the St. Louis Park Ordinance Code to allow a nursing home and enclosed pedestrian walkway at 3620 Phillips Parkway within a RC - Multiple Family Residential District having the following legal description - Par 1. Lot 3, Block 1, The Federation Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County Par 2. That part of Lot 2, Block 1 which lies Southerly of the following descnbed line: Commencing at the Northwest corner of said Lot 2; thence on an assumed bearing of South 20 degrees 36 minutes 09 seconds East along the Westerly line of said Lot 2, a distance of 88.00 feet to the point of beginning of the line to be described; thence South 57 degrees 35 minutes 07 seconds East a distance of 144.88 feet, thence South 88 degrees 16 minutes 39 seconds East, a distance of 164.00 feet to the Easterly line of said Lot 2 and there terminating, The Federation Addition according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County (Torrens Certificate No. 736884) WHEREAS, the City Council has considered the information related to Planning Case Nos 89 -5 -SP, 89 -64 -SP and 98 -10 -CUP and the effect of the nursing home and proposed enclosed pedestrian walkway on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan, and WHEREAS, a continued special use permit was issued regarding the subject property pursuant to Resolution No 89-108 of the St. Louis Park City Council dated July 31, 1988 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special use permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 89-108 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Case Files 89 -5 -SP, 89 -64 -SP and 98 -10 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 89-108 filed as Document No. 2031228 is hereby restated and amended by this resolution which continues and amends a special use permit to the subject property for the purposes of permitting a nursing home and enclosed pedestrian walkway within the RC - Multiple Family Residential District at the location described above based on the following conditions: L The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan dated February 21, 1989; Exhibit B - Landscaping Plan dated February 2, 1989; Exhibit C - Exterior Elevations, sheet A 14; and Exhibit D - Exterior, sheet A 16; Exhibit E - Grading, Drainage and Erosion Control Plan; Exhibit F - Utilities Plan. 2. No building permit shall be issued for this project until a noise study satisfactory to the Department of Inspectional Services has been received and approved and that adequate sound proofmg measures be instituted. 3. The applicant shall demonstrate approval by the Department of Transportation of the proposed drainage plan. 4. A survey creating the adjusted lot line shall be filed with the City and shall be approved and recorded before issuance of a building permit. 5. The exterior finish of the building shall be subject to the Architectural Control Ordinance 6. The Utility Plan shall be adjusted to provide adequate fire hydrants spacing. 7. The cul-de-sac shall be enlarged to meet a radius of 55 feet. "s i 8. Additional landscaping shall be provided along Highway 169 which would meet the approval of staff. 9. All improvements on the site shall be completed by March 1, 1991, with the exception of landscaping which shall be completed by May 31, 1991. 10. That exhibits described in condition number 1 be modified as they relate to the one story areas of the ends of the southeast and southwest wings of the proposed structure and as they relate to the stone face on a portion of the building by Exhibit F - Site Plan; Exhibit G - Landscaping Plan; Exhibits H, I, J - Elevations, Exhibit K - Grading, Drainage and Erosion Control Plan; and Exhibit L - Utility Plan, all stamped as printed by KKE Architects and received by Community Development on July 27, 1989. 11 The special use permit shall be amended on May 18, 1998 (Case No. 98 -10 -CUP) to incorporate all of the preceding conditions and to allow construction of an enclosed pedestrian walkway subject to the following conditions - a) Prior to building permit approval, the applicant shall submit revised elevations that conform to Class I exterior material requirements. b) Prior to building permit approval, the applicant shall submit plans for providing satisfactory access to the existing underground utilities and easement, as approved by the Director of Public Works. c) Prior to building permit approval, the applicant shall submit revised project plans and appropriate maintenance and operational agreements for approval by the Public Works and Community Development Directors. d) The addition shall be constructed as per the approved plans and exhibits. e) The property owner shall sign the assent form and exhibits prior to issuance of a building permit.
