RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF
VICTORIA PONDS 3RD ADDITION
WITH CERTAIN VARIANCES TO THE PLAITING REQUIREMENTS
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. SVK Development, Inc., owners and subdividers of the land proposed to be platted as
Victoria Ponds 3rd Addition have submitted an application for approval of the final plat of said
subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and
all proceedings have been duly had thereunder.
2. The proposed final plat has been found to be m all respects consistent with the City
Plan and the regulations and requirements of the laws of the State of Minnesota and the ordinances of
the City of St. Louis Park.
3. The proposed plat is situated upon the following descnbed lands in Hennepin County,
Minnesota, to -wit:
Outlot C, Victoria Ponds 2nd Addition
Conclusion
1. The proposed final plat of Victoria Ponds 3rd Addition is hereby approved and
accepted by the City as being in accord and conformity with all ordinances, City plans and
regulations of the City of St. Louis Park and the laws of the State of Minnesota, subject to the
following conditions:
A. Approval of the final plat includes approval of certain variances to the
Subdivision Regulations that were in effect at the time of Prelimmary Plat
approval to allow a private street system, undevelopable outlots, and utility
easements less than 12 feet in width in accordance with the following findings:
i. The proposed project will constitute a desirable and
stable community development; and
U. The proposed project will be in harmony with other areas.
B The final plat shall be revised prior to execution and recording to increase the
width of the utility easement to accommodate the storm sewer line on Lot 1,
Block 2,so that the line does not encroach on the buildable portion of the lot.
C. Prior to issuance of any building permits for combustible construction on lots
included in this final plat, fire hydrants determined by the Fire Marshall must
be operational and all-weather Class V road surface shall be installed; said road
shall be maintained for emergency access throughout construction on the
building lots included in the final plat; said road shall extend around all of the
building lots and out to both Rhode Island Avenue via Victoria Way and
Virginia Avenue via Victoria Curve; the base coat of bituminous shall be in
place on said road surface prior to occupancy of any buildings included in this
final plat.
provided, however, that this approval is made subject to the opinion of the City Attorney and
Certification by the City Clerk as provided for in Sections 14-303(3)(d) and (e) of the St. Louis
Park Ordinance Code in effect at the time of Preliminary Plat approval.
2. The City Clerk is hereby directed to supply two certified copies of this
Resolution to the above-named owner and subdivider, who is the applicant herein.
3. The Mayor and City Manager are hereby authorized to execute all contracts
required herein, and the City Clerk is hereby directed to execute the certificate of approval on
behalf of the City Council upon the said plat when all of the conditions set forth in Paragraph
No. 1 above and Section 14-303(3)(e) of the St. Lows Park Ordinance Code in effect at the
time of Preliminary Plat approval have been fulfilled.
4 Such execution of the certificate upon said plat by the City Clerk, as required
under Section 14-303(3)(e) in effect at the time of Preliminary Plat approval, shall be
conclusive showing of proper compliance therewith by the subdivider and City officials
charged with duties above described and shall entitle such plat to be placed on record forthwith
without further formality.
