HomeMy WebLinkAbout98-179 - ADMIN Resolution - City Council - 1998/12/07r 1 RESOLUTION NO. 98 m 1 79 RESOLUTION AUTHORIZING CONDEMNATION OF PROPERTY FOR TRAIL PURPOSES WHEREAS, the City Council of the City of St. Louis Park does hereby determine that it is necessary and for a public use and purpose to acquire the property described on the attached Exhibit "A" for public trail purposes; and WHEREAS, the City has been unable to acquire the property through negotiation with the landowner; and WHEREAS, the City has determined that a 14 foot wide trail easement and a temporary construction easement at 7500 W. 27th Street is required to accommodate the Hutchinson Spur Regional Trail, and NOW, THEREFORE, be it resolved by the City Council of the City of St Louis Park, Minnesota. 1. That the City Attorney is authorized to commence eminent domain proceedings pursuant to Minnesota Statute Chapter 117 to acquire title to the property described on the attached Exhibit "A" 2. That the City Attorney is authorized to acquire the property interests pursuant to the "quick take" provisions of Minnesota Statute 5117.042 3. That the Mayor and the City Clerk are authorized to execute all documents necessary, in the opinion of the City Attorney, to effect the acquisition of the necessary property interests Reviewed for Administration: City Manager -Deputy Attest: City Clerk Adopted by the,City Council December 7, 1998 CAMPBELL KNUTSON Dec 15.98 15:39 No.002 P.04 A 26 -foot temporary easement for construction purposes over, under, across and through the following described property: That part of the North Half of the Southwest Quarter of Section 8, Township 117, Range 21, Hennepin County, Minnesota formerly being the Great Northern Railway Company Hutchinson, Branch lying southerly of the 82.0 -foot Burlington Northern Railroad right-of-way and westerly of the westerly line and its northerly extension of Lot 4, ASTLEFORD'S PARK, said Hennepin County having a plat distance of 7.17 feet and lying easterly of a line drawn parallel with and distant 1,730 feet easterly, as measured at a right angle, to the center line of Virginia Avenue South, The center line of said temporary easement is described as follows, Beginning at the intersection of said northerly extension of Lot 4 with a line run parallel with and distant 8 0 feet southerly of the southerly right-of-way line of said 82.0 -foot Burlington Northern Railroad right-of-way; thence southwesterly parallel with said southerly right-of-way line 459.15 feet; thence southerly 86.34 feet along a tangential curve concave to the southeast having A radius of 65 62 feet and a central angle of 75 degrees 23 minutes 29 seconds; thence southerly tangent to said curve 7.95 feet, thence southwesterly 40 41 feet along a tangential curve concave to the west having a radius of 49.21 feet and a central angle of 47 degrees 08 minutes 51 seconds, thence southwesterly tangent to said curve 60.27 feet, thence southwesterly 26.08 feet along a tangential curve concave to the northwest having a radius of 328.08 feet and a central angle of 04 degrees 33 minutes 18 seconds, thence southwesterly tangent to said curse 105.32 feet, thence southwesterly 577.12 feet along a tangential curve concave to the northwest having a radius of 1,992 29 feet and a central angle of 16 degrees 35 minutes 50 seconds; thence southwesterly tangent to said curve to the southwesterly line of said property and said center line there terminating Together with a temporary easement for construction purposes over, under, across and through that part of said described property lying southerly of said 26.0 -foot temporary easement and westerly of the east line of Lot 7, Block 1, said ASTLEFORD'S PARK and its northerly prolongation Said temporary easement to expire December 1, 1999.
