A RESOLUTION GRANTING CONDITIONAL USE PERMIT UNDER
SECTION 14:4-9 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT THE REMOVAL OF 8,500 CUBIC YARDS OF
SOIL FOR PROPERTY ZONED R-1, SINGLE FAMILY RESIDENCE
DISTRICT LOCATED AT TWIN LAKES PARK
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. The City of St. Louis Park and the St. Louis Park Economic Development Authority have
made application to the City Council for a Conditional Use Permit under Section 14:4-9 of the
St. Louis Park Ordinance Code for the purpose of removing 8,500 cubic yards of soil within a
R-1, Single Family Residence District located at Twin Lakes Park for the legal description as
follows, to -wit:
The South 375.00 feet of the East 450.00 feet of the South One-half of the Northwest
Quarter (S1/2-NW1/4) of Section Thirty-one (31), Township Twenty Nine (29), Range
Twenty Four (24), Westridge (Abstract)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 97 -5 -CUP) and the effect of the proposed removal of 8,500 cubic yards
of soil on the health, safety and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area, the
effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning
Ordinance.
3. The Council has determined that the removal of 8,500 cubic yards of soil will not be
detrimental to the health, safety, or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and
the proposed removal of 8,500 cubic yards of soil is in harmony with the general purpose and
intent of the Zoning Ordinance and the Comprehensive Plan.
4. The contents of Planning Case File 97 -5 -CUP are hereby entered into and made part of the
public hearing record and the record of decision for this case.
Conclusion
The Conditional Use Permit to permit the removal of 8,500 cubic yards of soil at•the location
described is granted based on the findings set forth above and subject to •the following
conditions:
1. Trucks moving between the two sites shall use the routes on Map B, Truck Hauling Route -
Exhibit A.
2. All activity related to the excavation, filling and hauling must be done between the hours of 7
a.m. and 6 p.m. on weekdays and 9 a.m. to 6 p.m. on weekends and holidays.
3. Streets shall be cleaned by the contract hauler as needed to reduce dust and remove chunks of
dirt on the street as a result of the hauling activity.
4. Vegetation shall be restored by seeding grasses immediately following final grading.
5 Temporary erosion control measures shall be utilized as necessary until vegetation is
established.
6. Signs should be posted at both sites indicating the duration of the excavation and filling
activity and warning truck drivers and residents of the construction activity and need for
caution.
7. Assent form and official exhibits must be signed by applicant (or applicant and owner if
applicant is different from owner) prior to issuance of a building permit.
