A RESOLUTION, AMENDING RESOLUTION NO 88-2 ADOPTED ON JULY 18,
1988 AND, GRANTING AN AMENDMENT TO A CONTINUED SPECIAL USE
PERMIT UNDER SECTION 14.8-6 4 OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO ALLOW A SENIOR CITIZEN APARTMENT
BUILDING CONTAINING 155 UNITS AND AN ENCLOSED PEDESTRIAN
WALKWAY BETWEEN EXISTING BUILDINGS FOR PROPERTY ZONED RC
MULTIPLE FAMILY RESIDENTIAL AT 3630 PHILLIPS PARKWAY
FINDINGS
WHEREAS, Community Housmg and Service Corporation (Sholom Home Alliance) has made
application to the City Council for a special use permit under Section 14 8-6 4 of the St. Louis Park
Ordinance Code to allow a senior citizen apartment building contauung 155 units and an enclosed
pedestrian walkway at 3630 Philips Parkway within a RC - Multiple Family Residential Distnct having
the following legal description:
Lot 4, Blockl, The Federation Addition (Torrens Certificate No 698657)
WHEREAS, the City Council has considered the mformatton related to Planning Case No 87 -7 -
SP, 88 -50 -SP and 98 -10 -CUP and the effect of the 155 unit senior citizen apartment building and proposed
pedestrian walkway on the health, safety, and welfare of the occupants of the surrounding lands, ex.istmg
and anticipated traffic conditions, the effect on values of properties m the surrounding area and the effect of
the use on the Comprehensive Plan; and
WHEREAS, a continued special use perrnit was issued regarding the subject property pursuant to
Resolution No 88-82 of the St. Louis Park City Council dated July 18, 1988 which contained conditions
applicable to said property, and
WHEREAS, due to changed circumstances, amendments to those conditions are now necessary,
requiring the amendment of that special use permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit
granted by Resolution No 88-82 to add the amendments now required, and to consolidate all conditions
applicable to the subject property m this resolution,
WHEREAS, the contents of Planning Case Files 87 -7 -SP, 88 -50 -SP and 98 -10 -CUP are hereby
entered into and made part of the public hearing record and the record of decision for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No 99-82 filed as Document No
1945851 is hereby restated and amended by this resolution which continues and amends a special use
permit to the subject property for the purposes of penmuttmg an enclosed pedestnan walkway and a 155
unit senior citizen apartment building within the RC - Multiple Fanuly Residential District at the location
descnbed above based on the following conditions:
1. That the site be developed, used and maintained in accordance with Exhibit A - Site
Plan; Exhibit B - Landscape Plan; Exhibit C - Grading Plan; Exhibit D - Garage Plan;
Exhibit E - First Floor Plan; Exhibit F - Level Two Floor Plan; Exhibit G - Typical
Floor Plan Three to Eight; Exhibit 11 - Elevation Plan, East and West; Exhibit I
- Elevation Plan, South and North; except as modified on February 11, 1987, and as
modified by the following:
2. The floor plans are for general purposes to identify the number of units, locations
for storage of trash and related matters.
3. That all driveways and roadways be delineated by poured -in-place concrete curb
measuring six inches above and below grade.
4. There shall be no outdoor storage of trash or trash containers.
5. That all rooftop equipment be screened or placed out of view.
6. That the penthouse have exterior materials consistent with the exterior of the building.
7. That restriping of the garage be allowed to permit spaces at least nine feet wide.
8. That minor adjustments be made in the walkways to permit them to be detached from
the edge of the parking lot.
9. That a landscape plan consistent with the provisions of the approved PUD Plan and
consistent with landscaping and shoreland configurations for ponding areas of this
type including preservation of this area be submitted for approval on or before August
1, 1987.
10. That a plan for noise attenuation for the westerly portion of the site be submitted
prior to issuance of a construction permit and said noise attenuation plan must result
in interior spaces meeting the adopted noise ordinance of the City of St. Louis Park.
11. That all improvements including buildings, utilities, parking, landscaping, and other
elements contained in the exhibits be completed by May 15, 1989.
12. That Exhibit B - Landscape Plan is hereby replaced by Exhibit B1 - Revised Landscape
Plan. In addition, the sidewalk designated on the west side of Decatur Avenue may
be constructed on the east side of Decatur Avenue as shown on Extubit B3 - Landscape
Plan Zone VII, except that a minimum 5 -foot boulevard be provided along the entire
length, and provided the applicant and successors and assigns shall have responsibility
for maintenance of the sidewalk.
13 The special use permit shall be amended on May 18, 1998 (Case No 98 -10 -CUP) to incorporate
all of the preceding conditions and to allow construction of an enclosed pedestnan walkway
subject to the following conditions
a) Prior to building permit approval, the applicant shall submit revised elevations that
conform to Class I exterior material requirements
b) Prior to building permit approval, the applicant shall submit plans for providing
satisfactory access to the existing underground utilities and easement, as approved by
the Director of Public Works.
c) Prior to building permit approval, the applicant shall submit revised project plans and
appropriate maintenance and operational agreements for approval by the Public
Works and Community Development Directors.
d) The addition shall be constructed as per the approved plans and exhibits.
e) The property owner shall sign the assent form and exhibits prior to issuance of a
building permit.

FINDINGS
