Resolution Affirming Special Legislation
Limiting the Jurisdiction of Fire Civil Service
WHEREAS, a Management Study of the St. Louis Park Fire Department recommended the addition of
a paid -on-call contingent to assure the long-term viability of fire protection services in the City, and
WHEREAS, the City Council approved the addition of a paid -on-call supplement and directed the
manager to begin implementation of the program, and
WHEREAS, the Fire Civil Service Commission affirmed that the scope of its Rules and Regulations
apply only to sworn firefighting positions of full-time status, and
WHEREAS, the Fire Civil Service Commission resolved to limit its purview to those employees of the
department who are of a sworn position of full-time status, and
WHEREAS, the Governor and the Legislature of the State of Minnesota have approved special
legislation that excludes volunteer and paid -on-call firefighters, who are employees of the Fire
Department, from Civil Service.
NOW, THEREFORE, BE IT RESOLVED by the St. Louis Park City Council that:
1) The St. Louis Park City Council affirms Laws 1996, chapter 447, article 2, section 4, approved
by the Governor and Legislature of the State of Minnesota, which excludes volunteer and paid -
on -call firefighters, who are employed by the St. Louis Park Fire Department, from Civil Service,
and
2) The City Clerk, as the Chief Clerical Officer of the City of St. Louis Park, is hereby authorized to
file with the Secretary of State a certificate stating the essential facts necessary to validate
approval, including a copy of this resolution of approval, and
3) Volunteer and paid -on-call firefighters of the St. Louis Park Fire Department are subject to the
terms and conditions of employment as described by the City's Personnel Ordinance.
