HomeMy WebLinkAbout95-174 - ADMIN Resolution - City Council - 1995/12/18RESOLUTION NO 95-174 A RESOLUTION ACCEPTING A DONATION OF PRIVATE PROPERTY FOR PUBLIC USE FROM RICHARD NESLUND AND CHEYENNE LAND COMPANY. 9201, 9212 AND 9224 FREDERICK AVENUE WHEREAS, there has been official notification that Cheyenne Land Company and Richard Neslund (collectively referred to hereinafter as "the Owners") have offered to donate to the City of St. Louis Park (referred to hereinafter as "the City") fourteen Frederick Avenue lots in the J F Lyons 4th addition, to be made available for use at the City's discretion, and WHEREAS, the fourteen aforementioned lots comprise three separate parcels (referred to hereinafter as "the three parcels"), including 9201 Frederick Avenue (PID 18 117 21 22 0122); 9212 Frederick Ave (PID 18 117 21 22 0140), and 9224 Frederick Avenue (PID 18 117 21 22 0116), and WHEREAS, the Owners have made property tax payments on all three parcels which are current through 1995, and WHEREAS, the Owners require that this transaction be completed prior to December 31, 1995 with the understanding that the City would be required to pay property taxes which become due and payable in 1996, and WHEREAS, the Owners agree to transfer title for these three parcels to the City with no restrictive covenants or other encumbrances, notwithstanding the property taxes previously identified herein, and WHEREAS, the City believes that the three parcels to be donated are currently vacant, have not been built upon phd have not been the subject of any study, review or assessment which has indicated site contamination or any er issue of environmental concern NOW THEREFORE BE IT RESOLVED by the City Council that the City of St Louis Park hereby accepts the donation of fourteen Frederick Avenue lots in the J F Lyons 4th addition, currently under the ownership of Cheyenne Lane Company and Richard Neslund, to be used in any manner deemed to benefit the residents of St Louis Park, and BE IT FURTHER RESOLVED that pnor to December 31, 1995, the Mayor, City Manager and City Attorney are hereby directed to proceed in the preparation and execution of documents necessary to accept this donation, subject to completion of a favorable Phase I environmental assessment or transfer by warranty deed, and a title insurance policy If either the Phase I environmental assessment or satisfactory title insurance expose liabilittes,then the City should not accept the property Attest N 'ity Clerk viewed for Administration Adopted,py the City Council December 18, 1995 Mayor Lyle Hanks Approved as to form and execution. au.a faces City Attorney
