HomeMy WebLinkAbout95-106 - ADMIN Resolution - City Council - 1995/08/21RESOLUTION NO. 95-106 RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTIES BY PURCHASE OR EMINENT DOMAIN WHEREAS, the City of St. Louis Park, (the "City") is charged with the responsibility of providing public right of way for citizens within its boundaries; and WHEREAS, the City has determined that traffic signal and geometric improvements at the W. 38th Street/Excelsior Boulevard/Monterey Drive intersection are required to serve the transportation needs of its citizens; and WHEREAS, to accomplish the traffic signal and geometric improvements of said intersection, it is necessary to acquire the temporary and permanent real property rights, title and interests legally described on Exhibit "A" attached hereto (the "Property"). NOW, THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park: 1. That the recitals set forth above are found to be true and incorporated in the body of this resolution as it fully set forth herein. 2. That the City finds that it is necessary to construct a new traffic signal system along with geometric improvements at the W. 38th Street/Excelsior Boulevard/Monterey Drive intersection. 3. That the City and its staff, agents and attorneys are authorized to negotiate for the acquisition of the property both prior to commencing and throughout the eminent domain proceedings. 4. That in consultation with City staff, the attorneys for the City are directed to initiate quick -take eminent domain proceedings pursuant to Minnesota Statute Chapters 117 to acquire the property to permit the City to construct a new traffic signal system along with geometric improvements at the W. 38th Street/Excelsior Boulevard/Monterey Drive intersection. Which lies southerly of a line drawn from a point on the westerly line of said Lot 4 distant 21.50 feet northerly from the southwest corner of said Lot 4 to a point on the southerly line of said Lot 4 distant 101.00 feet easterly from said southwest corner. Said parcel contains 1,086 square feet more or less. PARCEL N0. 2 PIN: 06-028-24-43-0064 STREET ADDRESS: 4424 Excelsior Boulevard DESCRIPTION OF PARCEL: A perpetual easement for public right of way purposes over, under and across that part of the following described property: That part of Lot 16, Block 2, "Minikanda Vista 2nd Addition, Hennepin County," according to the recorded plat thereof which lies northwesterly of the northwesterly right of way line of Excelsior Boulevard as now laid out and traveled on July 20, 1995. Which lies southerly of a line drawn from a point on the southwesterly line of said Lot 16 distant 17.00 feet northwesterly from the intersection of the southwesterly line of said Lot 16 and the above described northwesterly right of way line to a point on said northerly right of way line distant 33.00 feet northeasterly from the above described intersection. Which lies easterly of a line drawn from a point on the northeasterly line of said Lot 1 distant 13.50 feet northwesterly from the intersection of the northeasterly line of said Lot 1 and the above described northwesterly right of way to a point on said northerly right of way line distant 18.00 feet southwesterly from the above described intersection. Said parcel contains 122 square feet more or less.
