A RESOLUTION APPROVING A PRELIMINARY PLANNED UNIT DEVELOPMENT
(PUD) UNDER SECTION 14:6-7 OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING FOR PROPERTY ZONED
"RC" HIGH DENSITY MULTIPLE RESIDENCE DISTRICT,
LOCATED AT 3601 PARK CENTER BOULEVARD
WHEREAS, notice of a public hearing on the Preliminary PUD was mailed to all owners
of property within 350 feet of the subject property, and
WHEREAS, notice of public hearing on the Preliminary PUD was published in the St.
Louis Park Sailor on June 19, 1996, and
WHEREAS, notice was received from the applicant, G & P Properties, Inc., on June 28,
1996, requesting that the public hearing scheduled for July 3, 1996 be rescheduled for July 17,
1996 to allow time to resolve outstanding issues and submit a complete application, and
WHEREAS, notice of a change in the meeting date of the public hearing was mailed to all
owners of property within 350 feet of the subject property and posted at City Hall, at 5005
Minnetonka Boulevard, and
WHEREAS, the Planning Commission opened the public hearing and took testimony at
the meeting of July 17, 1996, and
WHEREAS, a complete application for approval of a Preliminary PUD was received on
July 8, 1996, and
WHEREAS, the Planning Commission recommended approval of the Preliminary PUD
subject to 11 conditions of approval on a 6-0 vote with all members present voting in the
affirmative, and
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. G & P Properties, Inc. and Stewardship' Properties in have made application to the City
Council for approval of a Preliminary Planned Unit Development approval under Section 14.6-7
of the St. Louis Park Ordinance Code within an "RC" High Density Multiple Family Residence
District located at 3601 Park Center Boulevard for the legal description as follows, to -wit:
Lot 1 and the north 71 00 feet of Lot 2, Block 2, Park Center, St. Louis Park, Minnesota
2. The City Council has considered the advice and recommendation of the Planning Commission
(Case No. 96 -16 -PUD) and the effect of the proposed Preliminary PUD on the health, safety and
welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area, the effect of the use on the Comprehensive
Plan, and compliance' with the provisions of the Zoning Ordinance.
3. The City Council has determined that approval of a Preliminary PUD will not be detrimental to
the health, safety, or general welfare of the community. The Council has also determined that the
proposed Preliminary PUD is in harmony with the general provisions, purpose and intent of the
Zoning Ordinance and the Comprehensive Plan and that the requested modifications comply with
the requirements of Section 14:6-7.2(E).
4. The contents of Planning Case File 96 -16 -PUD are hereby entered into and made part of the
public hearing record and the record of decision for this case.
Conclusion
1. A Preliminary Planned Unit Development at the location described in paragraph 1 of the
above findings and in accordance with Exhibit A - Site Plan, Exhibit B - Grading,
Drainage & Utility Concept Plan and Exhibit C - Elevations is approved based on the
findings set forth above and subject to the following conditions:
a. The City Council hereby determines that an EAW for this phase is not necessary
based on the finding that no significant environmental effects are anticipated;
however, an EAW will be required for any future phases, unless an EAW or EIS
has already been prepared for a larger development concept that incorporates this
project.
b. Approval of this Preliminary PUD does not grant any concept approval for future
phases of development involving the property;
c. Recording of the administrative subdivision and vacation of the existing drainage
and utility easement along the south property line;
d. Termination of the drive thru bank lease, once the current terms expire.
e. Compliance with Building Code and Fire Marshal criteria;
f. Compliance with other City, Watershed District, and state/federal agency
requirements;
g. Prior to Final PUD consideration, the applicant shall apply for an amendment to
. the Continued Special Permit for the Parkshore apartment property to address site
design changes that are being requested for that property; such amendment shall
include dedication of a trail easement to the City and requirement that developer
installs the proposed trail pursuant to City specifications;
h. Final PUD application plans shall include public art and/or additional landscaping
along the trail and park property to compensate for deficiencies to internal parking
lot landscaping and bufferyard requirements;
i. Final PUD application plans shall include details of all proposed building and
fencing materials, including proposed colors of materials; building materials shall
exceed Class I material standards and shall not include use of any vinyl siding;
j. Execution of a development agreement prior to issuance of any building permits;
k. Execution of joint parking and access agreements between the office/bank
property, Assisted Living property and Parkshore Apartment building property
prior to issuance of any building permits.
2. The following modifications to ordinance requirements are granted as part of the
Preliminary PUD approval subject to the conditions in paragraph 1 of this conclusion
which are intended to integrate the effects of the modifications:
a. The minimum lot width of the proposed Assisted Living property at the minimum
required front yard setback may be reduced from 80 feet to 40 feet.
b. The minimum lot area per unit for the proposed Assisted Living property may be
reduced from 900 square feet to 884 square feet.
c. A bufferyard shall not be required between the temporary drive thru bank use and
the proposed Assisted Living facility.
d. Internal parking lot landscaping requirements may be reduced.
