HomeMy WebLinkAbout97-144 - ADMIN Resolution - City Council - 1997/11/03RESOLUTION NO. 9 7 s 1 4 4 A RESOLUTION WITH FINDINGS REGARDING THE APPLICATION OF NADER NOORYSHOKRY FOR AN AMENDMENT TO THE ZONING MAP 7100-02 EXCELSIOR BOULEVARD WHEREAS, on August 28, 1997, Nader Nooryshokry filed an application seeking an amendment to the St. Louis Park Zoning Map to change the zoning from R-4, Multiple Family Residence District, to R -C, High Density Multiple Family Residence District, for property located at 7100-02 Excelsior Boulevard; and WHEREAS, on September 3, 1997, the St. Louis Park Planning Commission tabled the request in order to allow more time for the applicant and staff to submit additional evidence; and WHEREAS, on October 8, 1997, the St. Louis Park Planning Commission considered the request and additional evidence, heard testimony and recommended denial of the request on a vote of 4-0-1; and WHEREAS, on November 3, 1997, the City Council held a public hearing, heard testimony and discussed the requested amendment; and WHEREAS, the contents of Community Development Department, Case File No. 97-81- ZA are entered into the public record of decision on this matter. NOW THEREFORE BE IT RESOLVED by the St. Louis Park City Council that the proposed rezoning is denied based on the following findings. 1. The existing R-4 zoning is consistent with adjacent zoning and existing development to the east (Meadowbrook Manor); 2. The existing R-4 zoning is more consistent with Comprehensive Plan policies since it limits non-residential development alternatives for the site while promoting housing development at an appropriate density; 3. The existing R-4 zoning is consistent with the Residential 30 dwelling units per acre comprehensive plan designation that has been approved by the City Council and Metropolitan Council; 4. The proposed R -C zoning would allow certain non-residential uses that are not compatible with the area. 5. The Analysis of Issues in the November 3, 1997 City Council report is hereby incorporated as additional findings. Ado r ed by the City Council November 3, 1997 Mayor ATTEST: C.
