HomeMy WebLinkAbout98-57 - ADMIN Resolution - City Council - 1998/04/06RESOLUTION NUMBER 98 "° 57 WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with the property owners to acquire permanent and temporary roadway easements, and WHEREAS, pursuant to such negotiations, Willow Creek Plaza Ltd. Partnership, a Minnesota limited partnership and WHIOP Real Estate Limited Partnership, a Delaware Limited Partnership, has indicated their desire to sell said permanent and temporary construction easements, and NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park purchase the following described easements located in Hennepin County, (see attached Exhibit A) Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said easements, and the City Manager is hereby authorized and directed to pay $10,500 to Willow Creek Plaza Ltd. Partnership, a Minnesota limited partnership, and directed to pay $60,400 to WHIOP Real Estate Limited Partnership, a Delaware Limited Partnership upon delivery of recordable documents together with an opinion by the City Attorney of the City of St. Louis Park, approving transfer documents. Temporary Construction Easement Temporary construction easement over that part of Lot 3, Block 8, Shelard Park according to the record plat thereof, which lies northerly of the following described line - Commencing at the intersecting point of curve on the north line of Lot 3 with the northerly city boundary line as point of beginning of the line to be described; thence southeasterly to a point 25 00 feet south of the city northerly boundary line measured from the northerly corner of Lot 3 along the easterly property line and there terminating. Exhibit "B" To Grant of Temporary and Permanent Easement (Legal Description of Permanent Roadway Easement) That part of Lots 2 and 3, Block 8, Shelard Park, according to the recorded plat thereof, which lies southwesterly and northwesterly of the following described line: Commencing at the southeast corner of said Lot 2; thence on an assumed bearing of North 88 degrees 06 minutes 00 seconds West, along the south line of said Lot 2, a distance of 232.42 feet, to the point of beginning of the line to be described; thence Northwesterly, a distance of 28.68 feet, along a tangential curve concave to the northeast having a radius of 20.00 feet and a central angle of 82 degrees 10 minutes 04 seconds, to a point of reverse curvature; thence northerly, a distance of 95.57 feet, along said reverse curve concave to the southwest having a radius of 346.91 feet and a central angle of 15 degrees 47 minutes 05 seconds; thence North 21 degrees 43 minutes 01 seconds West, tangent with the last described curve, a distance of 321 00 feet; thence North 23 degrees 16 minutes 59 seconds East a distance of 33.00 feet; thence north 69 degrees 25 minutes 37 seconds East a distance of 150.85 feet, to a point of curve on the northerly line of said Lot 3 and said line there terminating. 59381 -5-
