RESOLUTION NO. 96-184
RESOLUTION AUTHORIZING THE ACQUISITION OF
CERTAIN PROPERTIES BY PURCHASE OR EMINENT DOMAIN
WHEREAS, the City of St. Louis Park, (the "City") is charged with the responsibility of providing
public right-of-way for citizens within its boundaries; and
WHEREAS, The City has determined that improving by widening that portion of Excelsior Boulevard
located between France Avenue South and Monterey Drive is required to serve the transportation needs of its
citizens; and
WHEREAS, to accomplish the improving and widening of said portion of Excelsior Boulevard, it is
necessary to acquire temporary and permanent real property rights, title and interests from the parcels described
on Exhibit "A" attached hereto (the "Property").
NOW, THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park:
1. That the recitals set forth above are found to be true and incorporated in the body of this resolution as if
fully set forth herein.
11) 2. That the City finds that it is necessary to improve and widen the portion of Excelsior Boulevard located
between France Avenue South and Monterey Drive.
3. That the City and its staff agents and attorneys for the City are authorized to negotiate for the acquisition
of the necessary right-of-way and easements both prior to commencing and throughout the eminent
domain proceeding.
4. That in consultation with City staff the attorneys for the City are directed to initiate quick -take eminent
domain proceedings pursuant to Minnesota Statute Chapter 117 to acquire the right-of-way and
easements deemed necessary by the City Engineer to permit the City to improve and widen the portion of
Excelsior Boulevard between France Avenue South and Monterey Drive to complete the Excelsior
Boulevard Streetscape Project No. 96-22.
