HomeMy WebLinkAbout96-56 - ADMIN Resolution - City Council - 1996/04/15RESOLUTION NO. 96-56 RESOLUTION RELATING TO PROPOSED SPECIAL SERVICE DISTRICT AND IMPOSITION OF A SERVICE CHARGE, CALLING A PUBLIC HEARING BE IT RESOLVED by the City Council (the "City Council") of the City of St. Louis Park, Minnesota (the "City"), as follows: Section 1. Recitals: Findings. 1.01 The City Council has the power to create a special service district Act of June 5. 1985, ch. 302 Minn. Laws 1448 (authorizing establishment of special service district). 1.02 The City has received a petition to establish a special service district pursuant to Minnesota Statutes, Section 428A.02 from the owners of certain property Located within an area approximately bounded on the south by Excelsior Boulevard, on the north by 36th Street, on the west by Highway 100 and on the east by Naches Avenue South (the "Service District"). The specific properties included within the Service District are identified on Exhibit A attached hereto and are generally depicted on Exhibit B attached hereto. Each property so identified includes the right-of-way adjacent thereto. 1.03 The City has also received a petition proposing that a service charge be imposed within the proposed Service District. 1.04 The City Council has determined each of the following: (a) the owners of at least 25 percent or more of the land area within the proposed Service District have signed the petitions; (b) the owners of at least 25 percent more of the net tax capacity of the land within the proposed Service District` have signed the petitions; (c) only owners of property located within the proposed Service District have signed the petitions; and (d) only owners of property classified under Minnesota Statutes, Sec. 273.13 as commercial, industrial or public utility purposes, or that is vacant land zoned or designated on a land use plan for commercial, industrial or public utility purposes, have signed the petitions. Section 2. Public Hearing. 2.01 The City will conduct, and there is hereby called, a public hearing on the proposal stated in the aforementioned petitions to establish the proposed Service District and impose a service charge on the 211tb day of May 1996 at 7:30 o'clock p.m. at the Council Chambers of the City Hall, 5005 Minnetonka Boulevard in the City. 2.02 The actions of the City Clerk of the City causing a public notice, substantially in the form of the notice attached hereto as Exhibit C, to be published in the official newspaper of the City and a newspaper of general circulation in each of the locations of the Project and all activities undertaken in furtherance thereof prior to the date of this Resolution are hereby authorized, ratified, confirmed and approved. Section 3. Effective Date. 3.01 This resolution shall become effective immediately upon its passage and without publication. Adopted this hday of Apri 1 , 1996. The hearing will be held at Council Chambers of the City Hall, 5005 Minnetonka Boulevard, in said City on Monday,May 20 , 1996 at approximately 7:30 o'clock p.m. The petition requirements of Minn. Stat., Sec 428A.08 have been satisfied. Attached hereto as Exhibit B is the estimated cost of any improvement to be paid for in whole or in pan by the Service Charge, if any, the estimated cost of operating and maintaining the improvements during the first year and upon completion of the improvements, the proposed method and source of financing the improvements, and the annual cost of operating and maintaining the improvements. Attached hereto as Exhibit C is a statement of the proposed rate or amount of the proposed Service Charge to be imposed in the Service District during the 1996 and 1997 calendar year and the nature and character of the special services to be rendered in the Service District during the calendar year in which the Service Charge is to be collected. The proposed Service Charge is a multi-year charge. The Service Charge will remain in effect through and including the year 2006 for taxes payable in said year. With respect to improvements to be constructed within the Service District, operating services and maintenance services, the maximum Service Charge to be imposed in 1996 and 1997 arc set forth on Exhibit C. Each year thereafter, the Service Charge will increase or decrease from the maximum amount authorized in the preceding year based upon changes in the Consumer Price Yndex (All Items) for the Minneapolis/St. Paul Metropolitan Area, published by the United States Department of Labor, Bureau of Labor Statistics. Such increase or decrease shall not exceed five percent (5%) per year. At the above -referenced public hearing, the City shall give all parties who appear an opportunity to express their views with respect to the proposed Service District and Service Charge. Interested persons may also submit written comments to the undersigned City Clerk prior w the date of such hearing. A draft eopy of the proposed urUinam:0 t.rvuting the Service District and the proposed resolution imposing the Service Charge shall be available for public inspection, following publication of this Notice, in the administrative offices of the City in the City Hall, 5005 Minnetonka Boulevard in the City, Monday through Friday, except legal holidays, from 8:00 a.m. to 4:30 p.m. to and including the date of hearing.
