HomeMy WebLinkAbout97-110 - ADMIN Resolution - City Council - 1997/08/18RESOLUTION NO. 97-110 A RESOLUTION ESTABLISHING A RESIDENTIAL SOLID WASTE . ORGANIZED COLLECTION SYSTEM WITHIN THE CITY OF ST. LOUIS PARK, DESIGNATING SERVICE PROVIDER AND AUTHORIZING CONTRACT WHEREAS, the City followed Minnesota State Statute Section 115A.94 describing an optional process for organizing solid waste collection, which is in addition to its authority to govern solid waste collection granted by other law; and WHEREAS, two weeks' public notice was provided for a public hearing on February 18, 1997 regarding the City's intent to continue organized collection; and WHEREAS, mailed notices of the February 18, 1997 public hearing were sent to persons known by the City to be operating solid waste collection services within the City and Hennepin County; and WHEREAS, on February 18, 1997 the City adopted a resolution of intent to continue to organize residential solid waste collection and invited the participation of interested persons in planning and establishing the continued organized collection system; and WHEREAS, for a 90 -day period following the notice of intent, the City developed plans and proposals for continued organized collection and invited and employed the assistance of persons licensed to operate solid waste collection services within the City and Hennepin County; WHEREAS, on February 14, 1997 the City issued a Request for Qualifications (RFQ) to licensed haulers in Hennepin County and other interested collection service providers for the City's residential garbage, refuse, recycling, and yard waste collection services; and WHEREAS, an Evaluation Committee reviewed and met with each of the five interested providers that submitted a response to the City's RFQ; and WHEREAS, based on evaluation criteria, staff assessment, and meetings with the interested companies, the Evaluation Committee with the approval of the City Council identified the three most qualified providers to respond to the City's Request for Proposals (RFP); and WHEREAS, on May 1, 1997, the City invited these persons to comment on the City's draft Request for Proposals for residential garbage, refuse, recycling, and yard waste collection services; and WHEREAS, on May 13, 1997 the City issued the Request for Proposals for the City's residential garbage, refuse, recycling, and yard waste collection services which included comments and suggestions from the interested persons; and WHEREAS, on July 18, 1997 the City issued a revised Request for Proposals based on discussions and information gathered from interested persons; and WHEREAS, for a 90 -day period following the planning period, the City discussed organized collection arrangements with interested persons and met with these interested persons to discuss possible organized collection arrangements on several occasions; and WHEREAS, the City considered several service delivery options including, but not limited to: no organized system (privatization); separate haulers for separate areas within the City; separate haulers for garbage, refuse and yard waste and for recycling; franchise arrangement; and single contractor for comprehensive services; and WHEREAS, the City considered several options including, but not limited to: carts, commingling and source separating recyclables, additional recycling materials, biodegradable yard waste bags, separate charges for services to residents; and WHEREAS, the City identified organized collection goals as including the following: 1) maximize efficiency in solid waste collection, 2) maintain at least the same level of residential comprehensive collection service levels, 3) provide for reliable collection services at competitive and predictable costs, 4) encourage recycling and refuse abatement; 5) keep costs to the resident reasonable, and 6) keep the community clean and garbage free; and WHEREAS, based on the City's goals and additional considerations of ease of customer service and administration, economies of scale, and least disruption to neighborhoods from collection truck vehicles, the City supports the continued practice of a single contractor for comprehensive services; and WHEREAS, based on the City's goals, the organized collection system developed during the planning and discussion period, and the evaluation of proposals, the City wishes to modify its organized collection services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park, Minnesota, that: 1) The City has determined that its method of organizing residential collection shall be by ordinance and by contract using one collector, 1 f 1 2) The City has designated Waste Management, Inc. as the service provider for residential garbage, refuse, recycling, and yard waste collection services in the City of St. Louis Park subject to the preparation and execution of an acceptable written contract; 3) The Mayor and City Manager are hereby authorized, on behalf of the City Council, to execute a five year agreement with Waste Management, Inc. for residential garbage, refuse, recycling, and yard waste collection services commencing October 1, 1997 in the City in conformance with the general terms and conditions considered by Council; and 4) In the event an acceptable contract cannot be reached in the judgment of the Mayor or City Manager, the City Manager shall return to the City Council for further action and/or direction.
