A RESOLUTION GRANTING CONDITIONAL USE PERMIT UNDER
SECTION 14:5-5.3(D)(3) OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO PERMIT A MOTOR VEHICLE SERVICE AND
REPAIR FACILITY FOR PROPERTY ZONED C-2 GENERAL COMMERCIAL
DISTRICT LOCATED AT 7001 LAKE STREET WEST AND 6906 STATE
HIGHWAY 7.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. D. J. Investments (David Bomeman) has made application to the City
Council for a Conditional Use Permit under Section 14:5-5.3(D)(3) of the St. Louis Park
Ordinance Code for the purpose of permitting a motor vehicle service and repair facility
within a C-2 General Commercial District located at 7001 Lake Street West and 6906 State
Highway No. 7 for the legal description as follows, to -wit:
The West 1/2 of Lot 11 and all of Lots 12 to 18 inclusive, Block 35,
Rearrangement of St. Louis Park
Lot 19, Block 35, and Lots 1 to 5 inclusive, Block 188, including that part of
Davis Street now known as Georgia Avenue lying between extensions across it
of the Southeasterly line of Lake Street and a line running from the most
Southerly corner of Lot 2 of said Block 188 to the most Southerly corner of
said Lot 19, of said Block 35, Rearrangement of St. Louis Park, according to
the plat thereof on file or of record in the office of the Register of Deeds in
and for said County (Torrens)
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 95 -39 -CUP) and the effect of the proposed motor vehicle
service and repair facility on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area, the effect of the use on the Comprehensive Plan, and
compliance with the intent of the Zoning Ordinance.
3. The Council has determined that the proposed motor vehicle service and
repair facility will not be detrimental to the health, safety, or general welfare of the
community nor will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed motor vehicle service and repair
facility is in harmony with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
4. The contents of Planning Case File 95 -39 -CUP are hereby entered into and
made part of the public hearing record and the record of decision for this case.

5. ~No outdoor display or storage of equipment, parts, or products shall be allowed.
Except in emergencies, overnight parking of vehicles shall only be allowed in the
eastern -parking lot, which shall be screened by a 6 feet tall wood privacy fence.

6. Test driving shall be prohibited on any street in a Residential or Office Use District.

Conclusion
The Conditional Use Permit to permit a motor vehicle service and repair facility at the
location described is granted based on the findings set forth above and subject to the
following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A -
Site/Parking Plan and Landscape/Drainage Plan, Exhibit B - Floor Plan and Fence
Elevation and Exhibit C - Building Elevations; such documents incorporated by
reference herein and subject to the following conditions:
a. Turning radii shall be verified by the City Fire Marshall to ensure adequate
fire access prior to commencement of any site work.
b. A 6 -inch poured -in-place concrete curb shall be installed around the perimeter
of all parking and circulation drives, except where breaks for overland
drainage have been approved by the City Engineer after alternatives for
eliminating those breaks have been explored.
c. Drainage plan is preliminary only; final grading and drainage plans shall be
approved by the City Engineer prior to issuance of grading and building
permits. Watershed District and MNDOT approvals shall be obtained as
required.
d. The front parking lot shall be reconfigured so that all spaces are a minimum of
8-1/2 feet in width as measured from the inside face of the curb to the
centerlines of striping.
e. The Landscape Plan shall include two additional trees (one Spruce and one
Oak, Linden or Maple) in the Highway 7 bufferyard and the shrubs in front of
the chain link portion of the fence shall be changed to evergreens as approved
by the Planning Coordinator.
f. The wood privacy fence shall comply with the elevation detail except that
fence posts shall be cut to match the 6 feet height of the vertical boards. If
there is a difference in quality between the two sides of the fence, the fmished
side shall face the exterior of the property.
g. Final building materials and colors shall comply with the requirements of the
architectural design ordinance and shall be approved by the Director of
Community Development prior to issuance of building permits.
h. A Sign Permit shall be obtained prior to installation of any signage, and
maximum total sign area shall be limited to 260 square feet. If a pylon sign is
requested, the maximum size of each sign face shall be 10 square feet or the
proposed wall signage shall be reduced from that shown on the building
elevations.
2. Prior to issuance of the Certificate of Occupancy, all landscaping and irrigation
improvements shall be installed or fmancial surety for completion of said
improvements shall be provided in an amount determined by the Director of
Community Development.
3. No public address system shall be audible from any property in a Residential Use
District.
4. All repair, assembly, disassembly, and maintenance of vehicles shall be inside a closed
building.
