RESOLUTION GIVING APPROVAL FOR PRELIMINARY PLAT OF
LAMPLIGHTER PARK TOWNHOMES
WITH FRONT YARDVARIANCE
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Karen Melvin and Park Land Company owners and subdividers of the land
proposed to be platted as Lamplighter Park Townhomes have submitted an application for
approval of preliminary plat of said subdivision in the manner required for platting of land
under the St. Louis Park Ordinance Code, and all proceedings have been duly had
thereunder.
2. The proposed preliminary plat has been found to be in all respects consistent with
the City Plan and the regulations and requirements of the laws of the State of Minnesota
and the ordinances of the City of St. Louis Park, subject to the exception set forth herein.
3. Park dedication is not a requirement of the preliminary plat because the
Comprehensive Plan does not designate any part of the property as park or open space.
4. The proposed plat is situated upon the following described lands in Hennepin
County, Minnesota, to -wit:
That part of the Northwest 1/4 of the Southwest 1/4 of Section 5, Township
117, Range 21, Hennepin County Minnesota described as follows:
Commencing at Northeast corner of Lot 21 Turf & Paddock Addition, thence
South to the Southeast corner; thence east 209.8 feet to the East line of the
Northwest one quarter of the Southwest one quarter; thence North 210.00
feet to the South line of 14th Street; thence West 209.8 feet to the point of
beginning, Section 5, Township 117, Range 21.
5. A variance to reduce the front yard depth from 30 feet to 10 feet has been
requested by the applicant.
a. The variance is required to address the special circumstances or conditions
affecting the subject property such that the strict application of the provisions
of the Zoning Ordinance would deprive a reasonable use of the applicant's
land.
b. The variance is necessary for the preservation and enjoyment of a substantial
property right.

c. The granting of the variance will not be detrimental to the public welfare or
injurious to other property in the territory in which said property is situated.
6. The contents of Planning Case File 95-18-S are hereby entered into and made
part of the public hearing record and the record of decision for this case.
Conclusion
1. The proposed preliminary plat of Lamplighter Park Townhomes is hereby
approved and accepted by the City as being in accord and conformity with all ordinances,
City plans and regulations of the City of St. Louis Park and the laws of the State of
Minnesota, subject to the following conditions:
A. A permit shall be obtained from Minnehaha Creek Watershed District for
flood plain modification.
B. The utility easement requested by Northern States Power shall be shown on
the final plat or be granted by the applicant.
C. A covenant or homeowners association agreement be provided which
determines the ownership of Block 6 and establishes cross easements for the
proposed driveway and sidewalks in such form that is approved by the City
Attorney.
D. That a variance is granted to reduce the front yard depth from the required 30
feet to 10 feet.
E. That a sidewalk be provided on the west side of Pennsylvania Avenue in
conformance with the design standards of the Subdivision Ordinance and
Americans with Disabilities Act.
