LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT ADDITIONAL OVERNIGHT PARKING FOR RENTAL CARS FOR PROPERTY ZONED C-2 COMMERCIAL LOCATED AT 6801 WAYZATA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Ralph N. Bearman and Charlotte Bearman (Glass I Partners and Enterprise Rent-A-Car) has made application to the City Council for a Conditional Use Permit under Section 14:5-5.3(D)(2) of the St. Louis Park Ordinance Code for the purpose of permitting additional overnight parking for rental cars within a C-2 Commercial District located at 6801 Wayzata Boulevard for the legal description as follows, to -wit: EXHIBIT A - LEGAL DESCRIPTION 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 94 -24 -CUP) and the effect of the proposed additional overnight parking on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the additional overnight parking will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed additional overnight parking is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 94 -24 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The Conditional Use Permit to permit additional overnight parking at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Landscape Plan; such documents incorporated by reference herein. 2. No rental vehicles shall be parked overnight or during a weekend in the parking lot south of the building. 3. No Certificate of Occupancy issued until all improvements complete. Subject to building restrictions relating to use which reads as follows: "When said premises are improved it shall be by the erection of a dwelling of not leas than 5 rooms, same to have shingle roofing, drop siding and to be plastered and painted or said building may be of brick, cement or atone construction and that Said premises are not to be used for the conducting of a liquor business nor for immoral purposes"; Subject to minerals and mineral righte reserved by the State of Minnesota; Par 2: Lot 6 in "Richmond", according to the plat thereof on file or of record in the office of the Register of Deeds in and for said County. Subject to minerals and mineral rights reserved by the State of Minnesota; Par 1: Lots 1, 2 and 3 except highway in "Richmond", according to the plat thereof on file or of record in the office of the Register of Deeds in and for said County. That each of the following Lote and part of Lote is subject to building restrictions and restrictions relating to use which reads as follows: That said premises are not to be used for the conducting of a liquor business nor for moral purposes. That said Lots and pert of Lots subject to paid restrictions are situated in said Addition and are described ea follows to -wit: Lot 1 except highway, Lot 2 except highway, Lot 3 except highway Subject to minerals and mineral rights reserved by the State of Minnesota; Par 4: late 4 and 5 except parte of said Lote taken for state highway, "Richmond", according to the plat thereof on file or of record in the office of the Register of Deeds In and for said County. Subject to the restrictions on Lot 4 contained in a Deed recorded in Book 1087 of Deeds at page 463 in the office of the Register of Deeds of Hennepin County Minnesota but free from that portion of the restrictions which reads as follows: "When said premises are improved it shall be by the erection of a dwelling of not lose than five rooms, same to have shingle roofing, drop siding and to be plastered end painted or said dwelling may be of brick, cement or stone construction"; Subject to the restrictions on Lot 5 contained in a deed recorded in Book 852 of Deeds at page 322; of record in the office of the Register of Deeds of Hennepin County, Minnesota but free from that portion of the restrictions which reeds as follows: "ib duelling shall at any time be placed thereon with lees than five rooms, shingle roofing, drop siding, plastered and painted or of brick, cement or stone") (Torrens) Case No. 94 -24 -CUP
