RESOLUTION NO. 94-79
A RESOLUTION GRANTING CONDITIONAL USE PERMIT UNDER
SECTION 14:5-4.5(D)(1) OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO PERMIT A MULTIPLE FAMILY DWELLING
DEVELOPMENT OF 24 TOWNHOUSE AND APARTMENT UNITS FOR
PROPERTY ZONED R-4 MULTIPLE FAMILY RESIDENCE DISTRICT
LOCATED AT 2925 MONTEREY AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Monterey CoHousing Community has made application to the City Council
for a Conditional Use Permit under Section 14:5-4.5(D)(1) of the St. Louis Park Ordinance
Code for the purpose of permitting a multiple family dwelling development of 24
townhouse and apartment units within a R-4 Multiple Family Residence District located at
2925 Monterey Avenue. for the legal description as follows, to -wit:
Lot 22, Block 1, except the North 35.00 feet of that part of Lot 22 lying
Westerly of the Southerly extension of Lot 20, Block 1, and
also except the South 192.47 feet of the North 227.47 feet of the most
Westerly 35.00 feet of Lot 22; Block 1, Monterey Park (Torrens)
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 94 -9 -CUP) and the effect of the proposed multiple family
dwelling development on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area, the effect of the use on the Comprehensive Plan, and
compliance with the intent of the Zoning Ordinance.
3. The Council has determined that the proposed multiple family dwelling
development will not be detrimental to the health, safety, or general welfare of the
community nor will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed multiple family dwelling
development is in harmony with the general purpose and intent of the Zoning Ordinance
and the Comprehensive Plan.
4. The contents of Planning Case File 94 -9 -CUP are hereby entered into and
made part of the public hearing record and the record of decision for this case.
Conclusion
The Conditional Use Permit to permit a multiple family dwelling development of 24
townhouse and apartment units at the location described is granted based on the findings set
forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
Review plan, Exhibit B - Grading and Drainage Plan, Exhibit C - Utility Plan, Exhibit
D - Landscape Plan and Exhibit - E, Elevations to the extent that the elevations
indicate general architectural style and exterior building materials; such documents
incorporated by reference herein.
2. No Certificate of Occupancy issued until all improvements complete.
