HomeMy WebLinkAbout96-138 - ADMIN Resolution - City Council - 1996/09/03RESOLUTION NO. 96-138 RESOLUTION FOR RECONVEYANCE OF PROPERTY TO STATE OF MINNESOTA 2621 VIRGINIA AVENUE SOUTH WHEREAS, the City of St. Louis Park has received a request to conduct a study of public need for property at 2621 Virginia Avenue South, and WHEREAS, the City of St. Louis Park acquired a tax deed for this property on May 12, 1961 for street purposes; and WHEREAS, the State of Minnesota requires that the tax deed be returned to the State so the property can be sold at public auction if the City fails to use the property for the public purpose stated or if public use is abandoned, and WHEREAS, the City Council has determined that the public use has been abandoned; and WHEREAS, the City Council has determined there is no existing or future public need for the property; and WHEREAS, the City Council has found that said property is fully served by public utilities including water and sanitary sewer; and WHEREAS, the City Council has found that said property is a buildable lot as is determined by St. Louis Park Zoning Ordinances; and WHEREAS, the City Council has found that said property does not contain any wetlands as defined on the National Wetland Inventory; and WHEREAS, the City Council has found that said property is not located within any flood plain, flood fringe or flood way as determined by Federal Emergency Management Agency, Flood Insurance Rate Map, Community -Panel Number 270184 0005 B; and WHEREAS, the City Council has found that said property does not contain or border upon any protected water, and WHEREAS, the City Council has found a need for a 15 foot wide easement bordering Virginia Avenue on the west side of the property for future street improvements. NOW THEREFORE BE IT RESOLVED that, pursuant to Minnesota Statutes Section 282.01 Subdivision 1, the City Council reconvey the property described below back to the State of Minnesota for public auction and request a 15 foot wide easement bordering Virginia Avenue on the west side of the property be conveyed to the City: Property ID # 07-117-21-41-0001 Commencing on the North line of South One-half of Northeast Quarter (S1/2 NE1/4) of Southeast Quarter (SE1/4) at a point 646 7/10 feet West of Northeast (NE) corner of said South One-half of Northeast Quarter of Southeast Quarter (S1/2 NE1/4 SE1/4), thence South 126 feet to right-of-way of the St. P M. and M. Ry; thence Northeasterly along same to the North line of South One-half of Northeast Quarter of Southeast Quarter (S1/2 NE1/4 SE1/4) thence West to beginning, Section Seven (7), Township One Hundred Seventeen (117), Range Twenty-one (21).
