LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE REPLACEMENT OF AN EXISTING LIFT STATION WITH A NEW LIFT STATION FOR PROPERTY ZONED R1 SINGLE FAMILY RESIDENCE DISTRICT LOCATED AT 6601 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. The City of Hopkins and the City of Minneapolis, acting by and through its Board of Park Commissioners, (Meadowbrook Golf Course) have made application to the City Council for a Conditional Use Permit under Section 14:5-4.2(D)(3) of the St. Louis Park Ordinance Code for the purpose of replacing an existing lift station with a new lift station within a R1 Single Family Residence District located at 6601 Excelsior Boulevard for the legal description as follows, to - wit: See Attached Legal Description 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 96 -17 -CUP) and the effect of the proposed lift station on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the lift station will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed lift station is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 96 -17 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The Conditional Use Permit to permit the replacement of an existing lift station with a new lift station at the location described is granted based on the findings set forth above and subject to the following conditions: Neadoebrook Golf Course. The site shall be developed, used and maintained in accordance with Exhibit A - Forcemain Rehabilitation Site Plan, Exhibit B - Gravity Sewer and Lift Station Site Plan, Exhibit C - Driveway and Landscape Plan, Exhibit D - Building and Floor Plan, and Exhibit E - Footing and Foundation Plan (such documents incorporated by reference herein) which are modified according to the following conditions of approval: a. A minimum of 60% of the north, west and east sides of the lift station are to be built of Class I materials: stucco and glass (Exhibit D). b. The size of the sign located on the north side of the structure will be no larger than two square feet in size, as shown on Exhibit D. c. Compliance with the conditions as set forth in Attachment No. 1 as submitted by the Minneapolis Department of Parks and Recreation. The conditions of which guarantee certain landscaping requirements and color scheme of the structure itself d. Bufferyard C requirements will be utilized wherever the lift station easement of the Meadowbrook Golf Course property abuts Excelsior Boulevard.
