RESOLUTION NO. 95-51
A RESOLUTION RESCINDING RESOLUTION NO. 7397 ADOPTED ON
JUNE 6, 1983, AND AMENDING A CONTINUED SPECIAL PERMIT
UNDER SECTION 14:8-6.4 OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO ALLOW THE ADDITION OF A PHYSICAL
THERAPY ROOM FOR PROPERTY ZONED R-4 MULTIPLE FAMILY
RESIDENCE DISTRICT LOCATED AT 4415 WEST 36 1/2 STREET
FINDINGS
WHEREAS, Unicare Homes (Park Nursing Home) has made application to the City
Council to amend a continued special permit under Section 14:8-6.4 of the St. Louis Park •
Ordinance Code to permit the addition of a physical therapy room at 4415 West 36 1/2
Street within a R-4 Multiple Family Residence District having the following legal
description:
Lot 2
All that part of Lots 34 and 35 lying North of a line drawn Westerly at right
angles to the East line of said Lot 35, at a point 350 feet South of the
Northeast corner of said Lot 35,
Block 2, Minikanda Vista Second Addition Hennepin County
(Torrens Certificate No. 649040)
WHEREAS, the City Council has considered the information related to Planning
Case No. 95 -11 -CUP and the effect of the proposed addition of a physical therapy room on
the health, safety, and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area and
the effect of the use on the Comprehensive Plan; and
WHEREAS, a special use permit was issued regarding the subject property
pursuant to Resolution No. 7397 of the St. Louis Park City Council dated June 6, 1983 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special use permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 7397 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Case File 95 -11 -CUP are hereby entered into
and made part of the public hearing record and the record of decision for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 7397 filed as Document
(document not filed) is hereby rescinded and replaced by this resolution which continues
and amends a continued special use permit to the subject property for the purposes of
permitting the addition of a physical therapy room within the R-4 Multiple Family
Residence District at the location described above based on the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
Plan -Landscape Plan as modified by Exhibit A-2, Certificate of Survey dated March 3,
1983 by Ron Krueger and Associates, Inc.; Exhibit B, Elevation Plan; Exhibit B-1,
Elevation; Exhibit C, First Floor Plan; Exhibit C-1, Office Floor Plan; Exhibit D,
Second Floor Plan; Exhibit E, Room Detail; and Exhibit G, Trash Enclosure dated
September 7, 1982, except as modified by the following conditions: (Exhibits on file at
City Hall)
a) All existing landscape features 'including trees, grass areas, shrubbery,
benches and the like shall be retained.
b) The detached office structure shall be used only for administrative activities
associated with the Park Nursing and Convalescent Center, Inc. Tenancy by
other businesses or activities shall be prohibited.
c) The garage on the west end of the property described as Lot 2, Block 2,
Minikanda Vista Second Addition shall be used for maintenance and storage
purposes and only in conjunction with the operation of Park Nursing and
Convalescent Center, Inc.
d) No signage shall be allowed on the property frontage on Kipling Avenue.
e) Lot 2, Block 2, Minikanda Vista Second Addition shall be combined with the
nursing home parcel by August 1, 1983. No certificate of occupancy shall be
issued for the office structure until evidence of recording of the lot
combination is presented to Inspectional Services.
2. The continued special permit shall be amended pursuant to Planning Case No. 95 -11 -
CUP to permit the addition of a physical therapy room with the following conditions:
a. The site shall be developed, used and maintained in accordance with Exhibit
H - Site Plan and Exhibit I - Elevation Plan, and Exhibit J - Landscape Plan;
such documents incorporated by reference herein.
b. All improvements shall be completed by April 17, 1996
