LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT PLACEMENT OF FILL TOTALING 2,150 CUBIC YARDS FOR PROPERTY ZONED R1 SINGLE FAMILY RESIDENCE AND FF FLOOD FRINGE DISTRICTS LOCATED AT 2501 HIGHWAY 100 SOUTH. BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Benilde-St. Margaret's High School has made application to the City Council for a Conditional Use Permit under Section 14:4-9(A) of the St. Louis Park Ordinance Code for the purpose of permitting the placement of fill totaling 2,150 cubic yards within a R1, Single Family Residence District and FF, Floodfringe District located at 2501 Highway 100 South for the legal description as follows, to -wit: EXHIBIT A - LEGAL DESCRIPTION 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No.95-42-CUP) and the effect of the proposed placement of fill on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the placement of fill will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed placement of fill is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 95 -42 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The Conditional Use Permit to permit the placement of fill totaling over 400 cubic yards at the location described is granted based on the findings set forth above and subject to the following conditions: 1. An erosion control plan acceptable to City staff is received and an erosion control permit granted prior to any filling activities. 2. The finished berm shall be stabilized with sod within 15 days of achieving final grade in accordance with requirements of the Zoning Ordinance. 3. That fill be placed according to Exhibit A, Grading Plan. 4. The hauling route shall be West 26th Street from the source site. 5. Streets shall be cleaned each day there is hauling activity. 6. Dust shall be kept to a minimum by means of regular watering or other means acceptable to the City. 6. Hauling operations shall be conducted on Mondays through Thursdays between 7:00 a.m. and 9:00 p.m. and on Fridays between 7:00 a.m. and 5:00 p.m. 7. The fill operation shall be completed by June 1, 1996. From the point of beginning of line 1 described above, run Southeasterly ac right angles with said line 1 Lor 71 feet to the point of beginning of the line to be described; thence deflect to the right at an angle of 90 degrees 00 minutes for 57.46 feet; thence deflect to the left on an 11 degrees 00 minutes curve (Delta Angle 22 degrees 34 minutes 06 seconds) for 205.17 feet; thence on tangent to said curve for 41.94 feet; thence deflect to the right on a 25 degrees 00 minutes curve (Delta Angle 39 degrees 35 minutes 12 seconds) for 158.35 feet; thence on tangent to said curve for 35.17 feet; thence deflect to the left on an 11 degree 00 minutes,curve (Delta Angle 25 degrees 16 minutes 06 seconds) for 229.71 feet; thence on tangent to said curve for 100 feet and there terminating.
