A RESOLUTION GRANTING CONDITIONAL USE PERMIT UNDER
SECTIONS 14:5-4.9(A) AND 14:5-4.3(D))1) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO PERMIT THE
PLACEMENT OF 3,000 CUBIC YARDS OF FILL AND THE
CONSTRUCTION OF 5 CLUSTER HOUSING UNITS FOR PROPERTY
ZONED FF FLOOD FRINGE AND R-2 SINGLE FAMILY RESIDENCE
DISTRICTS LOCATED AT 1400 PENNSYLVANIA AVENUE SOUTH
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Karen Melvin (Park Land Company) has made application to the City
Council for a Conditional Use Permit under Sections 14:5-4.9(A) and 14:5-4.3(D)(1) of the
St. Louis Park Ordinance Code for the purpose of the placement of 3,000 cubic yards of fill
and the construction of 5 cluster housing units within FF Flood Fringe and R-2 Single
Family Residence Districts located at 1400 Pennsylvania Avenue South for the legal
description as follows, to -wit:

2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 95 -19 -CUP) and the effect of the proposed fill and cluster
housing on the health, safety and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance.
3. The Council has determined that the fill and construction of cluster housing
will not be detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, ,and the proposed fill and duster housing is in harmony with the general
purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
4. The contents of Planning Case File 95 -19 -CUP are hereby entered into and
made part of the public hearing record and the record of decision for this case.
Conclusion
The Conditional Use Permit to permit the placement of 3,000 cubic yards of fill and
construction of 5 cluster housing units at the location described is granted based on the
findings set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
Plan, Exhibit B - Landscape Plan, Exhibit C - Elevation Plan, and Exhibit D - Floor
Plan; such documents incorporated by reference herein.
2. The Conditional Use Permit shall be contingent upon filing of the final plat with
Registrar of Titles at Hennepin County.
3. A permit shall be received from the Minnehaha Creek Watershed District which
addresses flood plain modification and water quality.
4. The bituminous parking lot shall be modified to assure that the drainage goes to the
center and to the south away from the neighboring property.
5. Truck routes shall be along the South Frontage Road of I-394 and Pennsylvania
Avenue.
6. The following be provided prior to any fill operations:
a. An analysis of fill materials being used
b. An erosion control plan
c. A statement outlining period of time for reclamation operation
7. All affected streets shall be cleaned each day of the hauling operation.
8. A minimum four foot wide sidewalk shall be provided on the south side of 14th Street
for the future need of the residents of the project in conformance with the design
standards of the City.
9. All improvements shall be completed by May 15, 1996.

EXHIBIT A -- LEGAL DESCRIPTION
Beginning on the East line of the Northwest Quarter of the Southwest Quarter in Section 5, Township 117, Range 21.
850 feet South of the Northeast corner thereof, thence West along the South line of 14th Street as shown in the plat of Turf and
Paddock, 209.8 feet to the Northeast corner of Lot 21, Turf and Paddock, Hennepin County, Minnesota, thence South along the East
Zine of said Lot 21, to the Southeast corner thereof distant 210 feet, thence East parallel with the North line of said
Northwest Quarter of the Southwest Quarter to the East line thereof, thence North along the East line thereof to the South line
of 14th Street, being to the point of beginning.
