A RESOLUTION GRANTING CONDITIONAL USE PERMIT UNDER
SECTION 14 5-4 3(D)(2) OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO PERMIT THE RECONSTRUCTION OF THE
EXISTING SANITARY SEWER LIFT STATION FOR PROPERTY LOCATED
IN THE R-1 SINGLE FAMILY RESIDENCE DISTRICT LOCATED AT 6601
EXCELSIOR BOULEVARD (MEADOWBROOK GOLF COURSE)
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. The City of Minneapolis, acting by and through its Board of Park Commissioners, and the
City of Hopkins have made application to the City Council for a Conditional Use Permit under
Section 14 5-4 3(D)(2) of the St Louis Park Ordinance Code for the purpose of reconstruction
of the existing sanitary sewer lift station within a R-1 Single Family Residence District located at
6601 Excelsior Boulevard (Meadowbrook Golf Course) for the legal description as follows, to-
wit -

2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No 97 -13 -CUP) and the effect of the proposed reconstruction of the
existing sanitary sewer lift station on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of properties
in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance
3. The Council has determined that the reconstruction of the existing sanitary sewer lift station
will not be detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it senously depreciate surrounding
property values, and the proposed reconstruction of the existing sanitary sewer lift station is in
harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive
Plan.
4. The contents of Planning Case File 97 -13 -CUP are hereby entered into and made part of the
public hearing record and the record of decision for this case.
Conclusion
The Conditional Use Permit to permit the reconstruction of the existing sanitary sewer lift
station at the location described is granted based on the findings set forth above and subject to
the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A -
Site Plan and Exhibit B - Elevations, such documents incorporated by reference herein.
2. Assent form and official exhibits must be signed by applicant (or applicant and
owner if applicant is different from owner) prior to issuance of a building permit.

upon that portion of the premises described as followsi The Nortn 10 feet measured at rignt angles to tne South line of Excelsior
Boulevard of that part of the Northeast 1/4 of the Southwest 1/4 of Section 20-117-21 lying South of Excelsior Boulevarc being Lot 21,
St. Louis Park suourbs vacated and the North 10 feet extending from the West boundary to a line 75 feet pest of the center line of
Minnenaha Creek and the North 40 feet extending 75 feet West and 75 feet East of the center lane of 1!innehaha Creek, all measured at
right angles to the South line Excelsior Boulevard of that Fart of the North 1/2 of the Southeast 1/4 of Section 20-117-21 lying South
of Excelsior Boulevard, as created by deed of record in 3ook 1E17 of Deeds, page 455. Also
Subject to an easement until December 31, 1997, in favor of the Village of Hopkins to construct and maintain a sanitary sewer
lift station on that portion of said premises described as followsc Commencing at the intersection of the East line of Section 20-117-21,
and the South rignt of way line of Excelsior Boulevard and continuing alone said South right of way line of Excelsior Boulevard Westerly
for a distance of 360 feet, which shall be called the point of beginning; from said point of beginning continuing airectly Soutn for a
distance of 75 feet; thence airectly West for a distance of 75 feet; thence directly North to the South right of way line of Excelsior
Boulevard; thence Easterly along said South right of way line of Excelsior Boulevara to the point of beginning, as created by instrument
of record in Book 550 Miscellaneous Records, page 332. Also (Torrens)
